class=\"wp-block-list\">\n<li><strong>The Delhi High Court<\/strong> has recently issued a <strong>series of orders<\/strong> protecting the <strong>personality rights of Bollywood celebrities<\/strong> from unauthorised commercial use.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What are Personality Rights?<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Personality rights<\/strong> refer to the <strong>right of a person to protect his\/her personality<\/strong> under the <strong>right to privacy or property.&nbsp;<\/strong>\n<ul class=\"wp-block-list\">\n<li>These could include<strong> a pose, a mannerism or any aspect of their personality.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>These rights are important to celebrities as their <strong>names, photographs or even voices<\/strong> can easily be misused in various advertisements by different companies to boost their sales.<\/li>\n\n\n\n<li>Many celebrities even register some aspects as a trademark to use them commercially.\n<ul class=\"wp-block-list\">\n<li>For example, <strong>Usain Bolt\u2019s \u201cbolting\u201d <\/strong>or lightning pose is a registered trademark.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Reasons for providing these Rights<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The idea is that <strong>only the owner<\/strong> of these distinct features has the <strong>right to derive any commercial benefit from it.<\/strong><\/li>\n\n\n\n<li><strong>Exclusivity<\/strong> is a big factor in attracting commercial dividends for celebrities.&nbsp;<\/li>\n\n\n\n<li>Personality rights are not expressly mentioned in a Laws in India but <strong>fall under the right to privacy.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Legality of Personality Rights<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Celebrities can move the Court and <strong>seek an injunction<\/strong> when an unauthorised third party uses their personality rights for commercial purposes.<\/li>\n\n\n\n<li>Personality rights or their protection are not expressly mentioned in a statute in India but are traced to fall under the <strong>right to privacy (Article 21).<\/strong>&nbsp;<\/li>\n\n\n\n<li><strong>Many concepts in intellectual property rights<\/strong> used in protection of <strong>trademarks <\/strong>such as passing off, deception can be applied while deciding whether a celebrity deserves to be protected through an injunction.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Conclusion<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>India\u2019s courts are increasingly recognising personality rights to protect individuals from digital misuse, including AI-generated content.&nbsp;<\/li>\n\n\n\n<li>While protections are expanding, they must balance free speech, artistic expression, and privacy, highlighting the urgent need for comprehensive
