{"id":65294,"date":"2026-01-28T18:22:41","date_gmt":"2026-01-28T12:52:41","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=65294"},"modified":"2026-01-29T13:29:20","modified_gmt":"2026-01-29T07:59:20","slug":"ugc-rules-caste-based-discrimination","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/28-01-2026\/ugc-rules-caste-based-discrimination","title":{"rendered":"New UGC Rules on Caste-Based Discrimination"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/ Education\/ Governance<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The University Grants Commission (UGC) notified new regulations aimed at addressing discrimination, particularly caste-based discrimination, in higher education institutions.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Background<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>As per Regulation 3(c) <\/strong>of the UGC (Promotion of Equity in Higher Education Institutions) Regulations, 2026, \u201ccaste-based discrimination\u201d means <strong>\u201cdiscrimination only<\/strong> on the basis of caste or tribe against the members of the <strong>scheduled castes, scheduled tribes, and other backward classes\u201d.<\/strong><\/li>\n\n\n\n<li>It aims to curb caste-based discrimination on campuses and ensure a safe, dignified and inclusive academic environment for students, teachers and non-teaching staff.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Key Provisions of the 2026 Regulations<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Every higher education institution is mandated to have an Equal Opportunity Centre, an Equity Committee and Equity Squads.\n<ul class=\"wp-block-list\">\n<li><strong>The Equal Opportunity Centre (EOC)<\/strong> will oversee the implementation of policies related to disadvantaged groups, coordinate with the district administration and police, and <strong>help provide legal aid<\/strong> when necessary.<\/li>\n\n\n\n<li><strong>Equity Committee: <\/strong>The EOC will have a<strong> ten-member Equity Committee <\/strong>chaired by the head of the institution. Five of its members must be from reserved categories.<\/li>\n\n\n\n<li><strong>Equity Squads:<\/strong> These are to be constituted to \u201cmaintain vigil and prevent discrimination on campus\u201d.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>A 24-hour <strong>\u2018Equity Helpline\u2019<\/strong> and <strong>Equity Ambassadors <\/strong>will be appointed.<\/li>\n\n\n\n<li>The UGC will monitor compliance, and non-compliant institutions with the risk of losing UGC funding, degree-granting powers, and even recognition.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Impact of Caste-Based Discrimination<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>On Individuals:<\/strong>\n<ul class=\"wp-block-list\">\n<li>It undermines<strong> dignity, self-worth, and mental health<\/strong>, leading to anxiety, depression, and social withdrawal.<\/li>\n\n\n\n<li>It results in educational exclusion, including<strong> higher dropout rates, <\/strong>denial of academic opportunities, and restricted access to mentorship.<\/li>\n\n\n\n<li>It creates fear of reprisal, discouraging students from reporting discrimination.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>On Institutions:<\/strong>\n<ul class=\"wp-block-list\">\n<li>It weakens<strong> academic excellence <\/strong>by preventing equal participation and talent realisation.<\/li>\n\n\n\n<li>It fosters a hostile campus climate, <strong>eroding trust<\/strong> between students, faculty, and administration.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>On Society:<\/strong>\n<ul class=\"wp-block-list\">\n<li>It <strong>perpetuates intergenerational inequality<\/strong> and social stratification.<\/li>\n\n\n\n<li>It contradicts constitutional values of <strong>equality, fraternity, and social justice.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Constitutional Provisions&nbsp;<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 46 under the Directive Principles of State Policy, <\/strong>mandates the State to promote with special care the educational and economic interests of the weaker sections, particularly Scheduled Castes (SCs) and Scheduled Tribes (STs).&nbsp;<\/li>\n\n\n\n<li><strong>Article 14 <\/strong>guarantees equality before law and equal protection of laws.<\/li>\n\n\n\n<li><strong>Article 15(4) &amp; 15(5)<\/strong> enable affirmative action for socially and educationally backward classes.<\/li>\n\n\n\n<li><strong>Article 16(1) &amp; 16(4) <\/strong>ensure equality of opportunity and reservation in public employment.<\/li>\n\n\n\n<li><strong>Article 17<\/strong> abolishes untouchability and forbids its practice in any form.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Legal and Statutory Measures<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, <\/strong>criminalises caste-based harassment and violence.<\/li>\n\n\n\n<li><strong>Protection of Civil Rights Act, 1955<\/strong>, penalises the practice of untouchability.<\/li>\n\n\n\n<li><strong>Right to Education Act, 2009,<\/strong> mandates non-discrimination in elementary education.<\/li>\n\n\n\n<li><strong>University Grants Commission Act, 1956,<\/strong> empowers UGC to regulate equity in higher education.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What are the Concerns?<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Legal Concerns: <\/strong>Absence of a provision to deal with <strong>false
