{"id":78376,"date":"2026-07-04T18:33:09","date_gmt":"2026-07-04T13:03:09","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=78376"},"modified":"2026-07-04T18:34:30","modified_gmt":"2026-07-04T13:04:30","slug":"india-israel-bia","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/04-07-2026\/india-israel-bia","title":{"rendered":"India-Israel Bilateral Investment Agreement (BIA)"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/ IR<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Bilateral Investment Agreement (BIA) between India and Israel signed in September 2025, enters into force with e\ufb00ect from 4 July 2026.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>About<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Israel has become the first <strong>OECD (Organisation for Economic Co-operation and Development) <\/strong>member state to sign an investment pact under India\u2019s new model treaty framework.\n<ul class=\"wp-block-list\">\n<li>The BIA replaces the earlier investment treaty signed in <strong>1996<\/strong>, which was terminated in 2017 as part of India\u2019s policy overhaul on such agreements.\u00a0<\/li>\n\n\n\n<li>The Agreement will increase bilateral investments, which presently stands at a total of<strong> USD 800 million.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Key Provisions of the Agreement<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Definition and Scope of Investment:<\/strong> The agreement defines an investment as one that complies with the host country&#8217;s laws and possesses characteristics such as commitment of capital, expectation of profit, and assumption of risk.\n<ul class=\"wp-block-list\">\n<li>It limits treaty protection to investments made in accordance with domestic laws and excludes portfolio investments and speculative assets from the definition.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Right to Regulate:<\/strong> The BIA reaffirms the sovereign right of both countries to regulate investments in pursuit of legitimate policy objectives, including public health, environmental protection, taxation and national security.\n<ul class=\"wp-block-list\">\n<li>It also contains provisions preventing <strong>treaty shopping<\/strong> by denying treaty benefits to shell companies or investors that restructure solely to gain access to the agreement&#8217;s dispute resolution mechanism.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Taxation Provisions: <\/strong>The agreement contains a comprehensive <strong>tax carve-out, <\/strong>limiting the scope for investors to challenge tax measures through international arbitration. Except in cases involving allegations of expropriation, taxation measures are generally excluded from the treaty&#8217;s dispute settlement mechanism.\n<ul class=\"wp-block-list\">\n<li>The treaty also requires investors to comply with all applicable tax laws, regulations and administrative guidelines of the host country.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>On dispute settlement,<\/strong> investors must first seek to resolve disputes through consultations and are required to exhaust domestic legal remedies before initiating international arbitration.\n<ul class=\"wp-block-list\">\n<li>International arbitration can be initiated only after the domestic proceedings have concluded or <strong>after five years have elapsed<\/strong>, whichever is earlier.\u00a0<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>National Security Exception:<\/strong> The treaty includes a strong essential security exception, under which either government may take measures it considers necessary to protect its national security interests.\n<ul class=\"wp-block-list\">\n<li>Such decisions are expressly made non-justiciable, meaning arbitral tribunals cannot review a country&#8217;s decision to invoke the security exception, even in compensation claims.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>India and Israel Bilateral Relations<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Bilateral Relations: <\/strong>India announced its recognition of Israel in 1950. Regular embassies opened in <strong>1992<\/strong> when full diplomatic relations were established between the two countries.\n<ul class=\"wp-block-list\">\n<li>In 2022-23, the two countries jointly celebrated <strong>30 years<\/strong> of the elevation of bilateral ties to full diplomatic ties.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Defense &amp; Security: <\/strong>Israel has been a key supplier of advanced technology from AWACS (Airborne Warning and Control System) radars and drones to missile and surveillance systems making it one of India\u2019s largest defense suppliers.<\/li>\n\n\n\n<li><strong>Economic Relations: <\/strong>In FY 2023-24 and <strong>FY 2024-25<\/strong> the bilateral trade (excluding defense) was US$ 6.53 billion and <strong>US$3.75 billion<\/strong> respectively.\n<ul class=\"wp-block-list\">\n<li>In <strong>2017<\/strong>, both sides signed and exchanged seven MoUs on cooperation in the areas of <strong>innovation, technology, water, agriculture, and space &amp; science.<\/strong>\u00a0<\/li>\n\n\n\n<li><strong>A US$ 40 million<\/strong> India-Israel Industrial R&amp;D and<strong> Technological Innovation Fund (I4F)<\/strong> for joint projects was also set up.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Multilateral Cooperation:<\/strong> Both are active members of the <strong>I2U2 group <\/strong>(India, Israel, USA, UAE), focusing on economic and space collaboration with projects like food parks and space-based environmental tools.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Significance for India<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Defence &amp; security:<\/strong> Israel is a reliable partner for critical technologies for India and can be instrumental in India\u2019s Self Reliance and Make in India.<\/li>\n\n\n\n<li><strong>Agriculture &amp;
