{"id":54787,"date":"2025-09-22T19:16:33","date_gmt":"2025-09-22T13:46:33","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=54787"},"modified":"2025-09-24T14:42:06","modified_gmt":"2025-09-24T09:12:06","slug":"high-seas-treaty-un-entry-into-force-threshold","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/22-09-2025\/high-seas-treaty-un-entry-into-force-threshold","title":{"rendered":"High Seas Treaty of UN Reaches Entry into Force Threshold"},"content":{"rendered":"\n<p><strong>Syllabus: GS3\/Environment<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Recently, the BBNJ Treaty of the United Nations (UN) crossed the<strong> threshold of 60 ratifications,<\/strong> with Morocco and Sierra Leone becoming the 60th and 61st signatories respectively, paving\u00a0 the way to enter into force in January 2026.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>About the BBNJ Treaty<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It is the <strong>UN&#8217;s High Seas Treaty,<\/strong> formally known as the Agreement under the United Nations Convention on the Law of the Sea on the Conservation and Sustainable Use of Marine <strong>Biological Diversity of Areas Beyond National Jurisdiction (BBNJ).<\/strong>\n<ul class=\"wp-block-list\">\n<li>It builds on the <strong>UN Convention on the Law of the Sea (UNCLOS)<\/strong>, often referred to as the <strong>\u2018Constitution For The Oceans\u2019, <\/strong>adopted in 1982 and effective since 1994.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>It is designed to safeguard biodiversity in the <strong>high seas \u2014 areas that lie beyond national jurisdictions<\/strong>, and <strong>aligning with the Kunming-Montreal Global Biodiversity Framework<\/strong> goal of <strong>protecting 30% of the world\u2019s land and sea areas by 2030.<\/strong>\n<ul class=\"wp-block-list\">\n<li>Currently, <strong>only 1.44% of the high seas <\/strong>are under <strong>any form of protection<\/strong>.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>It establishes <strong>legally binding rules to:<\/strong>\n<ul class=\"wp-block-list\">\n<li>Create <strong>Marine Protected Areas (MPAs)<\/strong> in international waters; At present, <strong>6.35% of the ocean is protected<\/strong>, with just <strong>1.89% designated as no-take MPAs<\/strong>, where extractive activities are prohibited.<\/li>\n\n\n\n<li>Ensure fair and equitable sharing of benefits from <strong>Marine Genetic Resources (MGRs);<\/strong><\/li>\n\n\n\n<li><strong>Mandate Environmental Impact Assessments (EIAs) <\/strong>for activities like deep-sea mining and carbon sequestration;<\/li>\n\n\n\n<li>Promote scientific cooperation, capacity building, and technology transfer;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td><strong>Criteria For Treaty To Enter Into Force<\/strong><br>&#8211; According to the UN, the criteria for a treaty to enter into force are <strong>typically outlined within the treaty itself.<\/strong><br>&#8211; For the <strong>BBNJ Treaty<\/strong>, the specific condition is:<br>1. The treaty enters into force <strong>120 days after<\/strong> the deposit of the <strong>60th instrument of ratification, approval, acceptance, or accession<\/strong>.<br>2. It means that once 60 countries formally ratify or accede to the treaty, a countdown of 120 days begins, after which the treaty becomes legally binding for those parties.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>India\u2019s Role and Strategic Interests<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>India\u2019s Union Cabinet<\/strong> approved the <strong>signing of the BBNJ Treaty in July 2024<\/strong> with the aim to<strong> <\/strong>enhance India\u2019s strategic presence beyond its <strong>Exclusive Economic Zone (EEZ).<\/strong>\n<ul class=\"wp-block-list\">\n<li>It opens avenues for scientific research, and facilitates access to marine genetic resources and technology.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>India\u2019s proactive stance reflects its commitment to <strong>Sustainable Development Goal 14<\/strong> <strong>(Life Below Water)<\/strong> and its broader vision of environmental stewardship.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Next Steps: PrepCom and COP1<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Preparatory Commission (PrepCom): <\/strong>To <strong>define the operational mechanics<\/strong> of the treaty.\n<ul class=\"wp-block-list\">\n<li>These include setting up the scientific and technical bodies, determining qualifications for experts, and outlining procedures for reviewing MPA proposals.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>First Conference of Parties (COP1)<\/strong>: It will be convened after the treaty enters into force, marking the beginning of formal implementation.<\/li>\n\n\n\n<li>These sessions have focused on governance, the <strong>Clearing-House Mechanism,<\/strong> financial rules, and resource mobilization.<\/li>\n<\/ul>\n\n\n\n<p><a
