{"id":71620,"date":"2026-04-15T20:38:04","date_gmt":"2026-04-15T15:08:04","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=71620"},"modified":"2026-04-15T20:38:48","modified_gmt":"2026-04-15T15:08:48","slug":"digital-piracy-law","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/15-04-2026\/digital-piracy-law","title":{"rendered":"Digital Piracy &amp; Legal Consequences"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/Governance<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Recently, the Vijay-starrer <em>Jana Nayagan<\/em> was leaked online in <strong>high quality before theatrical release, <\/strong>indicating <strong>insider involvement or mishandling of authorised access.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>About Piracy<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It refers to the <strong>unauthorised use, reproduction, distribution, or sale of copyrighted material<\/strong> such as films, music, software, books, and digital content.<\/li>\n\n\n\n<li>It is essentially a form of <strong>copyright infringement<\/strong>, and occurs when intellectual property is used <strong>without permission of the rights holder<\/strong>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Types of Piracy<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Physical Piracy: <\/strong>Illegal copying on CDs, DVDs, USB drives; common before the digital era.<\/li>\n\n\n\n<li><strong>Digital Piracy: <\/strong>Downloading\/streaming via torrent websites; telegram channels; and cloud links; most prevalent today.\n<ul class=\"wp-block-list\">\n<li>It has expanded due to <strong>internet penetration and low-cost data access<\/strong>.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Film Piracy: <\/strong>Camcording in theatres; leaks from OTT or production sources; and pre-release leaks (e.g., insider leaks).<\/li>\n\n\n\n<li><strong>Software Piracy: <\/strong>Illegal copying of software programs; includes cracked versions and key generators.<\/li>\n\n\n\n<li><strong>Book\/Academic Piracy: <\/strong>Photocopying textbooks; and distribution of pirated PDFs (e.g., shadow libraries).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Nature and Trends of Film Piracy in India<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>India is among the <strong>largest consumers of pirated content globally<\/strong>. Piracy has shifted from <strong>physical formats (CD\/DVD)<\/strong> to <strong>digital ecosystems<\/strong> like torrent, Telegram, cloud sharing.<\/li>\n\n\n\n<li>High-quality leaks often originate from OTT platforms (DRM bypass), and internal supply chains.<\/li>\n\n\n\n<li>Piracy ecosystems are <strong>highly adaptive, decentralised, and technologically sophisticated<\/strong>, making regulation difficult.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Legal Framework in India<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Copyright Act, 1957: <\/strong>It governs protection of <strong>cinematographic works<\/strong>. It recognises <strong>producers as first owners of copyright<\/strong>. Key provisions include:\n<ul class=\"wp-block-list\">\n<li>Section 63: Imprisonment up to 3 years and fine up to \u20b92 lakh.<\/li>\n\n\n\n<li>Section 63A: Enhanced penalties for repeat offences.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Cinematograph (Amendment) Act, 2023<\/strong>: It aims to address <strong>camcording and pre-release leaks<\/strong>. It introduced anti-piracy provisions like:\n<ul class=\"wp-block-list\">\n<li>Criminalises <strong>unauthorised recording\/transmission<\/strong>.<\/li>\n\n\n\n<li>Penalty: <strong>Up to 5% of production cost<\/strong>.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Information Technology Act, 2000: <\/strong>It enables blocking of pirated websites, and intermediary liability for hosting infringing content.<\/li>\n\n\n\n<li><strong>Judicial Mechanisms:<\/strong>\n<ul class=\"wp-block-list\">\n<li><strong>John Doe Orders<\/strong>: Pre-emptive injunctions.<\/li>\n\n\n\n<li><strong>Dynamic Injunctions<\/strong>: Continuous blocking of piracy links.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Related Efforts &amp; Initiatives<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Ministry of Information &amp; Broadcasting<\/strong>: Oversees certification and anti-piracy awareness.<\/li>\n\n\n\n<li><strong>Department for Promotion of Industry and Internal Trade (DPIIT)<\/strong>: Handles IPR policy and enforcement.<\/li>\n\n\n\n<li><strong>National IPR Policy, 2016<\/strong>: Emphasises <strong>strong enforcement and awareness generation<\/strong>.<\/li>\n\n\n\n<li><strong>Cyber Crime Units (MHA)<\/strong>: Track online piracy networks.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Anti-Piracy Measures by Film Industry<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Preventive Mechanisms: Restricted access<\/strong> (encrypted hard drives for theatres); <strong>Digital Rights Management (DRM); and watermarking (visible\/invisible)<\/strong> to trace leaks.<\/li>\n\n\n\n<li><strong>Post-Leak Measures: <\/strong>Takedown notices to platforms; engagement with <strong>anti-piracy firms (e.g., AiPlex)<\/strong>; and court-ordered blocking of URLs.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Key Challenges in Tackling Film Piracy<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Weak Enforcement: <\/strong>Low conviction rates; overburdened judiciary; and limited specialised IPR courts.\n<ul class=\"wp-block-list\">\n<li>Judicial backlog and criminalisation issues weaken enforcement.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Technological Complexity: <\/strong>Use of VPNs, torrents, encrypted messaging apps; and frequent domain shifting by piracy websites.<\/li>\n\n\n\n<li><strong>Supply Chain Vulnerabilities: <\/strong>Insider leaks, and multiple access points (editors, distributors, OTT platforms).<\/li>\n\n\n\n<li><strong>Consumer Behaviour: <\/strong>High demand for <strong>free\/cheap content<\/strong>; and low awareness of legal consequences.\n<ul class=\"wp-block-list\">\n<li>Piracy persists due to <strong>cultural acceptance and affordability issues<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Way Forward<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Strengthening Enforcement: <\/strong>Need to establish <strong>specialised IPR courts<\/strong>;
