{"id":32809,"date":"2024-11-27T17:45:31","date_gmt":"2024-11-27T12:15:31","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=32809"},"modified":"2024-11-27T17:45:32","modified_gmt":"2024-11-27T12:15:32","slug":"india-signs-the-final-act-of-the-riyadh-design-law-treaty","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/27-11-2024\/india-signs-the-final-act-of-the-riyadh-design-law-treaty","title":{"rendered":"India signs the Final Act of the Riyadh Design Law Treaty"},"content":{"rendered":"\n<p><strong>Syllabus: GS3\/ Science and Technology<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>India has signed the <strong>Riyadh Design Law Treaty (DLT),<\/strong> reaffirming its commitment to fostering inclusive growth and strengthening its <strong>intellectual property (IP) ecosystem.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>About<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The treaty, adopted after almost two decades of negotiations under the <strong>World Intellectual Property Organization (WIPO).<\/strong><\/li>\n\n\n\n<li>The treaty seeks to<strong> harmonize the procedural frameworks for industrial design protection,<\/strong> improving the efficiency and accessibility of registration processes across multiple jurisdictions.<\/li>\n\n\n\n<li>It ensures that the benefits of streamlined <strong>design protection are accessible to all stakeholders,<\/strong> with particular emphasis on small and medium-sized enterprises (SMEs), startups, and independent designers.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Key Provisions of the treaty<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The DLT <strong>introduces several key provisions <\/strong>aimed at benefiting design applicants, including;\n<ul class=\"wp-block-list\">\n<li>Relaxed time limits and the reinstatement of lost rights,\u00a0<\/li>\n\n\n\n<li>The option to correct or add priority claims,\u00a0<\/li>\n\n\n\n<li>Simplified procedures for recording assignments and licenses, and\u00a0<\/li>\n\n\n\n<li>The option to file multiple designs in a single application.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The treaty encourages contracting parties to work towards implementing<strong> electronic industrial design systems <\/strong>and facilitating the e<strong>lectronic exchange of priority documents.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>India\u2019s initiative in safeguarding IPR<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>National IPR Policy 2016 <\/strong>encompassing all IPRs into a single vision document setting in place an institutional mechanism for implementation, monitoring and review of IP laws.\n<ul class=\"wp-block-list\">\n<li>The policy encourages innovation and creativity by providing stronger protection and incentives for inventors, artists, and creators.\u00a0<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Cell for IPR Promotion and Management (CIPAM):<\/strong> It has been set up to coordinate the implementation of the National IPR Policy.<\/li>\n\n\n\n<li><strong>National Intellectual Property Awareness Mission (NIPAM), <\/strong>a \ufb02agship program to impart IP awareness and basic training in educational institutes.<\/li>\n\n\n\n<li><strong>Scheme for Facilitating Startups Intellectual Property Protection(SIPP):<\/strong> it is introduced to foster innovation and entrepreneurship by providing a supportive ecosystem for startups to protect and manage their IP assets.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Concluding remarks<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>India\u2019s signing of the Riyadh Design Law Treaty is a progressive step towards strengthening its intellectual property framework.\u00a0<\/li>\n\n\n\n<li>When combined with initiatives like the<strong> Startup India program<\/strong> and the Startups <strong>Intellectual Property Protection (SIPP) scheme,<\/strong> these provisions will help empower startups and SMEs by boosting their competitiveness and supporting market growth.<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td><strong>What is Intellectual Property?<\/strong><br>&#8211; Intellectual property (IP) refers to creations of the mind, such as inventions; literary and artistic works; designs; and symbols, names and images used in commerce.<br>&#8211; IP is protected in law by patents, copyright and trademarks, which enable people to earn recognition or financial benefit from what they invent or create.\u00a0<br>&#8211; By striking the right balance between the interests of innovators and the wider public interest, the IP system aims to foster an environment in which creativity and innovation can flourish.<br><strong>Types of intellectual property<\/strong><br>&#8211; <strong>Patent: <\/strong>A patent is an exclusive right granted for an invention, which is a product or a process that provides, in general, a new way of doing something, or offers a new technical solution to a problem.\u00a0<br>&#8211; <strong>Copyright:<\/strong> It is a legal term used to describe the rights that creators have over their literary and artistic works.<br>&#8211; <strong>Trademark:<\/strong> It is a sign capable of distinguishing the goods or services of one enterprise from those of other enterprises.\u00a0<br>&#8211; <strong>Industrial design: <\/strong>It constitutes the ornamental or aesthetic aspect of an article.<br>&#8211; <strong>Geographical indications and appellations of origin<\/strong> are signs used on goods that have a specific geographical origin and possess qualities, a reputation or characteristics that are essentially attributable to that place of origin.\u00a0<br>&#8211;
