    SC to ‘consider’ plea to revive NJAC: CJI

  • The Chief Justice of India (CJI) recently stated that the Supreme Court would consider a plea seeking to revive the National Judicial Appointments Commission (NJAC) and put an end to the existing Collegium System.

    • What is NJAC?

  • NJAC was envisaged as a constitutional body to handle appointments/transfers of judges to the higher judiciary (Supreme Court and High Courts). 
  • Under the 99th Constitutional Amendment Act, 2014 and the accompanying NJAC Act, 2014, new constitutional Articles (124A–124C) were inserted to establish NJAC.
  • Composition of NJAC: Chief Justice of India as the ex-officio Chairperson, the two senior-most judges of the Supreme Court, the Union Minister of Law and Justice, and two eminent persons.
  • The eminent persons were to be selected by a committee comprising the Prime Minister, the Chief Justice of India, and the Leader of Opposition in the Lok Sabha.

  • वैश्विक शक्ति संरचनाएँ भौतिक संपत्तियों (तेल, सामरिक मार्ग) से डिजिटल संप्रभुता की ओर स्थानांतरित हो गई हैं। किसी राष्ट्र का डिजिटल पदचिह्न अब धन का प्राथमिक स्रोत और कूटनीति का सबसे प्रभावी उपकरण है।

  • इसमें कानूनी और नियामक संरचनाएँ बनाना शामिल है जो डेटा निर्यात पर संप्रभु नियंत्रण और राष्ट्रीय डिजिटल क्षेत्र को विनियमित करने के अबाध अधिकार सुनिश्चित करती हैं। यह भौतिक स्तर (अवसंरचना, प्रौद्योगिकी), कोड स्तर (मानक, नियम और डिज़ाइन) और डेटा स्तर (स्वामित्व, प्रवाह और उपयोग) है।

    सर्वोच्च न्यायालय NJAC को पुनः प्रारंभ करने की याचिका पर ‘विचार’ करेगा: CJI

  • भारत के मुख्य न्यायाधीश (CJI) ने हाल ही में कहा कि सर्वोच्च न्यायालय उस याचिका पर विचार करेगा जिसमें राष्ट्रीय न्यायिक नियुक्ति आयोग (NJAC) को पुनः प्रारंभ करने और वर्तमान कोलेजियम प्रणाली को समाप्त करने की मांग की गई है।

    • NJAC क्या है? 

  • NJAC को एक संवैधानिक निकाय के रूप में परिकल्पित किया गया था, जिसका कार्य उच्च न्यायपालिका (सर्वोच्च न्यायालय और उच्च न्यायालयों) में न्यायाधीशों की नियुक्ति/स्थानांतरण करना था।
  • 99वें संविधान संशोधन अधिनियम, 2014 और साथ ही NJAC अधिनियम, 2014 के अंतर्गत नए संवैधानिक अनुच्छेद (124A–124C) जोड़े गए थे ताकि NJAC की स्थापना की जा सके।
