{"id":703,"date":"2023-03-24T00:00:00","date_gmt":"2023-03-24T00:00:00","guid":{"rendered":"https:\/\/www.nextias.com\/current_affairs\/uncategorized\/24-03-2023\/freedom-of-press\/"},"modified":"2024-08-20T13:36:19","modified_gmt":"2024-08-20T08:06:19","slug":"freedom-of-press","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/editorial-analysis\/24-03-2023\/freedom-of-press","title":{"rendered":"Freedom of Press"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\"><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>In Context<\/strong><\/span><\/span><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Recently, the Chief Justice of India stated that \u2018Press must remain free if a country is to remain a democracy\u2019.<\/span><\/span><\/span><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Freedom of Press\u00a0<\/strong><\/span><\/span><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Meaning:<\/strong><\/span><\/span><\/span>\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">It is an absence of statutory and administrative control on dissemination of information, ideas, knowledge and thoughts.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>The constitutional bearing of the Freedom of Press:<\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Freedom of Expression:\u00a0<\/strong><\/span><\/span><\/span>\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Article 19<\/strong><\/span><\/span><\/span> <span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>(a) <\/strong><\/span><\/span><\/span><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">of the Indian constitution guarantees to every citizen of India the Freedom of speech and expression.<\/span><\/span><\/span><\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">It is a fundamental Right of the <a href=\"https:\/\/www.nextias.com\/blog\/constitution-of-india\/\" data-type=\"link\" data-id=\"https:\/\/www.nextias.com\/blog\/constitution-of-india\/\"><strong>Indian Constitution<\/strong><\/a>.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Restriction on freedom:<\/strong><\/span><\/span><\/span>\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">However this Freedom under Article 19 is also not absolute. It faces certain restrictions under <\/span><\/span><\/span><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Article 19(2)<\/strong><\/span><\/span><\/span><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">, which are as follows:<\/span><\/span><\/span>\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Matters related to in interests of the sovereignty and integrity of India, the security of the State, friendly relations with foreign States, public order, decency or morality or in relation to contempt of court, defamation or incitement to an offence.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Freedom of press:<\/strong><\/span><\/span><\/span>\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Freedom of press is not specifically mentioned in article 19(1) (a) of the Constitution and what is mentioned there is only freedom of speech and expression.\u00a0<\/span><\/span><\/span><\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">In the Constituent Assembly Debates it was made clear by Dr. Ambedkar, Chairman of the Drafting Committee, that<\/span><\/span><\/span><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong> no special mention of the freedom of press was necessary <\/strong><\/span><\/span><\/span><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">at all as the press and an individual or a citizen were the same as far as their right of expression was Antiqua',serif;\"><span style=\"color: #000000;\">The freedom of the press is an essential aspect to maintain the independence of the press.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Voice of the voiceless:<\/strong><\/span><\/span><\/span>\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">This ensures the integrity of the press as it is often referred to as the voice of the voiceless, a connecting link between the all-powerful rulers and those who are being ruled.<\/span><\/span><\/span><\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The goal of the press is to bring to light any injustice faced by the people and highlights the malaise of the system.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>One of the four pillars of democracy:<\/strong><\/span><\/span><\/span>\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">It is meant to help the government find solutions to these problems, while strengthening the values of the democratic system of governance.\u00a0<\/span><\/span><\/span><\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">For this very reason, the press is often referred to as one of the four pillars of a strong democracy and is the only aspect where the common citizen can directly participate in.\u00a0<\/span><\/span><\/span>\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The other three pillars are the Executive, Legislative, and the Judiciary \u2013 a gang of select few.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Debates, discussions &amp; reforms:<\/strong><\/span><\/span><\/span>\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The media sparks debates and discussion, which are the first step towards action. All societies inevitably become dormant, lethargic and immune to the problems that plague them.\u00a0<\/span><\/span><\/span><\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The media has always played and continues to play an important role in shaping the course of current events, and by extension, the course of history itself.<\/span><\/span><\/span><\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>For example,\u00a0<\/strong><\/span><\/span><\/span>\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">In India, the media\u2019s coverage of the <\/span><\/span><\/span><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>rape of Jyoti, or Nirbhaya,<\/strong><\/span><\/span><\/span><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> by certain men in Delhi resulted in<\/span><\/span><\/span><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong> widespread protests and later,<\/strong><\/span><\/span><\/span><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> in <\/span><\/span><\/span><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>reforms to criminal law<\/strong><\/span><\/span><\/span><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">.\u00a0<\/span><\/span><\/span><\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Even on a day-to-day basis, some news stories prompt questions and discussion in Parliament and in the legislative assemblies of states.<\/span><\/span><\/span><\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Recently, the #MeToo movement was sparked in part by the publication of stories concerning the accusations of sexual harassment against prominent figures in the film industry in the US. The #MeToo movement had cascading effects all across the world and was a watershed moment in history.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Community-based journalism:<\/strong><\/span><\/span><\/span>\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Local or community-based journalism has played an important role in encouraging social cohesion and political activism.\u00a0<\/span><\/span><\/span><\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Local journalism shines a bright light on local issues, people, and causes, which many times may not get covered by the media at the national-level.\u00a0<\/span><\/span><\/span><\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The emergence of social media enabled them to create their own space and come up with independent media platforms.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Relevance of the media during COVID:<\/strong><\/span><\/span><\/span>\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The relevance of the media was best highlighted during the period of the Covid-19 pandemic.\u00a0<\/span><\/span><\/span><\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Electronic, print and social media facilitated the State to disseminate relevant information to the general public at large even during the lockdown.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Press Freedom Index &amp; India\u2019s Performence<\/strong><\/span><\/span><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Across the globe, fake news has the capability to create tensions between communities by misleading people.<\/span><\/span><\/span><\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Media houses are expected to act cautiously while publishing news.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Legitimacy:<\/strong><\/span><\/span><\/span>\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Another issue affecting the media is that of legitimacy. Media institutions need to ensure that their newsroom culture reflects the diverse news content they are producing. Otherwise, audiences may question their authenticity.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Media trials:<\/strong><\/span><\/span><\/span>\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">A major issue that has percolated our system is trial by media. The presumption of innocence postulates that a person is presumed innocent until found guilty by a court of law.\u00a0<\/span><\/span><\/span><\/li>\n\n\n\n<li><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">This is one of the core tenets of law and legal processes.
