{"id":86327,"date":"2026-10-07T18:14:36","date_gmt":"2026-10-07T12:44:36","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=86327"},"modified":"2026-10-07T18:15:18","modified_gmt":"2026-10-07T12:45:18","slug":"legislative-privilege-freedom-of-speech","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/07-10-2026\/legislative-privilege-freedom-of-speech","title":{"rendered":"Legislative Privilege Versus Freedom of Speech and Expression"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/Polity<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court recently disposed of a more than two-decade-old dispute concerning the conflict between legislative privilege and freedom of speech and expression.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Background<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The matter arose from a <strong>2003 Tamil Nadu Legislative Assembly resolution<\/strong> against journalists over reports and an editorial critical of the state government and the then chief minister of the state.\n<ul class=\"wp-block-list\">\n<li>The Assembly treated the publication as a breach of privilege and ordered 15 days\u2019 imprisonment for five journalists. The Supreme Court stayed the arrest warrants.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The case raised questions about the scope of legislative privilege under <strong>Article 194(3)<\/strong> and its relationship with freedom of speech under <strong>Article 19(1)(a)<\/strong>, particularly when privilege is exercised against non-members.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Supreme Court Ruling<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Court disposed of the matter as infructuous, since the <strong>Tamil Nadu Legislative Assembly had withdrawn the 2003 resolution in 2004.<\/strong><\/li>\n\n\n\n<li>The Court did <strong>not decide the larger constitutional questions<\/strong> concerning the scope of legislative privilege and its relationship with <strong>Article 19(1)(a).<\/strong><\/li>\n\n\n\n<li>The Court kept these questions of law open for consideration in an appropriate future case.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What Are Legislative Privileges?<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Legislative Privileges: Article 105<\/strong> provides privileges and immunities to Parliament and its members.\n<ul class=\"wp-block-list\">\n<li><strong>Article 194(3)<\/strong> provides that the powers, privileges and immunities of a State Legislature and its members may be defined by the Legislature through law.<\/li>\n\n\n\n<li>These privileges are intended to enable legislatures and their members to <strong>function independently and effectively without undue external interference.<\/strong><\/li>\n\n\n\n<li>They include protection for speech and proceedings within the legislature and powers necessary to safeguard the authority and functioning of the House.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Right to Freedom of Speech and Expression<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 19(1)(a)<\/strong> guarantees citizens the fundamental right to freedom of speech and expression.<\/li>\n\n\n\n<li><strong>Article 19(2) of the Indian Constitution<\/strong> deals with the reasonable restrictions that can be placed on the <strong>fundamental right to freedom of speech and expression under Article 19(1)(a).\u00a0<\/strong><\/li>\n\n\n\n<li><strong>The conditions under which speech can be restricted by the state:<\/strong>\n<ul class=\"wp-block-list\">\n<li>Security of the State, Public Order, Decency or Morality, Contempt of Court, Defamation, Incitement to Offence.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Key Judicial Interventions<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>In M.S.M. Sharma v. Sri Krishna Sinha (1959),<\/strong> also known as <strong>Searchlight Case<\/strong> the Supreme Court of India ruled that the powers, privileges, and immunities of state legislatures under <strong>Article 194(3) <\/strong>prevail over the fundamental right to freedom of speech and expression under <strong>Article 19(1)(a).<\/strong><\/li>\n\n\n\n<li><strong>In Tej Kiran Jain v. N.
