{"id":43752,"date":"2025-05-20T19:16:57","date_gmt":"2025-05-20T13:46:57","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=43752"},"modified":"2025-05-20T19:17:10","modified_gmt":"2025-05-20T13:47:10","slug":"us-passes-take-it-down-act","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/20-05-2025\/us-passes-take-it-down-act","title":{"rendered":"US Passes Take It Down Act"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/ International Relations<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>In News<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The U.S. President Donald Trump signed the Take It Down Act, criminalizing the non-consensual sharing of intimate images including AI-generated deepfakes.\n<ul class=\"wp-block-list\">\n<li>An online boom in non-consensual deepfakes is currently outpacing efforts to regulate the technology around the world due to a proliferation of AI tools.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What is the Take It Down Act?<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Act makes it illegal to \u201cknowingly publish\u201d or threaten to publish intimate images without a person\u2019s consent, including AI-created \u201cdeepfakes.\u201d\u00a0<\/li>\n\n\n\n<li>It also requires websites and social media companies to remove such material within 48 hours of notice from a victim.\u00a0<\/li>\n\n\n\n<li>The platforms must also take steps to delete duplicate content.\u00a0<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>About Deepfakes<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Deepfakes are synthetic media generated using Artificial Intelligence (AI), particularly through machine learning techniques like GANs (Generative Adversarial Networks).\u00a0<\/li>\n\n\n\n<li>These tools can fabricate hyper-realistic images, videos, or audio, making it appear as if someone said or did something they never actually did.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Impacts of Deepfakes<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Deepfakes can be used to create fake news, propaganda, or doctored statements from public figures, influencing public opinion, eroding trust in media, and potentially disrupting elections or inciting social unrest.<\/li>\n\n\n\n<li>Unethical use of deepfake technology is creating pornographic content by superimposing individuals&#8217; victimising women.<\/li>\n\n\n\n<li>The unauthorized use of a person&#8217;s likeness or voice in deepfakes raises serious privacy concerns.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Legal Provisions in India<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Information Technology Act, 2000 (IT Act): <\/strong>Sections 66E and 67 penalize the violation of privacy and the transmission of obscene material electronically.\u00a0<\/li>\n\n\n\n<li><strong>Indian Penal Code (IPC), 1860 (now largely replaced by the Bharatiya Nyaya Sanhita &#8211; BNS, 2023): <\/strong>Section 356 of the BNS deals with defamation, organized crime (Section 111), theft in digital form (Section 316), and cheating (Section 318).<\/li>\n\n\n\n<li><strong>Digital Personal Data Protection Act, 2023: <\/strong>Focusing on the unauthorized processing of personal data<\/li>\n\n\n\n<li><strong>Indecent Representation of Women (Prohibition) Act, 1986: <\/strong>Prohibits depiction of women in indecent manner.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Legal Gaps &amp;
