{"id":82052,"date":"2026-08-21T18:46:17","date_gmt":"2026-08-21T13:16:17","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=82052"},"modified":"2026-08-21T18:48:37","modified_gmt":"2026-08-21T13:18:37","slug":"supreme-court-industry-definition-irc-2020","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/21-08-2026\/supreme-court-industry-definition-irc-2020","title":{"rendered":"Supreme Court\u2019s New Ruling on the Definition of \u2018Industry\u2019"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/Governance<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court has ruled that the definition of <strong>\u201cindustry\u201d under the Industrial Relations Code (IRC), 2020 <\/strong>must be interpreted independently and will not automatically be governed by the landmark <strong>1978 Bangalore Water Supply judgment.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The 1978 Bangalore Water Supply Judgement<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In<strong> Bangalore Water Supply and Sewerage Board v. R. Rajappa (1978),<\/strong> a seven-judge bench, adopted a broad interpretation of \u201cindustry\u201d under Section <strong>2(j) of the Industrial Disputes Act, 1947.<\/strong><\/li>\n\n\n\n<li>The judgement evolved the <strong>Triple Test<\/strong>, under which an activity could qualify as an industry when it involved:\n<ul class=\"wp-block-list\">\n<li>Systematic and organised activity;<\/li>\n\n\n\n<li>Organised by cooperation between employer and employee;<\/li>\n\n\n\n<li>Production and\/or distribution of goods or services calculated to satisfy human wants and wishes.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The interpretation brought several establishments, including <strong>hospitals, educational institutions and municipalities,<\/strong> within the ambit of labour law.\n<ul class=\"wp-block-list\">\n<li>Core sovereign functions, such as <strong>defence, judiciary and law enforcement, <\/strong>were generally excluded.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Supreme Court Ruling<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Court held that the meaning of \u201cindustry\u201d under Section 2(p) of the IRC, 2020, must be determined from the language, structure and context of the new Code itself.<\/li>\n\n\n\n<li>The interpretation of the term \u2018industry\u2019 under IRC would be done on a <strong>clean slate.<\/strong><\/li>\n\n\n\n<li>The 1978 judgement will continue to govern pending disputes under the Industrial Disputes Act, 1947.
