State of Rajasthan judgment (1997)<\/strong>, which laid down binding guidelines to fill the legislative vacuum on workplace sexual harassment.<\/li>\n\n\n\n<li><strong>Scope and Coverage:<\/strong> The Act applies to all workplaces, including government offices, private sectors, NGOs, educational institutions, hospitals, sports bodies, and unorganized sectors, extending protection even to domestic workers in residences used for employment<\/li>\n\n\n\n<li><strong>Institutional Framework: <\/strong>Every organization with 10 or more employees must constitute an Internal Complaints Committee (ICC), with the presiding officer and at least half the members being women, including an external NGO expert.\n<ul class=\"wp-block-list\">\n<li>For workplaces with fewer than 10 employees, District Officers form Local Complaints Committees (LCCs) at the district level to ensure accessibility.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Complaint and Inquiry Process: <\/strong>Complaints must be filed within 3 months of the incident (extendable by another 3 months for sufficient cause) to the ICC or LCC, which conducts a time-bound inquiry within 90 days, maintaining confidentiality and natural justice principles.\n<ul class=\"wp-block-list\">\n<li>Outcomes include conciliation, disciplinary action up to termination, or compensation, with appeals to courts within 90 days; false complaints also attract penalties.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p><strong>Source: HT<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\"><strong>Supreme Court\u2019s Ruling on Narco Tests<\/strong><\/h2>\n\n\n\n<p><strong>Syllabus: GS2\/Governance; GS3\/Science and Technology<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>In News<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court ruled that forced or involuntary narco tests are unconstitutional and invalid.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>About Narco Test<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It is a process of investigation during which it is expected that the accused, undergoing such a test, would express the concealed facts.&nbsp;<\/li>\n\n\n\n<li>In this test the accused is sedated by administering a certain class of substances, such as<strong> barbiturates<\/strong>, for instance, <strong>Sodium Pentothal<\/strong>, to reduce a subject\u2019s inhibitions and reasoning ability.&nbsp;<\/li>\n\n\n\n<li>It is a non-violent method similar to those called<strong> polygraphs or brain mapping.<\/strong><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Legality of Narco Test&nbsp;<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court, referencing the Selvi guidelines, ruled that any test conducted <strong>without free consent is unconstitutional<\/strong> and its results cannot be used as evidence.\n<ul class=\"wp-block-list\">\n<li>This upholds Article 20\u2019s protections against ex-post facto laws, double jeopardy, and self-incrimination.&nbsp;<\/li>\n\n\n\n<li>Such tests also violate the <strong>Right to Privacy under Article 21<\/strong>, which, along with Articles 14 and 19\u2014the \u201cGolden Triangle\u201d\u2014safeguards personal liberty and democratic principles.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>In <strong>Manoj Kumar Saini v. State of MP (2023) and Vinobhai v.
