{"id":81850,"date":"2026-08-18T18:18:57","date_gmt":"2026-08-18T12:48:57","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=81850"},"modified":"2026-08-18T18:19:37","modified_gmt":"2026-08-18T12:49:37","slug":"black-money-in-elections","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/18-08-2026\/black-money-in-elections","title":{"rendered":"Black Money in Elections Hampers Democracy: SC"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/Polity and Governance<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court has recently passed directives to check unexplained cash and electoral offences, stating that voter choices influenced by illicit money are detrimental to free and fair elections and the \u2018<strong>very essence of democracy\u2019.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Black Money in Elections<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The black money in elections is used to influence voters, support the campaign, distribute cash or gifts and fulfil election related expenses through unaccounted or undeclared money outside the legal framework.\n<ul class=\"wp-block-list\">\n<li>It creates an uneven electoral playing field and can develop a link between money, crime and politics.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The issue came before the Supreme Court in <strong><em>Prathik Parasrampuria v. State of Karnataka<\/em><\/strong><strong>,<\/strong> arising from a Karnataka High Court decision (2015) quashing an FIR concerning alleged hoarding of cash for voter bribery.\n<ul class=\"wp-block-list\">\n<li>The Court expanded the proceedings to examine the broader systemic problem of black money in elections.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Current Status<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <strong>Election Commission of India (ECI)<\/strong> placed before the Court data showing <strong>3,87,430 FIRs<\/strong> registered during the <strong>2024 Lok Sabha elections<\/strong>, of which only about <strong>42.9% (1,66,044)<\/strong> had resulted in convictions, with the remainder pending investigation or trial.<\/li>\n\n\n\n<li>The Court noted that the withdrawal of election-related prosecutions, following changes in administration, could give rise to an impression of impunity.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Why Black Money Threaten Democracy?<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Distorting Voter Choice:<\/strong> Financial incentives turn an informed election choice into a transaction.<\/li>\n\n\n\n<li><strong>Creates an Unequal Playing Field:<\/strong> Candidates with more access to illicit financing have an unfair advantage.<\/li>\n\n\n\n<li><strong>Promotes Criminalisation:<\/strong> Unaccounted money can help to increase the link between crime, business and politics.<\/li>\n\n\n\n<li><strong>Destroys Public Confidence<\/strong>: The perception of electoral manipulation undermines confidence in democratic institutions .<\/li>\n\n\n\n<li><strong>Encourages Policy Capture: <\/strong>Candidates reliant on illicit finance may become subject to private interests.<\/li>\n\n\n\n<li><strong>Undermines Democratic Equality: <\/strong>Too much money in politics can drown out the political voice of less well-off persons.\n<ul class=\"wp-block-list\">\n<li>The Supreme Court referred to Justice HR Khanna\u2019s statement in Indira Nehru Gandhi v. Raj Narain that democracy depends upon faith in free and fair elections.<\/li>\n\n\n\n<li>In <strong>Anoop Baranwal v. Union of India,<\/strong> it reiterated that \u2018<strong><em>the ballot is more potent than the most powerful gun\u2019.<\/em><\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Constitutional, Legal and Institutional Framework<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Election Commission:<\/strong> Detects unlawful campaign spending with expenditure monitors, Static Surveillance Teams and Flying Squads\n<ul class=\"wp-block-list\">\n<li><strong>Article 324<\/strong> confers the comprehensive authorities for conduct and monitoring of elections in the Election Commission.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Representation of the People Act, 1951:<\/strong> It provides the statutory framework dealing with electoral offences, corrupt practices and election expenditure.<\/li>\n\n\n\n<li><strong>Income Tax Authorities:<\/strong> Investigate unexplained cash and assets, including seizures over prescribed criteria.<\/li>\n\n\n\n<li><strong>Judiciary: <\/strong>Reviews electoral issues and ensures that prosecutions and withdrawals relating to elections are in accordance with the law.<\/li>\n\n\n\n<li>The Court traced the issues of financial disparity to Kanwar Lal Gupta v. Amar Nath Chawla (1975), <strong>Goswami Committee Report (1990), Vohra Committee Report (1993) <\/strong>and <strong>255th Report of Law Commission (2015).<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Supreme Court&#8217;s Recent Directions<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Court directed that:\n<ul class=\"wp-block-list\">\n<li>Seized cash\/assets need to be reported to the jurisdictional District Magistrate\/Additional District Magistrate\/Court <strong>within 24 hours<\/strong>, with reasons establishing a prima facie electoral nexus.<\/li>\n\n\n\n<li>Investigations should ordinarily be completed <strong>within one year<\/strong>;
