Japan, Luxembourg, and the U.S. have enacted frameworks to facilitate licensing, liability coverage, and commercial rights over space activities.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>India\u2019s approach to space legislation<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>India\u2019s space legislation follows a deliberate, phased approach, focusing first on technical regulations to enable commercial space operations in compliance with <strong>Article VI of the Outer Space Treaty<\/strong>.&nbsp;<\/li>\n\n\n\n<li>This has led to key regulatory instruments such as the <strong>Catalogue of Indian Standards for Space Industry, the <a href=\"https:\/\/www.nextias.com\/ca\/current-affairs\/07-04-2023\/indian-space-policy-2023\" data-type=\"link\" data-id=\"https:\/\/www.nextias.com\/ca\/current-affairs\/07-04-2023\/indian-space-policy-2023\">Indian Space Policy (2023)<\/a>, and the IN-SPACe Norms, Guidelines and Procedure<\/strong>s, which collectively facilitate the authorisation of non-governmental space activities.\u00a0<\/li>\n\n\n\n<li><strong>India has ratified the key UN space treaties<\/strong> but it is still in the process of enacting comprehensive national space legislation.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Importance of National Space Law for India<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Regulate Private Sector and Protect National Security<\/strong> \u2013 India\u2019s growing private space industry lacks clear legal guidelines on licensing, liability, and dispute resolution.\n<ul class=\"wp-block-list\">\n<li>&nbsp;Legal oversight is needed to safeguard sensitive technologies, prevent espionage, and address space militarization.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Meet International Commitments<\/strong> \u2013 A domestic law would enforce compliance with global treaties like the Outer Space Treaty and Liability Convention.<\/li>\n\n\n\n<li><strong>Enable Commercial Growth \u2013<\/strong> A clear legal framework would boost investor confidence, insurance markets, and innovation in space tech.<\/li>\n\n\n\n<li><strong>Ensure Sustainability and Ethics<\/strong> \u2013 Laws are essential to manage space debris, orbital congestion, and promote responsible exploration.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What are industry perspectives?<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Industry leaders highlight the urgent need for a robust national space law to address operational challenges and regulatory gaps.&nbsp;<\/li>\n\n\n\n<li>Leaders stressed the importance of granting statutory authority to IN-SPACe, clearly defining licensing procedures, easing FDI norms, and establishing liability and insurance frameworks.&nbsp;<\/li>\n\n\n\n<li>There should be protection of intellectual property, better inter-ministerial coordination, enforceable rules on space debris and accidents, and an independent appellate body.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Way Ahead&nbsp;<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>India\u2019s advancing space ambitions\u2014human spaceflight, lunar missions, and a national space station\u2014require a strong legal framework.&nbsp;<\/li>\n\n\n\n<li>Without it, the country\u2019s strategic and commercial goals risk being compromised.
