The recent spate of custodial deaths in Tamil Nadu has yet again highlighted the methods used by the police during interrogation.<\/span><\/span><\/span><\/p>\n

What is Custodial Death ?<\/u><\/strong><\/span><\/span><\/span><\/p>\n

    \n
  • It is widely referred to as death that happens to a person who is <\/span><\/span><\/span>under trial<\/strong><\/span><\/span><\/span> or has already been convicted of a crime.<\/span><\/span><\/span><\/li>\n
  • It can be <\/span><\/span><\/span>due to natural causes<\/strong><\/span><\/span><\/span> like <\/span><\/span><\/span>illness <\/strong><\/span><\/span><\/span>or may also happen due to <\/span><\/span><\/span>suicide,<\/strong><\/span><\/span><\/span> <\/span><\/span><\/span>infighting among prisoners<\/strong><\/span><\/span><\/span> but in many instances, it is <\/span><\/span><\/span>police brutality<\/strong><\/span><\/span><\/span> and <\/span><\/span><\/span>torture <\/strong><\/span><\/span><\/span>that is the <\/span><\/span><\/span>reason behind the death<\/strong><\/span><\/span><\/span>.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/div>\n

    Present Status of custodial deaths in India\u00a0<\/u><\/strong><\/span><\/span><\/span><\/p>\n

      \n
    • When <\/span><\/span><\/span>police grow increasingly frustrated<\/strong><\/span><\/span><\/span> with the trajectory of their interrogation, sometimes resort to torture and<\/span><\/span><\/span> violence which could lead to the death of the suspect.<\/strong><\/span><\/span><\/span><\/li>\n
    • India has a grim record in police brutality and custodial violence. Between <\/span><\/span><\/span>2001 and 2018, 1,727 persons died <\/strong><\/span><\/span><\/span>in police custody, but only 26 policemen were convicted for such deaths.<\/span><\/span><\/span><\/li>\n
    • Custodial deaths are common despite enormous <\/span><\/span><\/span>time and money being spent<\/strong><\/span><\/span><\/span> on<\/span><\/span><\/span> training police personnel<\/strong><\/span><\/span><\/span> to <\/span><\/span><\/span>embrace scientific methods<\/strong><\/span><\/span><\/span> of <\/span><\/span><\/span>investigation<\/strong><\/span><\/span><\/span>.\u00a0<\/span><\/span><\/span>\n
        \n
      • This is because police personnel are humans from <\/span><\/span><\/span>different backgrounds and with different perspectives.<\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
      • Custodial deaths are one of the highest forms of violation of human rights. It is a blunt attack on the right to life and liberty guaranteed by the Indian Constitution.<\/span><\/span><\/span><\/li>\n<\/ul>\n

        Technological Solutions to handle them<\/u><\/strong><\/span><\/span><\/span><\/p>\n

          \n
        • Several technological<\/strong><\/span><\/span><\/span> solutions are available to <\/span><\/span><\/span>help prevent custodial deaths.<\/strong><\/span><\/span><\/span>\n
            \n
          • These include <\/span><\/span><\/span>body cameras and automated external defibrillators.\u00a0<\/strong><\/span><\/span><\/span><\/li>\n
          • Technology can help <\/span><\/span><\/span>avert police custodial deaths.\u00a0<\/strong><\/span><\/span><\/span>\n
              \n
            • For example, body cameras could hold officers liable.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
            • Deception detection tests (DDTs), <\/strong><\/span><\/span><\/span>which deploy technologies such as <\/span><\/span><\/span>polygraph, narco-analysis and brain mapping<\/strong><\/span><\/span><\/span>, could be valuable in learning information that is known only to a <\/span><\/span><\/span>criminal regarding a crime.<\/strong><\/span><\/span><\/span>\n
                \n
              • Among the <\/span><\/span><\/span>DDTs, the Brain Fingerprinting System (BFS)<\/strong><\/span><\/span><\/span> is an innovative technology that several police forces <\/span><\/span><\/span>contemplate adding to their investigative tools.\u00a0<\/strong><\/span><\/span><\/span><\/li>\n
              • BFS has proved helpful for solving crimes, identifying perpetrators, and exonerating innocent suspects<\/strong><\/span><\/span><\/span>.\u00a0<\/span><\/span><\/span>\n
                  \n
                • Laboratory and field tests for the BFS at the Federal Bureau of Investigation, the Central Intelligence Agency, and U.S. Navy demonstrated <\/span><\/span><\/span>no errors and no false positives and false negatives.<\/strong><\/span><\/span><\/span>\u00a0<\/span><\/span><\/span><\/li>\n
                • In June 2008, India convicted an accused leaning on evidence from a BFS device.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n
                • \u00a0In 2010, the Supreme Court, in Selvi v. State of Karnataka, rendered the evidence inadmissible.\u00a0<\/span><\/span><\/span>\n
                    \n
                  • The court observed that the state could not perform narco analysis, polygraph, and brain-mapping tests on any individual without their consent.\u00a0<\/span><\/span><\/span>\n
                      \n
                    • With informed consent, however, any information or material discovered during the BFS tests can be part of the evidence.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n
                        \n
                      • Police departments are increasingly using robots for surveillance<\/strong><\/span><\/span><\/span> and bomb detection. Many departments now want robotic interrogators for interrogating suspects.\u00a0<\/span><\/span><\/span>\n
                          \n
                        • robots can meet or exceed the capabilities of the human interrogator, partially because humans are inclined to respond to robots in ways that they do to humans.\u00a0<\/span><\/span><\/span><\/li>\n
                        • Robots equipped with AI and sensor technology<\/strong><\/span><\/span><\/span> can build a rapport with the suspects, utilise persuasive techniques like flattery, shame and coercion, and strategically use body language.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n
                            \n
                          • Researchers at the University of Arizona have created automated interrogation technology called The<\/span><\/span><\/span> Automated Virtual Agent for Truth Assessments in Real-Time (AVATAR).\u00a0<\/strong><\/span><\/span><\/span>\n
                              \n
                            • T<\/strong><\/span><\/span><\/span>he Canadian Border Services Agency tested AVATAR last year.<\/span><\/span><\/span><\/li>\n
                            • \u00a0The HCI system uses visual, auditory, near-infrared and other sensors to scrutinise a suspect\u2019s eye movements, voice, and other qualities throughout an interaction.\u00a0<\/span><\/span><\/span><\/li>\n
                            • The aggregation of information and its analysis by the system have been highly accurate.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n
                                \n
                              • Artificial Intelligence (AI) and Machine Learning (ML)<\/strong><\/span><\/span><\/span> are emerging as<\/span><\/span><\/span> tools of interrogations.\u00a0<\/strong><\/span><\/span><\/span>\n
                                  \n
                                • AI can detect <\/span><\/span><\/span>human emotions and predict behaviour<\/strong><\/span><\/span><\/span>.<\/span><\/span><\/span>\n
                                    \n
                                  • \u00a0ML can in real-time alert superiors when police are meting out inhumane treatment to suspects.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

                                    Concerns Linked to them\u00a0<\/u><\/strong><\/span><\/span><\/span><\/p>\n

                                      \n
                                    • There is a lot of concern about AI or robot interrogations, both legally and ethically.\u00a0<\/span><\/span><\/span><\/li>\n
                                    • There exists the <\/span><\/span><\/span>risk of bias, the peril of automated interrogation tactics, <\/strong><\/span><\/span><\/span>the <\/span><\/span><\/span>threat of ML algorithms targeting individuals and communities,<\/strong><\/span><\/span><\/span> and the<\/span><\/span><\/span> hazard of its misuse for surveillance<\/strong><\/span><\/span><\/span>.\u00a0<\/span><\/span><\/span><\/li>\n
                                    • Therefore, while the technology available to the police and law-enforcement agencies is constantly improving, it is a restricted tool that <\/span><\/span><\/span>can\u2019t eradicate custodial deaths.\u00a0<\/strong><\/span><\/span><\/span><\/li>\n
                                    • While it might provide comfort and transparency<\/span><\/span><\/span>, it can never address the underlying issues that lead to these situations.<\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n
                                      \n\n\n\n
                                      \n

                                      Legal provisions against custodial torture in India<\/u><\/strong><\/span><\/span><\/span><\/p>\n

                                      The Indian Constitution and the legal regime provide <\/span><\/span><\/span>various safeguards<\/strong><\/span><\/span><\/span> against custodial torture:<\/span><\/span><\/span><\/p>\n

                                        \n
                                      • Protection against Conviction or Enhanced Punishment under Ex-Post Facto Law<\/strong><\/span><\/span><\/span>: <\/span><\/span><\/span>Article 20(1) of the Constitution of India<\/strong><\/span><\/span><\/span> provides that, no person shall be convicted of any offence except for violation of law in force at the time of the commission of the act charged as an offence.<\/span><\/span><\/span><\/li>\n
                                      • Protection against Double Jeopardy<\/strong><\/span><\/span><\/span>: Article 20(2) of the Constitution states that no person shall be prosecuted and punished for the same offence more than once.<\/span><\/span><\/span><\/li>\n
                                      • Right not to be a witness against himself<\/strong><\/span><\/span><\/span>: Article 20(3) of the Constitution provides that no accused person will be compelled to be a witness against himself.<\/span><\/span><\/span><\/li>\n
                                      • Section 163 of the Code of Criminal Procedure, 1973: <\/strong><\/span><\/span><\/span>prohibits the investigating officers from making any inducement, threat or promise under Section 24 of the Indian Evidence Act (1872) but also prevents him from forcing any person to make any statement which he would like to make on his free will.<\/span><\/span><\/span><\/li>\n<\/ul>\n
                                          \n
                                        • Article 21 (Right to Life) <\/strong><\/span><\/span><\/span>guarantees protection of every life except for procedures established by law.<\/span><\/span><\/span><\/li>\n
                                        • Article 22 prohibits detention in custody <\/strong><\/span><\/span><\/span>without being informed as well as gives the detainee the right to consult and to be defended by a legal practitioner of his choice.<\/span><\/span><\/span><\/li>\n
                                        • Article 39A provides for NALSA and free legal aid.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/div>\n

                                          Conclusion and Way forward\u00a0<\/u><\/strong><\/span><\/span><\/span><\/p>\n

                                            \n
                                          • There is a need for the <\/span><\/span><\/span>formulation of a multi-pronged strategy<\/strong><\/span><\/span><\/span> by the <\/span><\/span><\/span>decision-makers encompassing legal enactments, technology, accountability, training and community relations.\u00a0<\/strong><\/span><\/span><\/span><\/li>\n
                                          • The Law Commission of India\u2019s proposition in 2003 to change the Evidence Act to place the onus of proof on the police for not <\/span><\/span><\/span>having tortured suspects is important in this regard.\u00a0<\/strong><\/span><\/span><\/span>\n
                                              \n
                                            • Besides, stringent action must be taken against personnel who breach the commandments issued by the apex court in<\/span><\/span><\/span> D.K. Basu v. State of West Bengal (1997)<\/strong><\/span><\/span><\/span>.\u00a0<\/span><\/span><\/span><\/li>\n
                                            • The draft bill on the Prevention of Torture, 2017, which has not seen the day, needs to be revived.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
                                            • Technology may make policing more convenient, but it can never be an alternative for<\/span><\/span><\/span> compassionate policing established on trust between the police and the citizens.<\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n
                                                \n
                                              • Policemen need to be sensitised and educated, and told that they should rely on scientific methods of investigation and a proper interrogation technique.<\/span><\/span><\/span><\/li>\n<\/ul>\n
