{"id":42780,"date":"2025-05-06T20:16:55","date_gmt":"2025-05-06T14:46:55","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=42780"},"modified":"2025-05-06T20:17:11","modified_gmt":"2025-05-06T14:47:11","slug":"appointment-to-central-bureau-of-investigation-cbi","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/06-05-2025\/appointment-to-central-bureau-of-investigation-cbi","title":{"rendered":"Appointment to Central Bureau of Investigation (CBI)"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/Polity &amp; Governance<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Recently, the <strong>high-level committee<\/strong>, headed by the Prime Minister of India, met to select the <strong>next Director of the Central Bureau of Investigation (CBI)<\/strong>.\n<ul class=\"wp-block-list\">\n<li>Due to the lack of consensus on a new appointment, incumbent CBI Director is all set to get a one-year extension.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>About the Central Bureau of Investigation (CBI)<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It is India\u2019s specialized investigative agency, responsible for tackling high-profile crimes, corruption, and national security matters.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Origins &amp; Evolution<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The CBI traces its roots to the <strong>Special Police Establishment (SPE), formed in 1941<\/strong> to investigate corruption in wartime procurement.<\/li>\n\n\n\n<li>It was officially <strong>established by an executive order<\/strong> of the Government of India in <strong>1963, <\/strong>on the recommendation of<strong> Santhanam Committee.<\/strong>\n<ul class=\"wp-block-list\">\n<li>It was <strong>not created by an Act of Parliament,<\/strong> thus <strong>not a Statutory Body.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Functioning<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Under DoPT, Ministry of Personnel, Public Grievances, and Pensions.<\/li>\n\n\n\n<li>It derives its <strong>investigative powers<\/strong> from the <strong>Delhi Special Police Establishment (DSPE) Act, 1946.<\/strong><\/li>\n\n\n\n<li>It is <strong>exempted<\/strong> from the purview of the <strong>Right to Information (RTI) Act.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Jurisdiction<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Central Government can authorize CBI to investigate such a crime in a State <strong>but only with the consent<\/strong> of the concerned State Government.\u00a0<\/li>\n\n\n\n<li>The <strong>Supreme Court and High Courts<\/strong> can order CBI to investigate such a crime anywhere in the country <strong>without the consent of the State.<\/strong><\/li>\n\n\n\n<li>CBI can <strong>suo-moto<\/strong> take up investigation of offences <strong>only in the Union Territories.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Organizational Structure of CBI<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Director of CBI:<\/strong> It is the head of the agency, appointed by the Central Government.\n<ul class=\"wp-block-list\">\n<li>Oversees all investigative operations and policy decisions.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Specialized Divisions: <\/strong><em>Anti-Corruption Division; Economic Offenses Division; Special Crimes Division; Directorate of Prosecution; Policy &amp; Coordination Division; and Central Forensic Science Laboratory.<\/em><\/li>\n\n\n\n<li><strong>Regional Offices:<\/strong> CBI has regional offices across India, each headed by a Joint Director or Additional Director.<\/li>\n\n\n\n<li><strong>International Coordination:<\/strong> CBI serves as India\u2019s nodal agency for <strong>Interpol, <\/strong>handling <strong>cross-border investigations.<\/strong><\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td><strong>Appointment of the Director of the CBI<\/strong><br>&#8211; The Director of the CBI is appointed by the <strong>Appointments Committee of the Cabinet <\/strong>based on recommendations from a <strong>high-level selection panel.<\/strong>\u00a0<br>&#8211; The selection process follows provisions under the Delhi Special Police Establishment (DSPE) Act, 1946.<br>&#8211; <strong>Selection Committee Composition:<\/strong><br>1. Prime Minister of India (Chairperson)<br>2. Chief Justice of India (CJI)<br>3.
