{"id":80210,"date":"2026-07-28T18:03:23","date_gmt":"2026-07-28T12:33:23","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=80210"},"modified":"2026-07-28T18:05:21","modified_gmt":"2026-07-28T12:35:21","slug":"supreme-court-protest-guidelines","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/28-07-2026\/supreme-court-protest-guidelines","title":{"rendered":"Supreme Court to Frame Guidelines for Police Handling of Public Protests"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/Polity and Governance<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court of India decided to lay down pan-India guidelines on the police\u2019s handling of public protests, acknowledging the constitutional right to peaceful protest but also emphasising the value of a law-enforcer\u2019s life.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Background<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The order was passed on <strong>petitions alleging police excesses<\/strong> during the nationwide protests by students after the NEET exam paper leak.\u00a0<\/li>\n\n\n\n<li>The petitioners sought <strong>national norms to regulate the police response to demonstrations<\/strong> and to avoid the arbitrary use of force.<\/li>\n\n\n\n<li>The Court said peaceful protest is a cornerstone of democracy but said protests should be peaceful and cannot violate the rights of others or threaten public safety.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Constitutional Basis of the Right to Protest<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Constitution does not explicitly mention a <strong>&#8220;right to protest&#8221;<\/strong>; however, it is derived from several Fundamental Rights:\n<ul class=\"wp-block-list\">\n<li><strong>Article 19(1)(a):<\/strong> Freedom of speech and expression.<\/li>\n\n\n\n<li><strong>Article 19(1)(b):<\/strong> Right to assemble peacefully and without arms.<\/li>\n\n\n\n<li><strong>Article 19(1)(c): <\/strong>Right to form associations or unions.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>However these rights are subject to reasonable restrictions under:\n<ul class=\"wp-block-list\">\n<li><strong>Article 19(2):<\/strong> Sovereignty and integrity of India, security of the State, public order, decency, morality, etc.<\/li>\n\n\n\n<li><strong>Article 19(3):<\/strong> Restrictions on peaceful assembly in the interest of public order and sovereignty.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Challenges in Tackling Public Unrest<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Distinguishing peaceful protestors<\/strong> from violent or anti-social forces that infiltrate protests.<\/li>\n\n\n\n<li><strong>Maintaining public order <\/strong>while not compromising on fundamental freedoms, especially during big demonstrations.<\/li>\n\n\n\n<li><strong>Handling misinformation and rumours<\/strong> circulating on social media, which can quickly increase emotions.<\/li>\n\n\n\n<li><strong>Avoid disruption<\/strong> to vital public services, transport infrastructure and economic activity during extended demonstrations.<\/li>\n\n\n\n<li><strong>Ensuring the safety and lives <\/strong>of both demonstrators and police in hazardous situations.<\/li>\n\n\n\n<li><strong>Limited availability of current crowd-control tools<\/strong>, including body cameras, surveillance systems and non-lethal technologies;<\/li>\n\n\n\n<li><strong>Lack of staff <\/strong>and lack specialist training are among the capacity constraints of police units.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Supreme Court Judgments<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Ramlila Maidan Incident (2012):<\/strong> The Supreme Court of India held that peaceful protest is a basic right, the freedom to sleep is part of life under <strong>Article 21<\/strong> and midnight police crackdowns on sleeping masses are illegal.<\/li>\n\n\n\n<li><strong>Mazdoor Kisan Shakti Sangathan v. Union of India (2018): <\/strong>The Supreme Court concluded that the right to peaceful protest is a fundamental right under Article 19(1)(a) and Article 19(1)(b).\n<ul class=\"wp-block-list\">\n<li>It said limits on public meetings must pass the requirements of constitutionality of reasonableness, necessity and proportionality.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Amit Sahni v. Commissioner of Police (2020): <\/strong>The Court held that <strong>public routes and public spaces cannot be occupied indefinitely for protests<\/strong> balancing the fundamental right to peaceful dissent with the rights of the general public.<\/li>\n\n\n\n<li><strong>D.K. Basu v. State of West Bengal (1997):<\/strong> The Court established down necessary standards to prohibit arbitrary arrest, detention and custodial assault. It held that police powers must be exercised in accordance with the rule of law and <strong>Article 21 of the Constitution.<\/strong><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Way Ahead<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Formulate standard <strong>pan-India Standard Operating Procedures (SOPs)<\/strong> for police dealing with peaceful protests in accordance with Supreme Court instructions.<\/li>\n\n\n\n<li>Embed the <strong>principles of necessity, proportionality and minimum use of force<\/strong> in crowd control activities.<\/li>\n\n\n\n<li><strong>Strengthen the implementation<\/strong> of the Supreme Court&#8217;s orders on police reforms, operational autonomy and accountability in <strong>Prakash Singh v.
