{"id":37568,"date":"2025-02-18T18:47:21","date_gmt":"2025-02-18T13:17:21","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=37568"},"modified":"2025-02-22T11:52:17","modified_gmt":"2025-02-22T06:22:17","slug":"immigration-foreigners-bill-2025","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/18-02-2025\/immigration-foreigners-bill-2025","title":{"rendered":"The Immigration and Foreigners Bill, 2025"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/Governance<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The government has developed a draft legislation, <strong>The Immigration and Foreigners Bill, 2025<\/strong>, to regulate foreigners coming to India.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>About<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Matters related to foreigners and immigration are currently governed by: <\/strong>The Foreigners Act, 1946, The Passport (Entry into India) Act, 1920, The Registration of Foreigners Act, 1939 and The Immigration (Carriers\u2019 Liability) Act, 2000.\n<ul class=\"wp-block-list\">\n<li>Three of these laws were enacted during the pre-Constitution period, particularly during the extraordinary times of World Wars I and II.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The necessity has been identified<strong> to repeal these laws and enact a new comprehensive legislation: The Immigration and Foreigners Bill, 2025.<\/strong><\/li>\n\n\n\n<li><strong>The purpose of the new legislation is to:<\/strong>\n<ul class=\"wp-block-list\">\n<li>Avoid multiplicity and overlapping of laws.<\/li>\n\n\n\n<li>Regulate matters related to foreigners, including: Requirement of visas, Registration and other travel-related documentation (passports, etc.).<\/li>\n\n\n\n<li>Streamline the procedures for persons entering and exiting India.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Provisions<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>It obligates the mandatory registration of foreigners<\/strong> upon their arrival and places restrictions on movement, name changes, and stays in protected\/restricted areas.\n<ul class=\"wp-block-list\">\n<li>The burden of proof is on individuals <strong>to establish that they are not foreigners.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Entering India without valid passport\/visa:<\/strong> Up to 5 years in prison and a fine of up to Rs 5 lakh.<\/li>\n\n\n\n<li><strong>Entry, stay, or exit with forged documents: <\/strong>2-7 years in prison and a fine of Rs 1-10 lakh.<\/li>\n\n\n\n<li><strong>Overstaying, violating visa conditions, or accessing restricted areas:<\/strong> Up to 3 years in prison, a fine up to Rs 3 lakh, or both.<\/li>\n\n\n\n<li><strong>Reporting requirements: <\/strong>Educational institutions, universities, hospitals, and nursing homes must report foreigners to the registration officer.<\/li>\n\n\n\n<li><strong>Carrier accountability: <\/strong>Carriers transporting foreigners without valid documents will have to pay a fine up to Rs 5 lakh and failure to pay penalty may lead to the potential seizure of transport.\n<ul class=\"wp-block-list\">\n<li>If any foreigner\u2019s entry has been refused, he shall be handed over to the transport carrier by the Immigration Officer,&nbsp;
