Anr, has <strong>opened the door for spouses to seek damages, in the civil sphere, from third parties.<\/strong><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>About<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The High Court issued summons in a wife\u2019s suit seeking <strong>damages for Alienation of Affection (AoA),<\/strong> against her husband\u2019s alleged affair partner.<\/li>\n\n\n\n<li><strong>AoA<\/strong> is a term from common law referring to a <strong>\u201cheart-balm\u201d tort,<\/strong> which allows a <strong>spouse to sue a third party<\/strong>, usually the lover, for<strong> wilfully interfering in the marriage <\/strong>and causing \u2018<strong>loss of affection and companionship\u2019.&nbsp;<\/strong><\/li>\n\n\n\n<li><strong>Notably, the Indian legal framework neither codifies nor prohibits AoA.<\/strong>\n<ul class=\"wp-block-list\">\n<li><strong>In Pinakin Mahipatray Rawal versus State of Gujarat (2013)<\/strong>, the Supreme Court held that <strong>\u201calienation of affection by a stranger, if proved, is an intentional tort.\u201d&nbsp;<\/strong><\/li>\n\n\n\n<li><strong>In Indra Sarma versus V.K.V.
