Helped in establishing links in the money laundering chain.<br>&#8211; <strong>AgustaWestland Helicopter Scam (2013 onwards): <\/strong>Through MLAT requests, India sought evidence from Italy, Mauritius, Singapore, and the UK.<br>&#8211; <strong>Nirav Modi &amp; Mehul Choksi (PNB Scam, 2018): <\/strong>India sent MLAT requests to Hong Kong, Singapore, Switzerland, and UAE to trace assets and collect financial evidence.<br>1. Helped in asset seizure and strengthening extradition proceedings.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Objectives and Key Provisions<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Objectives:&nbsp;<\/strong>\n<ul class=\"wp-block-list\">\n<li>Facilitate investigation and prosecution of crimes.<\/li>\n\n\n\n<li>Ensure speedy exchange of evidence and information.<\/li>\n\n\n\n<li>Provide an alternative to lengthy diplomatic channels.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Provisions:<\/strong>\n<ul class=\"wp-block-list\">\n<li>Exchange of documents, records, and evidence.<\/li>\n\n\n\n<li>Identification and location of persons.<\/li>\n\n\n\n<li>Examination of witnesses.<\/li>\n\n\n\n<li>Search and seizure of assets.<\/li>\n\n\n\n<li>Assistance in asset recovery, forfeiture, and confiscation.<\/li>\n\n\n\n<li>Service of judicial documents.<\/li>\n\n\n\n<li>Transfer of persons for testimony.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Challenges in MLATs<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Time-Consuming Process: <\/strong>Requests often take months due to bureaucratic red tape.<\/li>\n\n\n\n<li><strong>Lack of Uniformity in Legal Systems: <\/strong>Different countries have varying evidentiary standards, admissibility rules, and judicial procedures.\n<ul class=\"wp-block-list\">\n<li>Some requests are rejected because they don\u2019t meet local legal requirements.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Limited Coverage: <\/strong>India doesn\u2019t have MLATs with all countries hampering cooperation in jurisdictions without treaties.<\/li>\n\n\n\n<li><strong>Digital Evidence Issues: <\/strong>Rising cybercrimes demand quick access to server logs, emails, cloud data.\n<ul class=\"wp-block-list\">\n<li>Big Tech companies are often located in countries where India doesn\u2019t have speedy MLAT access.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Sovereignty &amp; Privacy Concerns: <\/strong>Countries are reluctant to share sensitive information citing sovereignty or data protection laws.<\/li>\n\n\n\n<li><strong>Resource Constraint: <\/strong>Many developing countries lack trained personnel, infrastructure, and capacity to process MLAT requests efficiently.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Significance<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Tackling Transnational Crimes: <\/strong>Provides a legal mechanism to investigate and prosecute crimes that cross borders such as terrorism, drug trafficking, human trafficking, cybercrimes, and money laundering.<\/li>\n\n\n\n<li><strong>Faster &amp; Reliable Evidence Sharing: <\/strong>Unlike informal channels or diplomatic routes, MLATs offer a direct, legally binding framework for collecting and sharing admissible evidence.<\/li>\n\n\n\n<li><strong>Strengthening Counter-Terrorism Efforts:<\/strong> Helps trace terror financing, identify operatives, and dismantle international terror networks.<\/li>\n\n\n\n<li><strong>Combating Financial Crimes: <\/strong>Assists in locating, freezing, and confiscating assets obtained through corruption, fraud, and black money parked abroad.<\/li>\n\n\n\n<li><strong>Promotes Rule of Law &amp; Mutual Trust: <\/strong>Enhances legal cooperation and builds trust between nations.<\/li>\n\n\n\n<li><strong>Strengthening Diplomatic Ties: <\/strong>MLATs deepen bilateral and multilateral relations by fostering cooperation in sensitive areas of law and security.<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td><strong>Other Mechanisms<\/strong><br>&#8211; <strong>Extradition Treaties: <\/strong>It aims to transfer an accused\/convicted person from one country to another to face trial or serve a sentence.<br>1. <strong>India\u2019s Status:<\/strong> India has extradition treaties with more than 40 countries including UK, USA, France, UAE.<br>&#8211; <strong>Letters Rogatory (LRs): <\/strong>These are formal requests from an Indian court to a foreign court for judicial assistance such as evidence collection, serving summons.<br>1. It is done through diplomatic channels and is usually slower than MLAT.<br>&#8211; <strong>Interpol Mechanisms: <\/strong>It uses tools such as:&nbsp;<br>1. <strong>Red Notice<\/strong> \u2013 request to locate &amp; provisionally arrest a person pending extradition.<br>2.
