{"id":69568,"date":"2026-03-23T20:28:52","date_gmt":"2026-03-23T14:58:52","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=69568"},"modified":"2026-03-23T20:33:36","modified_gmt":"2026-03-23T15:03:36","slug":"prison-reforms-sc","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/23-03-2026\/prison-reforms-sc","title":{"rendered":"Supreme Court Push for Prison Reforms"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/ Governance<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court of India has directed all States and Union Territories to submit updated and comprehensive data on prison conditions, in a suo motu case on inhuman conditions in prisons.\n<ul class=\"wp-block-list\">\n<li><strong>\u201cPrisons\/persons detained therein\u201d<\/strong> is a <strong>\u2018State-list\u2019<\/strong> subject as per <strong>Entry 4<\/strong> of List II of\u00a0 the Seventh Schedule to the Constitution of India.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Directions Issued by the Supreme Court<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Court has directed States to <strong>specify both ongoing and proposed measures<\/strong> to address overcrowding.<\/li>\n\n\n\n<li>It has also emphasized the need to <strong>ensure education, healthcare, and welfare of children <\/strong>living with incarcerated mothers.<\/li>\n\n\n\n<li>The Court has directed States to <strong>provide details of sanctioned staff strength, <\/strong>vacancies, and steps taken for recruitment.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Existing Issues in Indian Prisons<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Overcrowding: <\/strong>As per the <strong>Prison Statistics India 2023 <\/strong>report by the National Crime Records Bureau (NCRB), India\u2019s prisons operated at an average occupancy rate of <strong>120.8%.<\/strong><\/li>\n\n\n\n<li><strong>Undertrial Crisis: <\/strong>The high proportion of undertrial prisoners reflects delays in investigation and trial processes, which undermines the principle of justice.<\/li>\n\n\n\n<li><strong>Poor Infrastructure and Hygiene:<\/strong> Many prisons face challenges like inadequate ventilation, sanitation, and access to healthcare. Such conditions fail to meet international norms and are often cited as grounds to deny extradition.<\/li>\n\n\n\n<li><strong>Lack of Classification: <\/strong>There is <strong>no separate category of detention facilities<\/strong> for economic offenders, foreign nationals, or high-risk fugitives.\u00a0<\/li>\n\n\n\n<li>Reports from the National Human Rights Commission (NHRC), have highlighted cases of <strong>custodial violence, delayed medical attention, and limited legal access,<\/strong> further weakening India\u2019s position in international courts.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Committees on Prison Reforms<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>A. N. Mulla Committee: <\/strong>Formally the <strong>All India Committee on Jail Reforms (1980\u201383) <\/strong>recommended Separation of undertrial prisoners from convicts and improvement of prison conditions, nutrition, and sanitation.<\/li>\n\n\n\n<li><strong>Justice Amitava Roy Committee:<\/strong> It recommended decongestion of prisons, speedy trials and legal aid reforms and use of technology for prison management.<\/li>\n\n\n\n<li><strong>Krishna Iyer Committee: <\/strong>It advocated for separate jail facilities for women to prevent exploitation.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Judicial Interventions<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Hussainara Khatoon v.
