case<\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">, took cognisance of the <\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>misuse of Section 498A of the Indian Penal Code (IPC).<\/strong><\/span><\/span><\/span><\/p>\n\n\n\n<p><strong>Major Points\u00a0<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 12pt;\"><span style=\"font-family: #000000;\">HC proposed certain <\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>safeguards and directed the State authorities<\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> of Uttar Pradesh to #000000;\"><strong>Reasons for Dowry<\/strong><\/span><\/span><\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Economic causes:<\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> These include inheritance systems and the bride&#8217;s economic status. style=\"color: #000000;\"> The system encourages dowry perhaps due to the exclusion of the bride&#8217;s family after marriage as a form of pre mortem inheritance for the bride.<\/span><\/span><\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Issues\u00a0<\/strong><\/span><\/span><\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The dowry system is thought to put a great financial burden on the bride&#8217;s family.\u00a0<\/span><\/span><\/span><\/li>\n\n\n\n<li><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">In some cases, the dowry system Leads to crime against women, ranging from emotional abuse and injury to even deaths.<\/span><\/span><\/span><\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-group has-background\" style=\"background-color:#ebecf0\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\">Legal Status in India<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The payment of dowry has long been\u00a0<strong>prohibited\u00a0<\/strong>under specific Indian laws including the Dowry Prohibited under specific Indian law including:<\/li>\n\n\n\n<li><strong>Dowry Prohibition Act, 1961-\u00a0<\/strong>To prohibit giving or taking of dowry.\n<ul class=\"wp-block-list\">\n<li>Anyone who violates this law is punishable with imprisonment for a term not less than five years, and fine of not less than Rs 15,000, or an amount of the value of such dowry, whichever is more.\u00a0<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Section 304-B of the IPC<\/strong>\n<ul class=\"wp-block-list\">\n<li>It is about the Dowry death of a woman subjected to cruelty or harassment by her husband or any relative of her husband.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p Section.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>SC\u2019s Observations\u00a0<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In\u00a0<strong>Vishaka vs State of Rajasthan (1997),<\/strong>\u00a0the Supreme Court issued directions to enforce fundamental rights in the absence of law in certain cases of sexual harassment at the workplace.\u00a0<\/li>\n\n\n\n<li>The\u00a0<strong>Supreme Court<\/strong>\u00a0said not just laws but people had to also change from within and learn to treat a woman with respect for the social evil of dowry to be vanquished once and for all.<\/li>\n\n\n\n<li>It requested the\u00a0<strong><a href=\"https:\/\/www.nextias.com\/ca\/current-affairs\/24-02-2023\/22nd-law-commission\" data-type=\"link\" data-id=\"https:\/\/www.nextias.com\/ca\/current-affairs\/24-02-2023\/22nd-law-commission\">Law Commission of India<\/a>\u00a0<\/strong>to take a \u201cfresh look\u201d to bring \u201cmore teeth\u201d to the law against dowry.<\/li>\n\n\n\n<li>Recently, the Supreme Court has held that Dowry death can be presumed if the wife was harassed, mentally and physically close before her death in the marital home.<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<p><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Conclusion and Way Forward\u00a0<\/strong><\/span><\/span><\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>\u00a0<\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Educate the daughters<\/span><\/span><\/span>\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Education and independence <\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">is one powerful and valuable gift that we can give to our daughters.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">At the same time, the society at large needs to become aware and understand the gravity of such crimes.<\/span><\/span><\/span><\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The police must strictly enforce the <\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Supreme Court\u2019s directions issued in Arnesh Kumar vs State of Bihar (2014) <\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">and ensure that there is <\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>sufficient reason<\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> and <\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>credible material against the accused person <\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">to necessitate arrest.\u00a0<\/span><\/span><\/span><\/li>\n\n\n\n<li><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The <\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>investigating officers must be imparted rigorous training<\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> with regard to the principles stated by the Court relating to arrest.\u00a0<\/span><\/span><\/span>\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">At the same time, wrong-doers need to be punished departmentally.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-size: 12pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Strong legislation is vital for holding the perpetrators accountable.
