class=\"wp-block-list\">\n<li>The Union government introduced the Immigration and Foreigners Bill, 2025 in the Lok Sabha, aimed at overhauling India\u2019s immigration system.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Key Provisions<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The Bill seeks to replace<\/strong> four pre-Independence and early post-Independence Acts: the Passport (Entry into India) Act, <strong>1920,<\/strong> the Registration of Foreigners Act, <strong>1939,<\/strong> the Foreigners Act, <strong>1946<\/strong>, and the Immigration (Carriers&#8217; Liability) Act, <strong>2000.<\/strong><\/li>\n\n\n\n<li><strong>Establishment of Bureau of Immigration: <\/strong>The Bill proposes the establishment of a Bureau of Immigration<strong> (Section 5)<\/strong>, headed by a Commissioner.\n<ul class=\"wp-block-list\">\n<li>The Bureau will regulate immigration, oversee entry and exit of foreigners, and perform other functions as prescribed by the Centre.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Central Government\u2019s Powers over Foreigners:<\/strong> Under <strong>Section 7<\/strong>, the Bill empowers the Central government to:\n<ul class=\"wp-block-list\">\n<li><strong>Specify entry and departure points<\/strong> and impose conditions on foreigners upon arrival.<\/li>\n\n\n\n<li>Order foreigners to stay in designated areas or prohibit them from entering specific regions.<\/li>\n\n\n\n<li>Mandate <strong>identity verification<\/strong>, biometric submission, and medical examination for foreigners.<\/li>\n\n\n\n<li><strong>Restrict association with certain individuals <\/strong>or involvement in specified activities.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Punishments: <\/strong>The Bill also carries punishments for foreigners who:\n<ul class=\"wp-block-list\">\n<li>Enter any area without a valid passport or a travel document <strong>(Section 21). <\/strong>The punishment is up to <strong>five years<\/strong> imprisonment and\/or a fine of up to <strong>Rs 5 lakh.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Restrictions on carriers:<\/strong> A carrier has been defined as a person or entity \u201cengaged in the business of transporting passengers or cargo by air, water or land by aircraft or ship or any other mode of transport\u201d.\n<ul class=\"wp-block-list\">\n<li><strong>Under Section 17,<\/strong> carriers are required to share information related to the passengers and crew with an immigration officer or with a District Magistrate\/Police Commissioner when asked.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Criticism of the Bill<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Violation of Fundamental Rights:<\/strong> It is argued that the Bill violates fundamental rights by granting the government excessive powers over foreigners, potentially affecting asylum seekers and legitimate travelers.<\/li>\n\n\n\n<li><strong>Lack of an Appeal Mechanism: <\/strong>The government\u2019s authority to issue binding directives without a transparent appeal mechanism raises concerns over natural justice and due process.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Concluding remarks<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Immigration and Foreigners Bill, 2025, represents an effort to modernize India&#8217;s immigration framework.\u00a0<\/li>\n\n\n\n<li>However, concerns regarding human rights implications, and broad executive authority highlight the need for additional safeguards.\u00a0<\/li>\n\n\n\n<li>Addressing these concerns by introducing clear legal recourse and judicial
