{"id":81088,"date":"2026-08-08T20:21:29","date_gmt":"2026-08-08T14:51:29","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=81088"},"modified":"2026-08-08T20:33:17","modified_gmt":"2026-08-08T15:03:17","slug":"money-bill-judges-amendment-2026","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/08-08-2026\/money-bill-judges-amendment-2026","title":{"rendered":"Money Bill Passed to Increase Judges\u2019 Number: Why This Route Faces Legal Challenge?"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/Polity and Governance<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Rajya Sabha has passed the <strong>Supreme Court (Number of Judges) Amendment Bill, 2026.<\/strong>\n<ul class=\"wp-block-list\">\n<li>The Bill <strong>was passed as a money Bill,<\/strong> a route it had also taken in 2019 when the Supre\u00adme Court strength was raised to 34.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>About<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The issue of <strong>whether a Bill can be certified as a money Bill <\/strong>is a key question pending for consideration by a seven-judge Constitution Bench.\u00a0<\/li>\n\n\n\n<li><strong>In 2023,<\/strong> the then Chief Justice of India D Y Chandrachud had said that the case would be listed for hearing soon. However, the issue is yet to be taken up.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Types of Bills<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>There are four types of Bills:<\/strong> Constitution Amendment Bills; Money Bills; Financial Bills; and Ordinary Bills.\n<ul class=\"wp-block-list\">\n<li><strong>Constitution Amendment Bills:<\/strong> These are Bills which seek to amend the Constitution.<\/li>\n\n\n\n<li><strong>Money Bills:<\/strong> A Bill is said to be a Money Bill if it only contains provisions related to taxation, borrowing of money by the government, expenditure from or receipt to the Consolidated Fund of India.\n<ul class=\"wp-block-list\">\n<li>Bills that only contain provisions that are incidental to these matters would also be regarded as Money Bills.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Financial Bills:<\/strong> A Bill that contains some provisions related to taxation and expenditure, and additionally contains provisions related to any other matter is called a Financial Bill.\n<ul class=\"wp-block-list\">\n<li>Therefore, if a Bill merely involves expenditure by the government, and addresses other issues, it will be a financial bill.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Ordinary Bills:<\/strong> All other Bills are called ordinary bills.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img data-dominant-color=\"d8dede\" data-has-transparency=\"false\" style=\"--dominant-color: #d8dede;\" loading=\"lazy\" decoding=\"async\" width=\"600\" height=\"400\" src=\"https:\/\/wp-images.nextias.com\/cdn-cgi\/image\/format=auto\/ca\/uploads\/2026\/08\/image-73.png\" alt=\"money bill vs other bills\" class=\"not-transparent wp-image-81089\" srcset=\"https:\/\/wp-images.nextias.com\/cdn-cgi\/image\/format=auto\/ca\/uploads\/2026\/08\/image-73.png 600w, https:\/\/wp-images.nextias.com\/cdn-cgi\/image\/format=auto\/ca\/uploads\/2026\/08\/image-73-300x200.png 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/figure>\n<\/div>\n\n\n<h2 class=\"wp-block-heading\"><strong>Article 110(1) (g)<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 110(1) (g) <\/strong>adds that<strong> \u201cany matter incidental to any of the matters specified in Articles 110(1)(a)-(f)\u201d<\/strong> can also be a money Bill.\n<ul class=\"wp-block-list\">\n<li>This additional clause has been the <strong>basis for the government to pass key legislations as money Bills in its previous terms.\u00a0<\/strong><\/li>\n\n\n\n<li>The Opposition had argued then that this was done only because the <strong>government did not have the numbers to get these legislations cleared in the Rajya Sabha.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The <strong>Speaker <\/strong>certifies a Bill as a Money Bill, and the<strong> Speaker\u2019s decision is final.\u00a0<\/strong>\n<ul class=\"wp-block-list\">\n<li>Also, the Constitution states that parliamentary proceedings as well as officers responsible for the conduct of business (such as the Speaker) may not be questioned by any Court.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Supreme Court\u2019s Take<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The constitutionality of three major laws<\/strong>, including the Prevention of Money Laundering Act, are yet to be examined by the larger bench in the light of <strong>whether these laws qualify to be passed as a money Bill.\u00a0<\/strong>\n<ul class=\"wp-block-list\">\n<li>The other two are the Aadhaar Act and the 2017 amendments altering service conditions of Tribunals.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>While the PMLA and Aadhaar Act were substantially upheld by the Court, the <strong>Supreme Court struck down the tribunal amendments as unconstitutional.\u00a0<\/strong>\n<ul class=\"wp-block-list\">\n<li>However, in<strong> both rulings the issue of money Bill <\/strong>was left to a larger bench to decide.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p><strong>Source: IE<\/strong><\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p><strong> Context <\/strong><\/p>\n<li class=\"ms-5\"> The Rajya Sabha has passed the Supreme Court (Number of Judges) Amendment Bill, 2026. <\/li>\n<p><\/p>\n<p><strong> About <\/strong><\/p>\n<li class=\"ms-5\"> The issue of whether a Bill can be certified as a money Bill is a key question pending for consideration by a seven-judge Constitution Bench.\u00a0 <\/li>\n<li class=\"ms-5\"> In 2023, the then Chief Justice of India D Y Chandrachud had said that the case would be listed for hearing soon.
