{"id":59298,"date":"2025-11-17T19:10:30","date_gmt":"2025-11-17T13:40:30","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=59298"},"modified":"2025-11-18T13:20:54","modified_gmt":"2025-11-18T07:50:54","slug":"gender-neutrality-pocso-act","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/editorial-analysis\/17-11-2025\/gender-neutrality-pocso-act","title":{"rendered":"Gender Neutrality Under the POCSO Act"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/Governance; Social Issues<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court of India is currently reviewing a petition challenging the <strong>gender-specific interpretation of the POCSO Act, 2012<\/strong>, in a case where a woman is accused of penetrative sexual assault against a minor boy.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Understanding the POCSO Act, 2012<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Protection of Children from Sexual Offences <strong>(POCSO) Act, 2012 <\/strong>defines a <strong>\u2018child\u2019 as any person below the age of 18<\/strong>, without reference to gender.<\/li>\n\n\n\n<li>It criminalizes a range of sexual offences \u2014 such as penetrative and non-penetrative sexual assault, sexual harassment, and pornography \u2014 <strong>regardless of the gender<\/strong> of the victim or the perpetrator.\n<ul class=\"wp-block-list\">\n<li><strong>Penetrative Sexual Assault <\/strong>is defined under <strong><em>Section 3<\/em><\/strong><strong> <\/strong>of <strong>POCSO Act, 2012<\/strong>, and <strong>applies to all genders<\/strong>.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong><em>Section 5(k)<\/em><\/strong> and<em> <\/em><strong><em>Section 9(k)<\/em><\/strong> of the <strong>POCSO Act<\/strong> address aggravated penetrative sexual assault, especially when the <strong>child has a mental or physical disability.<\/strong><\/li>\n\n\n\n<li><strong>Section 6<\/strong> prescribes stringent <strong>punishment<\/strong>: minimum 20 years of rigorous imprisonment, which may extend to life imprisonment or even the death penalty in extreme cases.\n<ul class=\"wp-block-list\">\n<li>The <strong>Amendment to the POCSO Act (2019)<\/strong> further strengthened penalties and clarified procedural safeguards for child victims.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>It is intentionally broad to cover various forms of abuse, and does not specify the gender of either the victim or the perpetrator, making it gender-neutral by design.<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td><strong>Child &amp; Constitution of India<\/strong><br>&#8211; <strong>Article 23:<\/strong> Prohibition of Human Trafficking and Forced Labour<br>&#8211; <strong>Article 24:<\/strong> Prohibition of Child Labour in Hazardous Jobs.<br>1. No child <strong>below the age of 14 years<\/strong> shall be employed to work in any factory or mine or engaged in any other hazardous employment.<br><strong>Directive Principles of State Policy (DPSP)<\/strong><br>&#8211; <strong>Article 39(e):<\/strong> Directs the state to ensure that children are not forced by economic necessity to enter vocations unsuited to their age or strength.<br>&#8211; <strong>Article 39(f):<\/strong> Mandates that children grow up in conditions of freedom and dignity and are protected against exploitation and moral abandonment.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Legislative Intent &amp; Interpretation<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Pronoun \u2018He\u2019 Includes \u2018She\u2019: <\/strong>Section 13(1) of the <strong><em>General Clauses Act, 1897<\/em><\/strong><strong> <\/strong>makes it clear that <strong>words importing the masculine gender include females<\/strong> unless the statute indicates otherwise.\n<ul class=\"wp-block-list\">\n<li>Thus, the <strong>use of \u2018he\u2019 in Section 3 of POCSO<\/strong> does <strong>not<\/strong> limit the offence to male perpetrators.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Scope of Section 3 Extends Beyond Penile Acts: <\/strong>Section 3 of POCSO covers a broad range of penetrative acts, including <strong>digital penetration; object penetration; and oral penetration;<\/strong>\n<ul class=\"wp-block-list\">\n<li>These acts can be committed by individuals of <strong>any gender<\/strong>, including women.<\/li>\n\n\n\n<li>The provision includes situations where a person compels a child to perform such acts on themselves or a third person \u2014 again reinforcing <strong>gender neutrality<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Related Concerns &amp; Issues<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Contrast With the Gender-Specific Rape Provision: <\/strong>The<strong> Bharatiya Nyaya Sanhita (BNS)<\/strong> provision on <strong>rape (Section 63) <\/strong>explicitly states \u2018<em>a <\/em><strong><em>man<\/em><\/strong><em> commits rape against a <\/em><strong><em>woman\u2019.<\/em><\/strong>\n<ul class=\"wp-block-list\">\n<li>Its choice <em>not<\/em> to do so reflects a <strong>deliberate intent to keep POCSO gender-neutral for perpetrators and victims alike<\/strong>.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Criminalization of Consensual Adolescent Relationships:<\/strong><strong>POCSO Act<\/strong> is increasingly used to prosecute consensual relationships between adolescents.\n<ul class=\"wp-block-list\">\n<li><strong>POCSO Act,<\/strong> in its current form, does not distinguish between exploitative abuse and consensual teenage intimacy.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Mandatory Reporting and Its Consequences:<\/strong><strong>Section 19 of the Act<\/strong> mandates that any knowledge of a sexual offence involving a child must be reported to the police.\n<ul class=\"wp-block-list\">\n<li>It can <strong>infringe on the right to health<\/strong> of adolescent girls, especially in cases involving consensual sex and access to reproductive healthcare, and <strong>discourages minors<\/strong> from seeking medical help or counseling for fear of legal repercussions.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Delays in Investigation and Prosecution:<\/strong> The <strong>Gujarat High Court<\/strong> highlighted the procedural lapses and lack of diligence in a case where POCSO charges were invoked eight years after the original FIR.<\/li>\n\n\n\n<li><strong>Judicial Discretion:<\/strong> The <strong>Supreme Court<\/strong> declined to impose a sentence on a man convicted under POCSO, citing that the victim was now in a relationship with the accused.\n<ul class=\"wp-block-list\">\n<li>It invoked <strong>Article 142<\/strong> to ensure <strong>\u2018complete justice\u2019.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Endorsements of Gender Neutrality<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Legislative Endorsements:<\/strong>\n<ul class=\"wp-block-list\">\n<li><strong>Official Government Clarifications: <\/strong>The Ministry of Women and Child Development (MWCD), in multiple Parliamentary responses, has expressly stated that <strong>POCSO is a gender-neutral law<\/strong>.<\/li>\n\n\n\n<li><strong>Parliamentary Records: <\/strong>The <strong><em>Statement of Objects and Reasons<\/em><\/strong>, at the time of POCSO Amendment in 2019, explicitly reaffirmed the gender-neutral character of POCSO.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Judicial Endorsements:<\/strong>\n<ul class=\"wp-block-list\">\n<li><strong>The Supreme Court of India<\/strong>, in <em>Sakshi v. Union of India (2004)<\/em>, stressed that child sexual abuse includes conduct far beyond penile-vaginal intercourse.\n<ul class=\"wp-block-list\">\n<li>Limiting the <strong>law based on gender<\/strong> would undermine this reality.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Karnataka High Court<\/strong> ruled that a woman can be prosecuted for penetrative sexual assault under the POCSO Act.<\/li>\n\n\n\n<li><strong>Delhi High Court<\/strong> stated that the POCSO Act is a gender-neutral legislation and that its application cannot be limited by assumptions about the gender of offenders.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Conclusion<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The core objective of POCSO is to <strong>protect minors from sexual harm<\/strong>, regardless of the gender identity of the perpetrator. A gender-neutral application is therefore consistent with the law\u2019s protective purpose.<\/li>\n\n\n\n<li>Both statutory interpretation and legislative intent clearly indicate that <strong>women can be prosecuted for penetrative sexual assault under Section 3 of POCSO<\/strong>.<\/li>\n\n\n\n<li>A gender-neutral approach best serves the Act\u2019s overarching goal of safeguarding all children from sexual abuse.<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#fff2cc\"><tbody><tr><td><strong>Daily Mains Practice Question<\/strong><br><strong>[Q]<\/strong> Examine the principle of gender neutrality under the POCSO Act, 2012.
