Veeraswami vs Union of India (1991)<\/strong>, emphasized that <strong>honesty and impartiality<\/strong> are absolute standards for judges.\n<ul class=\"wp-block-list\">\n<li>In <strong>M. Krishna Swami vs Union of India (1992)<\/strong>, the Supreme Court held that not every <strong>error of judgment or negligence<\/strong> amounts to misbehaviour, it must involve <strong>wilful misconduct, corruption, or moral turpitude<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Legislative Framework: Judges (Inquiry) Act, 1968<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Parliament enacted the <strong>Judges (Inquiry) Act, 1968<\/strong> and the corresponding <strong>Rules<\/strong>, outlining the procedure for investigating charges against judges under <strong>Article 124(5)<\/strong><\/li>\n\n\n\n<li><strong>Key Provisions:<\/strong>\n<ul class=\"wp-block-list\">\n<li>A motion for removal must be <strong>signed by at least 100 Lok Sabha MPs<\/strong> or <strong>50 Rajya Sabha MPs<\/strong>.<\/li>\n\n\n\n<li>The motion is submitted to the <strong>Speaker (Lok Sabha)<\/strong> or <strong>Chairman (Rajya Sabha)<\/strong>.<\/li>\n\n\n\n<li>The <strong>Speaker\/Chairman decides whether to admit or disallow<\/strong> the motion.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>A <strong>three-member inquiry committee<\/strong> is constituted, comprising a <strong>Supreme Court judge, a<\/strong> <strong>Chief Justice of a High Court, and<\/strong> <strong>distinguished jurist<\/strong>, if admitted.<\/li>\n\n\n\n<li>If the committee finds the judge guilty of misbehaviour or incapacity,<strong> both Houses of Parliament<\/strong> need to pass a motion <strong>by a two-thirds majority<\/strong> before it is sent to the <strong>President<\/strong>, who then issues an order for removal.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Structural Flaw in the Impeachment Process<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Role of Speaker or Chairman: <\/strong>The removal procedure lies in the <strong>discretion vested in the Speaker or Chairman<\/strong><strong>to admit or disallow the motion.<\/strong>\n<ul class=\"wp-block-list\">\n<li>The system\u2019s weakness lies in allowing a <strong>single presiding <strong>dismissed at the threshold<\/strong>, rendering Parliament\u2019s role redundant.<\/li>\n\n\n\n<li>It undermines the <strong>principle of judicial accountability<\/strong> and gives undue power to the <strong>executive branch<\/strong>, which can indirectly influence the Speaker or Chairman\u2019s decision.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Lack of Defined Criteria: <\/strong>The <strong>Judges (Inquiry) Act<\/strong> does not specify the <strong>conditions for admissibility<\/strong> of such a motion.\n<ul class=\"wp-block-list\">\n<li>Consequently, the <strong>decision to disallow<\/strong> can be made <strong>without assigning reasons<\/strong>, potentially nullifying a constitutionally backed effort supported by over 100 MPs.<\/li>\n\n\n\n<li>It raises concerns about <strong>arbitrariness and executive influence<\/strong>, especially when the Speaker or Chairman acts as a <strong>statutory authority<\/strong> rather than as the presiding officer of the House.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Constitutional Ambiguity: Article 124(5)<\/strong> does <strong>not empower the Speaker\/Chairman<\/strong> to reject a motion.\n<ul class=\"wp-block-list\">\n<li>It merely authorizes Parliament to regulate the procedure for <strong>investigation and proof<\/strong> of misbehaviour.&nbsp;<\/li>\n\n\n\n<li>The <strong>proof<\/strong> needs to come through a <strong>judicial inquiry<\/strong>, not through the Speaker\u2019s preliminary scrutiny.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Need For Reform<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Reconsidering the Speaker\u2019s Role: <\/strong>Given the <strong>constitutional intent<\/strong> of <strong>checks and balances<\/strong>, it is imperative that the <strong>Speaker\u2019s or Chairman\u2019s role<\/strong> be <strong>limited to procedural verification<\/strong> rather than substantive judgment of allegations.\n<ul class=\"wp-block-list\">\n<li>The actual evaluation should rest with the <strong>independent inquiry committee<\/strong>.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Ensuring Transparency: <\/strong>Any decision to reject a motion should be accompanied by <strong>written reasons<\/strong> and made <strong>subject to judicial review<\/strong> to avoid arbitrariness.<\/li>\n\n\n\n<li><strong>Legislative Reforms: <\/strong>A re-examination of the <strong>Judges (Inquiry) Act, 1968<\/strong> is necessary to:\n<ul class=\"wp-block-list\">\n<li>Define <strong>clear admissibility criteria<\/strong> for motions.<\/li>\n\n\n\n<li>Mandate <strong>automatic reference<\/strong> to an inquiry committee when a motion meets constitutional requirements.<\/li>\n\n\n\n<li>Safeguard the process from <strong>political interference<\/strong> while preserving <strong>judicial independence<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Conclusion<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The impeachment motion has reopened vital discussions about the <strong>balance between judicial independence and accountability<\/strong>.&nbsp;<\/li>\n\n\n\n<li>The Constitution of India has a removal process <strong>to prevent misuse.<\/strong> However, the <strong>discretionary gatekeeping power<\/strong> vested in the <strong>Speaker or Chairman<\/strong> threatens to reduce this process to a <strong>political formality<\/strong>.<\/li>\n\n\n\n<li>The law needs to ensure that <strong>serious motions by elected representatives<\/strong> are not dismissed without due consideration to uphold public faith in the judiciary.\n<ul class=\"wp-block-list\">\n<li>Revisiting the <strong>Judges (Inquiry) Act, 1968<\/strong> is not just a procedural necessity, it is a <strong>constitutional imperative<\/strong>
