{"id":80082,"date":"2026-07-25T18:08:19","date_gmt":"2026-07-25T12:38:19","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=80082"},"modified":"2026-07-25T18:09:43","modified_gmt":"2026-07-25T12:39:43","slug":"sc-court-videos-social-media","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/25-07-2026\/sc-court-videos-social-media","title":{"rendered":"SC Prohibits Unauthorised Recording, Monetisation of Court Videos on Social Media"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/Polity and Governance<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The SC ha<strong>s prohibited the extraction, editing, dissemination, reposting, uploading or monetisation <\/strong>of<strong> audio and video recordings of judicial proceedings<\/strong> on social media and other digital platforms<strong> without prior permission from the concerned court.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>About<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The court clarified that the<strong> interim order<\/strong> would<strong> not affect fair news reporting of judicial proceedings.<\/strong><\/li>\n\n\n\n<li>The High Courts have also been asked to submit reports on the adoption of the <strong>Supreme Court&#8217;s model livestreaming guidelines and explain the impact of continuous livestreaming of proceedings.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Live Streaming of Court Proceedings<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The SC began livestreaming proceedings before its Constitution Benches<strong> in 2022.<\/strong><\/li>\n\n\n\n<li><strong>Aim: <\/strong>To make judicial proceedings <strong>more transparent and accessible<\/strong> to the public.\u00a0<\/li>\n\n\n\n<li>It followed the court\u2019s September 2018 ruling in<strong> Swapnil Tripathi v. Union of India, <\/strong>which had declared<strong> live telecast of court proceedings part of the right to access justice under Article 21 of the Constitution.<\/strong>\n<ul class=\"wp-block-list\">\n<li>It stated that <strong>livestreaming would \u201cvirtually\u201d expand the court beyond the four walls of the courtroom.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Subsequently<strong>, the Supreme Court\u2019s e-Committee,<\/strong> <strong>headed by then CJI<\/strong> Chandrachud, came out with <strong>model guidelines to regulate livestreaming of court proceedings in India.<\/strong><\/li>\n\n\n\n<li>In 2023, the Supreme Court became the<strong> first court in India to introduce AI-assisted live transcription of its proceedings.<\/strong>\n<ul class=\"wp-block-list\">\n<li>Announcing the initiative, then CJI Chandrachud said the <strong>technology would create a reliable archival record of court proceedings<\/strong> while serving as a <strong>valuable resource for the judiciary.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Concerns<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Livestreaming <\/strong>was introduced to <strong>promote transparency and the principle of open justice, the absence of a regulatory framework <\/strong>has enabled courtroom recordings to be clipped, edited and circulated with misleading captions.\n<ul class=\"wp-block-list\">\n<li>Selectively edited clips were often used to <strong>create misleading narratives about court proceedings.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>The misuse of recordings of judicial proceedings<\/strong> has a<strong> \u201cchilling effect\u201d<\/strong> on the functioning of both judges and lawyers by exposing them to \u201ccharacter assassination\u201d and \u201cpublic trolling\u201d.<\/li>\n\n\n\n<li>Such circulation creates a climate of<strong> hostility, misinformation, and deliberate sensationalism<\/strong> around<strong> judicial proceedings,<\/strong> thereby <strong>undermining public confidence in the administration of justice.<\/strong><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Way Ahead<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Frame a Comprehensive Regulatory Framework: <\/strong>Establish clear legal and procedural guidelines governing the recording, reproduction, dissemination and commercial use of livestreamed court proceedings while balancing transparency with the integrity of the judicial process.<\/li>\n\n\n\n<li><strong>Strengthen Technological Safeguards: <\/strong>Deploy digital watermarking, content authentication tools and AI-based monitoring systems to detect unauthorised editing, deepfakes and misuse of judicial recordings across digital platforms.<\/li>\n\n\n\n<li><strong>Ensure Uniform Implementation of Livestreaming Guidelines: <\/strong>High Courts should adopt and periodically review the Supreme Court&#8217;s model livestreaming guidelines.<\/li>\n\n\n\n<li><strong>Enhance Public Legal Awareness: <\/strong>Conduct awareness campaigns highlighting the legal consequences of unauthorised
