{"id":60612,"date":"2025-12-04T19:07:22","date_gmt":"2025-12-04T13:37:22","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=60612"},"modified":"2025-12-05T13:15:02","modified_gmt":"2025-12-05T07:45:02","slug":"supreme-court-on-rohingya-deportation-case","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/04-12-2025\/supreme-court-on-rohingya-deportation-case","title":{"rendered":"Supreme Court on Rohingya Deportation Case"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/Governance\/IR<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>In News\u00a0<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court heard a habeas corpus petition by activists alleging disappearance of several Rohingya persons who were in Delhi Police custody since May.\n<ul class=\"wp-block-list\">\n<li>The petitioner maintained that any deportation must still follow due legal process.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Rohingya\u00a0<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>They are a<strong> muslim ethnic group<\/strong> living mainly in <strong>Myanmar\u2019s Rakhine state.\u00a0<\/strong><\/li>\n\n\n\n<li>They speak a dialect of<strong> Bengali rather than Burmese.\u00a0<\/strong><\/li>\n\n\n\n<li>Although they have lived in Myanmar for generations, the government regards them as descendants of colonial-era migrants and denies them full citizenship.<\/li>\n\n\n\n<li>Under Myanmar\u2019s 1982 citizenship law, Rohingya can obtain citizenship only by proving their ancestors lived in the country before 1823; otherwise, they are classified as resident foreigners or associate citizens, even if one parent is Myanmar-born.\n<ul class=\"wp-block-list\">\n<li>As a result, they face restrictions on civil service employment and movement within Rakhine.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Related Laws in india<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>India has <strong>no legal obligation to provide asylum or follow the principle of non-refoulement <\/strong>because it is <strong>not a party to the Refugee Convention<\/strong>, the Convention Against Torture, or the Convention on Enforced Disappearance.<\/li>\n\n\n\n<li>Refugees are detained under older domestic laws \u2014 the <strong>Foreigners Act, 1946,\u00a0 the Passport Act, 1967 &amp; the Citizenship Act, 1955<\/strong>.<\/li>\n\n\n\n<li>Refugee status operates via ad-hoc executive channels with<strong> &#8220;strategic ambiguity&#8221; <\/strong>like the Ministry of Home Affairs handles Sri Lankan Tamils and Tibetans.<\/li>\n\n\n\n<li>The <strong>principle of non-refoulement <\/strong>is accepted as customary international law, prohibiting return to persecution, though not statutorily binding.\n<ul class=\"wp-block-list\">\n<li><strong>Article 21<\/strong> offers basic protections to all persons but no right to reside for non-citizens.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Supreme Court\u2019s recent Observations<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court of India recently observed that Rohingyas cannot be automatically classified as refugees without an official government declaration, stressing that illegal entrants do not have legal rights within the country.<\/li>\n\n\n\n<li>The Court emphasized the need for a clear government stance on their status.
