{"id":80581,"date":"2026-08-01T18:06:33","date_gmt":"2026-08-01T12:36:33","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=80581"},"modified":"2026-08-01T18:08:53","modified_gmt":"2026-08-01T12:38:53","slug":"national-honour-amendment-bill-2026","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/01-08-2026\/national-honour-amendment-bill-2026","title":{"rendered":"Parliament Passed Prevention of Insults to National Honour (Amendment) Bill, 2026"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/Polity and Governance<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Parliament has passed the Prevention of Insults to National Honour (Amendment) Bill, 2026, extending the same legal protection currently available to the National Anthem (<em>Jana Gana Mana<\/em>) to the National Song (<em>Vande Mataram<\/em>).\u00a0<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Key Highlights<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Bill amends<strong> Section 3 <\/strong>of the Prevention of Insults to National Honour Act, 1971.\u00a0<\/li>\n\n\n\n<li>It makes it an offence to:\n<ul class=\"wp-block-list\">\n<li>intentionally prevent the singing of <strong>Vande Mataram<\/strong>; or<\/li>\n\n\n\n<li>disturb an assembly engaged in singing it.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The punishment remains unchanged: imprisonment up to <strong>3 years<\/strong>, or fine, or both.<\/li>\n\n\n\n<li>The enhanced punishment under <strong>Section 3A<\/strong> for repeat offenders will also apply.\u00a0<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Why was the Amendment Proposed<\/strong><strong>?<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Although Dr. Rajendra Prasad, while addressing the Constituent Assembly on <strong>24 January 1950<\/strong>, stated that <em>Vande Mataram<\/em> should be honoured equally with <em>Jana Gana Mana<\/em>, the <strong>Prevention of Insults to National Honour Act, 1971<\/strong> provided statutory protection only to the National Anthem, creating a legislative gap that the Amendment seeks to address.\u00a0<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Prevention of Insults to National Honour Act, 1971<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Enacted on 23rd December 1971, the Act extends to the whole of India and provides statutory protection to the <strong>Indian National Flag, the Constitution of India and the Indian National Anthem, Jana Gana Mana<\/strong>.<\/li>\n\n\n\n<li><strong>Key Provisions of the Existing Act:<\/strong>\n<ul class=\"wp-block-list\">\n<li><strong>Section 2 &#8211;<\/strong> <strong>National Flag and Constitution:<\/strong> Deals with insults to the Indian National Flag and the Constitution of India. It stipulates that anyone who burns, mutilates, defaces, defiles, disfigures, destroys, tramples upon, or otherwise shows disrespect to the Flag or the Constitution in a public place can face imprisonment for up to three years, a fine, or both.<\/li>\n\n\n\n<li><strong>Lawful criticism protected: <\/strong>Comments criticising the Constitution, the National Flag or government measures, when made with a view to securing lawful amendment or alteration, do not constitute an offence under Section 2.<\/li>\n\n\n\n<li><strong>Section 3 &#8211; National Anthem: <\/strong>Specifically addresses the National Anthem.
