{"id":73123,"date":"2026-05-06T18:15:40","date_gmt":"2026-05-06T12:45:40","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=73123"},"modified":"2026-05-06T18:16:41","modified_gmt":"2026-05-06T12:46:41","slug":"pil-private-interest-litigation","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/06-05-2026\/pil-private-interest-litigation","title":{"rendered":"PIL has Become \u2018Private Interest Litigation\u2019: SC"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/Polity and Governance<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court judge has said <strong>Public Interest Litigation (PIL),<\/strong> has lately metamorphosed into<strong> \u2018private interest litigation\u2019, \u2018publicity interest litigation\u2019 and even \u2018paisa\u2019 and \u2018political\u2019 interest litigation.\u00a0<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Public Interest Litigation (PIL)<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Public Interest Litigation (PIL) means a case or petition filed before a court to <strong>protect, safeguard or enforce public interest.\u00a0<\/strong><\/li>\n\n\n\n<li>It is a unique mechanism initiated by the <strong>Indian judiciary post-Emergency<\/strong> to \u201cbring social justice within the reach of the common man\u201d,.\u00a0<\/li>\n\n\n\n<li>PIL is <strong>not explicitly mentioned in the Constitution<\/strong> but has evolved through judicial interpretation.<\/li>\n\n\n\n<li><strong>All Indian citizens or organisations<\/strong> can file a public interest litigation petition before the<strong> Supreme Court under Article 32 <\/strong>or the <strong>High Courts under Article 226 <\/strong>of the Constitution.\n<ul class=\"wp-block-list\">\n<li>However, the person or organisation filing the PIL petition must prove to the court that the <strong>PIL is being filed for an issue concerning public interest<\/strong> and that it will benefit the public at large.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>A PIL can only be filed against the Central Government, municipal governments or State Government and <strong>not against individuals.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Some Landmark Judgements in India<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Hussainara Khatoon vs. State of Bihar case: <\/strong>This case was the first reported instance of PIL in India, which brought attention to the issue of inhuman conditions of prisoners and undertrial prisoners.\u00a0<\/li>\n\n\n\n<li><strong>Vishaka vs. State of Rajasthan:<\/strong> This case is related to the issue of sexual harassment in the workplace. As a result, the Vishaka Guidelines came into effect, published in 1997.<\/li>\n\n\n\n<li><strong>M.C. Mehta vs. Union of India: <\/strong>This case is related to pollution in the Ganges basin. Directions were given to prevent the consequences of water and air pollution on millions of people in the Ganga basin.<\/li>\n\n\n\n<li><strong>Parmanand Katara vs. Union of India: <\/strong>This case was filed to facilitate hospitals to handle emergency accident cases without concern for pending police investigations.\n<ul class=\"wp-block-list\">\n<li>The judgment made it obligatory for a hospital or doctor, public and private, to provide immediate medical aid to a road accident victim.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Significance of Public Interest Litigation<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It ensures that <strong>public bodies are accountable<\/strong> by acting reasonably within the limits of their powers and ensures they make precise choices.\u00a0<\/li>\n\n\n\n<li>It expands the <strong>scope of law<\/strong> by helping the judges to understand legislation and develop laws.\u00a0<\/li>\n\n\n\n<li>It helps to <strong>focus attention on broader public issues <\/strong>in the areas of consumer welfare, environment and human rights.<\/li>\n\n\n\n<li>It gives<strong> weak people a voice<\/strong> by emphasising a significant issue and gives them a platform to advocate their rights.\u00a0<\/li>\n\n\n\n<li>It also helps <strong>raise awareness<\/strong> of critical public problems through <strong>media coverage and debates.\u00a0<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Concerns related to Public Interest Litigation<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Indian Judiciary is<strong> already burdened<\/strong> with a heavy caseload due to pending cases, and PIL petitions <strong>may add to that burden.<\/strong><\/li>\n\n\n\n<li>Petitions without a significant public issue <strong>can waste the courts\u2019 time.\u00a0<\/strong><\/li>\n\n\n\n<li>Sometimes, PIL<strong> may be abused by individuals <\/strong>pushing for personal grievances instead of championing public causes, and thus, public interest litigation may become private interest litigation.<\/li>\n\n\n\n<li>The <strong>lack of effective implementation of court judgments<\/strong> is a significant issue hindering successful PIL implementation.<\/li>\n\n\n\n<li>Sometimes, PILs <strong>may lead to Judicial Overreach, <\/strong>i.e. courts entering the domain of the legislative and executive branches of government.<\/li>\n<\/ul>\n\n\n\n<h3
