{"id":65086,"date":"2026-01-24T17:48:00","date_gmt":"2026-01-24T12:18:00","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=65086"},"modified":"2026-01-24T18:00:39","modified_gmt":"2026-01-24T12:30:39","slug":"fugitives-located-abroad-2025","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/24-01-2026\/fugitives-located-abroad-2025","title":{"rendered":"71 Fugitives Located Abroad in 2024-25"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/ Governance; GS3\/ Economy<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>According to the 2024-25 annual report of the Department of Personnel and Training (DoPT), the Central Bureau of Investigation (CBI) located <strong>71 people wanted by India in foreign countries,<\/strong> the <strong>highest in the last 12 years.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>About<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Fugitives are individuals who are <strong>accused or convicted of a crime<\/strong> and <strong>deliberately evade the legal process <\/strong>by fleeing from the jurisdiction of the country where the offence was committed.<\/li>\n\n\n\n<li>They escape to avoid arrest, trial, conviction, or punishment by law enforcement authorities and their return requires a <strong>legally recognised international mechanism<\/strong>, known as <strong>extradition<\/strong>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What is Extradition?<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Extradition is the<strong> recognised international mechanism<\/strong> for the timely return of fugitives from foreign countries.\u00a0<\/li>\n\n\n\n<li>It is defined as the \u201c<strong>delivery of an accused or convicted individual <\/strong>from the country he is found in, to another country that requests his extradition\u201d.<\/li>\n\n\n\n<li>The process is <strong>governed by treaties and agreements <\/strong>which adopt internationally recognised legal principles for the surrender of fugitives.<\/li>\n\n\n\n<li><strong>Extradition Requests:<\/strong>\n<ul class=\"wp-block-list\">\n<li>Over the last five years, India has sent<strong> 137 extradition requests<\/strong> to foreign countries, of which most were accepted but remain pending.<\/li>\n\n\n\n<li><strong>Letters Rogatory continue<\/strong> to face significant delays. As of 2025, <strong>533 <\/strong>Letters Rogatory were pending with foreign countries.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background has-fixed-layout\" style=\"background-color:#fff2cc\"><tbody><tr><td><strong>Institutional Framework Governing Extradition<\/strong><br><br>&#8211; <strong>The Central Bureau of Investigation<\/strong>, acting as India\u2019s Interpol National Central Bureau, issues Interpol notices, and engages with foreign police agencies to locate fugitives.<br>&#8211; <strong>The Ministry of External Affairs<\/strong> manages diplomatic engagement related to extradition and mutual legal assistance.<br>a. <strong>India has extradition treaties<\/strong> with around <strong>48 countries<\/strong> and extradition arrangements with <strong>12 countries.<\/strong><br>&#8211; <strong>Mutual Legal Assistance Treaty: <\/strong>It<strong> <\/strong>is a mechanism whereby <strong>countries cooperate<\/strong> with one another in order to provide and obtain formal assistance in prevention, suppression, investigation and <strong>prosecution of crime.<\/strong><br>a. <strong>Aim:<\/strong> To ensure that the <strong>criminals do not escape or sabotage<\/strong> the due process of law for want of evidence available in different countries.<br>&#8211; <strong>Letters Rogatory (LRs): <\/strong>These are <strong>formal requests<\/strong> from an Indian court to a foreign court for judicial assistance such as evidence collection, serving summons.<br>a. It is done through diplomatic channels and is usually slower than MLAT.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Legal Architecture Supporting Extradition<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Extradition in India<\/strong> is governed by the <strong>Extradition Act, 1962<\/strong>, which provides the legal basis for surrendering or receiving fugitives under treaties or executive arrangements.<\/li>\n\n\n\n<li>India is also a party to <strong>multilateral conventions<\/strong> such as;\n<ul class=\"wp-block-list\">\n<li><strong>United Nations Convention against Corruption<\/strong> and\u00a0<\/li>\n\n\n\n<li><strong>United Nations Convention against Transnational Organized Crime.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>The Fugitive Economic Offenders Act, 2018 (FEOA):<\/strong> The law was enacted to deter economic offenders from evading the process of Indian law by remaining outside the jurisdiction of Indian courts.\n<ul class=\"wp-block-list\">\n<li>It is a law whereby the <strong>Enforcement Directorate<\/strong> is mandated to attach the properties of the fugitive economic offenders who have escaped from India warranting arrest and provide for the confiscation of their properties to the Central Government.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Structural Challenges in Extradition<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Judicial Scrutiny in Foreign Jurisdictions: <\/strong>Foreign courts independently examine extradition requests, <strong>prison conditions and human rights safeguards<\/strong> in the requesting country.\n<ul class=\"wp-block-list\">\n<li>These assessments frequently prolong or obstruct extradition proceedings involving Indian requests.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Asylum and Political Protection Claims:<\/strong> Many fugitives claim political persecution or seek asylum in host countries, transforming criminal proceedings into complex legal and humanitarian disputes.\u00a0<\/li>\n\n\n\n<li><strong>Absence of Treaties with Certain Jurisdictions:<\/strong> Several fugitives reside in countries with which India does not have extradition treaties, limiting India\u2019s ability to secure their return through legal compulsion.<\/li>\n\n\n\n<li><strong>Outdated Treaty Structures:<\/strong> Older treaties follow a restrictive list system, which excludes modern crimes such as cybercrime and complex financial fraud.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Governance and Security Implications<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Impact on Rule of Law:<\/strong> Low extradition outcomes weaken deterrence against economic and transnational crimes and encourage offenders to evade domestic legal processes by fleeing abroad.<\/li>\n\n\n\n<li><strong>Internal Security and Financial Integrity:<\/strong> Delayed extradition hampers India\u2019s efforts to combat money laundering, corruption, and organized crime, while also undermining public confidence in the criminal justice system.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Way Ahead<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>India needs to <strong>expand its extradition treaty network,<\/strong> especially with major financial centres, and pursue sustained <strong>diplomatic engagement to expedite pending cases.<\/strong><\/li>\n\n\n\n<li><strong>Improving prison infrastructure<\/strong>, ensuring <strong>timely trials<\/strong>, and reinforcing <strong>procedural safeguards<\/strong>
