class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <strong>National Biodiversity Authority (NBA)<\/strong> has crossed the <strong>\u20b9200-crore<\/strong> milestone in cumulative disbursements under<strong> India\u2019s Access and Benefit-Sharing (ABS) <\/strong>framework.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>About<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Madhya Pradesh and Maharashtra<\/strong> have emerged as the largest cumulative recipients among the states and UTs receiving the ABS proceeds.\u00a0<\/li>\n\n\n\n<li>The initiative also supports India\u2019s commitments under the<strong> Convention on Biological Diversity<\/strong>, the <strong>Nagoya Protocol on Access and Benefit-sharing<\/strong> and the <strong>Kunming-Montreal Global Biodiversity Framework,<\/strong> particularly <strong>Target 13<\/strong> on equitable benefit-sharing from the utilisation of genetic resources.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What is Access and Benefit-Sharing (ABS)?<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ABS is a mechanism to ensure the fair and equitable sharing of benefits arising from the utilisation of biological and genetic resources.<\/li>\n\n\n\n<li>It seeks to ensure that commercial users of biological resources contribute towards:\n<ul class=\"wp-block-list\">\n<li>Biodiversity conservation;<\/li>\n\n\n\n<li>Sustainable use of biological resources; and<\/li>\n\n\n\n<li>Welfare of local communities associated with such resources.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Utilisation of ABS funds<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Under <strong>Section 32(2)<\/strong> of the <strong>Biological Diversity Act, 2002<\/strong>, the funds can support:\n<ul class=\"wp-block-list\">\n<li>Preparation and updating of <strong>People&#8217;s Biodiversity Registers (PBRs);<\/strong><\/li>\n\n\n\n<li><strong>In-situ and ex-situ<\/strong> conservation of biodiversity;<\/li>\n\n\n\n<li>Restoration of degraded ecosystems;<\/li>\n\n\n\n<li>Strengthening of Biodiversity Heritage Sites;<\/li>\n\n\n\n<li>Capacity building of <strong>Biodiversity Management Committees (BMCs)<\/strong>; and<\/li>\n\n\n\n<li>Improving the livelihoods of local communities.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Biological Diversity Act, 2002<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Act was introduced to achieve the objectives of <strong>United Nations Convention on Biological Diversity (CBD), 1992.\u00a0<\/strong><\/li>\n\n\n\n<li>It provides a framework for <strong>access to biological resources and sharing the benefits arising out of such access and use. <\/strong>It is in line with the <strong>Nagoya Protocol on Access and Benefit Sharing.<\/strong><\/li>\n\n\n\n<li>The act envisaged a<strong> three-tier structure<\/strong> to regulate the access to biological resources: the National Biodiversity Authority (NBA),<strong> <\/strong>the State Biodiversity Boards (SBBs)<strong> <\/strong>and the Biodiversity Management Committees (BMCs).<\/li>\n\n\n\n<li><strong>The National Biodiversity Authority (NBA)<\/strong>\n<ul class=\"wp-block-list\">\n<li>It is a <strong>Statutory Body<\/strong> established in 2003 to implement India\u2019s Biological Diversity Act (2002).<\/li>\n\n\n\n<li><strong>It advises the Central Government<\/strong> on matters relating to the conservation of biodiversity, sustainable use of its components and equitable sharing of benefits arising out of the utilization of biological resources.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>The State Biodiversity Boards (SBBs)<\/strong><\/li>\n\n\n\n<li>They are established under <strong>Section 22<\/strong> of the Act and focus on advising the State Governments, subject to any guidelines issued by the Central Government, on matters relating to the conservation of biodiversity.<\/li>\n\n\n\n<li><strong>The Biodiversity Management Committees (BMCs)<\/strong>\n<ul class=\"wp-block-list\">\n<li>As per the Act,<strong> the local bodies constitute the BMC<\/strong> within their area of jurisdiction for the purpose of promoting conservation, sustainable use and documentation of biological diversity.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<div class=\"wp-block-group has-background\" style=\"background-color:#ebecf0\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\"><strong>Convention on Biological Diversity&nbsp;<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Origin:<\/strong> The Convention was opened for signature in<strong> 1992<\/strong> at the United Nations Conference on Environment and Development (<strong>Rio Earth Summit).<\/strong>\n<ul class=\"wp-block-list\">\n<li>The Convention on Biological Diversity (CBD) entered into force on <strong>29 December 1993.\u00a0<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>\u00a0The first session of the COP <\/strong>was scheduled in<strong> 1994 in the Bahamas<\/strong>.<\/li>\n\n\n\n<li><strong>Secretariat: <\/strong>Montreal, Canada.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Kunming-Montreal Global Biodiversity Framework<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Kunming-Montreal Global Biodiversity Framework was concluded at COP15 of the Convention on Biological Diversity (CBD), held in <strong>Montreal, Canada, in 2022.\u00a0<\/strong><\/li>\n\n\n\n<li>This framework is a landmark agreement aimed at addressing the global biodiversity crisis.<\/li>\n\n\n\n<li>It features <strong>23 targets to be met by 2030<\/strong> and <strong>four global goals for 2050 <\/strong>to preserve biodiversity for current and future generations.<\/li>\n\n\n\n<li>The agreement is <strong>not binding<\/strong> on members<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Nagoya Protocol<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization (ABS) is a supplementary agreement to the <strong>Convention on Biological Diversity (CBD).<\/strong><\/li>\n\n\n\n<li>It provides a transparent legal framework for the effective implementation of one of the three objectives of the CBD:<strong> the fair and equitable sharing of benefits arising out of the utilization of genetic resources.<\/strong><\/li>\n\n\n\n<li>It was adopted in <strong>2010 in Nagoya,<\/strong> Japan and entered into force in <strong>2014.<\/strong><\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Source: <\/strong><a
