Gavai Sworn in as Chief Justice of India"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/ Polity and Governance<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Justice Bhushan Ramkrishna Gavai was sworn in by President Droupadi Murmu as the 52nd Chief Justice of India.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Constitutional Provisions<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Constitution of India does not mention any procedure for appointing the CJI.\n<ul class=\"wp-block-list\">\n<li><strong>Article 124 (1) <\/strong>of the Constitution merely says, \u201cThere shall be a Supreme Court of India consisting of a Chief Justice of India.\u201d<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Clause (2) of Article 124<\/strong> of the Constitution says that every Judge of the Supreme Court shall be appointed by the President.\n<ul class=\"wp-block-list\">\n<li>Thus, in the absence of a constitutional provision, the procedure to appoint CJI relies on convention.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What is the Convention?<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The outgoing CJI recommends his successor<\/strong> a practice, which is strictly based on seniority.<\/li>\n\n\n\n<li>Seniority, however, is not defined by age, but by the number of years a judge has been serving in the top court of the country.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Eligibility<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Apart from being an Indian citizen, the person must;\n<ul class=\"wp-block-list\">\n<li>Have been for at least <strong>five years a Judge of a High Court <\/strong>or of two or more such Courts in succession or,<\/li>\n\n\n\n<li>Have been for<strong> at least ten years an advocate of a High Court <\/strong>or of two or more such Courts in succession, or<\/li>\n\n\n\n<li>Be, in the opinion of the President, a <strong>distinguished jurist.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Tenure and Retirement<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Constitution <strong>does not fix a tenure<\/strong> for the Chief Justice.<\/li>\n\n\n\n<li>The <strong>retirement age <\/strong>for Supreme Court judges, including the CJI, is<strong> 65 years.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Removal of CJI<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The constitution provides that a judge can be removed only<strong> by an order of the president,<\/strong> based on a motion passed by both houses of parliament.\u00a0<\/li>\n\n\n\n<li>The procedure for removal of judges is elaborated in the <strong>Judges Inquiry Act, 1968. <\/strong>The Act sets out the following steps for removal from office:<\/li>\n<\/ul>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full is-resized\"><img data-dominant-color=\"4f433a\" data-has-transparency=\"false\" loading=\"lazy\" decoding=\"async\" width=\"509\" height=\"559\" src=\"https:\/\/wp-images.nextias.com\/cdn-cgi\/image\/format=auto\/ca\/uploads\/2025\/05\/Removal-of-CJI.png\" alt=\"Removal of CJI\" class=\"not-transparent wp-image-43399\" style=\"--dominant-color: #4f433a;
