{"id":42019,"date":"2025-04-25T19:00:53","date_gmt":"2025-04-25T13:30:53","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=42019"},"modified":"2025-04-25T19:00:54","modified_gmt":"2025-04-25T13:30:54","slug":"wto-global-trade-landscape","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/editorial-analysis\/25-04-2025\/wto-global-trade-landscape","title":{"rendered":"Relevance of WTO in Changing Global Trade Landscape"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/Effects of Policies on India\u2019s Interest; GS3\/Agriculture<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In recent years, the relevance of the World Trade Organisation (WTO) has been questioned due to institutional paralysis, stalled negotiations, and rising protectionism.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>About the World Trade Organisation (WTO)<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It is the <strong>only global international organisation<\/strong> dealing with the rules of trade between nations.<\/li>\n\n\n\n<li>Its main function is<strong> to ensure that trade flows<\/strong> as smoothly, predictably, and freely as possible.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Formation of WTO<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Predecessor: The General Agreement on Tariffs and Trade (GATT)<\/strong> was established by a multilateral treaty of 23 countries in 1947 after World War II.\n<ul class=\"wp-block-list\">\n<li>GATT was designed <strong>to provide an international forum<\/strong> that <strong>encouraged free trade<\/strong> between member states by <strong>regulating and reducing tariffs<\/strong> on traded goods and by providing <strong>a common mechanism for resolving trade disputes<\/strong>.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>The Marrakesh Agreement:<\/strong> The establishment of the WTO was agreed upon during the <strong>Uruguay Round of GATT negotiations<\/strong>, which took place from 1986 to 1994.\n<ul class=\"wp-block-list\">\n<li>It was signed by 123 nations on April 15, 1994, marking the culmination of the Uruguay Round and the official establishment of the WTO.<\/li>\n\n\n\n<li>It expanded upon the scope of the GATT to <strong><em>include new areas such as services, intellectual property, dispute resolution, and trade policy review mechanisms<\/em><\/strong>.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The WTO officially commenced operations on January 1, 1995, in accordance with the 1<strong>994 Marrakesh Agreement, <\/strong>replacing the GATT.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Organisational Structure of WTO<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Ministerial Conference:<\/strong> The WTO\u2019s <strong>apex decision-making<\/strong> body is the <strong>Ministerial Conference<\/strong>, which <em>usually <\/em>takes place <strong>every two years<\/strong>.<\/li>\n\n\n\n<li><strong>General Council:<\/strong> It is just below the Ministerial Conference that meets several times a year at the WTO\u2019s headquarters in Geneva.\n<ul class=\"wp-block-list\">\n<li>It meets as the <strong>Trade Policy Review Body<\/strong> and the <strong>Dispute Settlement Body<\/strong>.<\/li>\n\n\n\n<li><strong>Trade Related Intellectual Property Rights (TRIPS) Council: <\/strong>It is for the Goods, Services, and Intellectual Property<strong>,<\/strong> and it reports to the General Council.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td><strong>Dispute Settlement Mechanism of WTO:<\/strong><br>&#8211; The WTO has a Dispute Settlement Mechanism to resolve trade disputes between its member countries, and has one of the most active international dispute settlement mechanisms in the world.<br>1. Since 1995, over 350 rulings have been issued.<br>&#8211; <strong>Appellate Body (Dispute Settlement System of WTO): <\/strong>These play a crucial role in resolving trade disputes among WTO members.<br>1. <strong>The Appellate Body<\/strong> was established in 1995 under Article 17 of the Understanding on Rules and Procedures Governing the Settlement of Disputes.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Challenges Facing the WTO<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Dispute Settlement Crisis:<\/strong> The Appellate Body, WTO\u2019s apex dispute resolution forum, has been non-functional since 2019 due to the U.S. blocking judge appointments.\n<ul class=\"wp-block-list\">\n<li>Countries now resort to bilateral retaliation and unilateral trade measures, weakening the WTO\u2019s enforcement mechanisms.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Rise of Protectionism:<\/strong> The U.S.\u2013China trade war, export restrictions, and sanctions reflect growing disregard for WTO norms.\n<ul class=\"wp-block-list\">\n<li>Many nations violate <strong>Most Favoured Nation (MFN)<\/strong> principles, fragmenting the global trade order.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Stalled Negotiations:<\/strong> The <strong>Doha Development Agenda (2001)<\/strong> aimed to address developing nations&#8217; concerns but has stalled for over two decades.\n<ul class=\"wp-block-list\">\n<li>No meaningful consensus has been reached on agricultural subsidies, fisheries policies, or digital trade regulations.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Failure to Address Emerging Trade Domains:<\/strong> WTO lacks binding rules on e-commerce, digital taxation, and climate-related trade policies.\n<ul class=\"wp-block-list\">\n<li>Countries increasingly form regional trade agreements, bypassing WTO frameworks.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Marginalization of Developing Nations:<\/strong> Developing countries argue that their interests are sidelined in WTO negotiations.\n<ul class=\"wp-block-list\">\n<li><strong>Special and Differential Treatment (S&amp;DT)<\/strong> provisions are under threat, limiting their ability to protect domestic industries.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>India\u2019s Position on WTO Reforms<\/strong><\/h2>\n\n\n\n<ul
