{"id":32192,"date":"2024-11-14T18:10:34","date_gmt":"2024-11-14T12:40:34","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=32192"},"modified":"2024-11-14T18:10:36","modified_gmt":"2024-11-14T12:40:36","slug":"guidelines-for-prevention-of-misleading-advertisement-in-coaching-sector-2024","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/14-11-2024\/guidelines-for-prevention-of-misleading-advertisement-in-coaching-sector-2024","title":{"rendered":"Guidelines for Prevention of Misleading Advertisement in Coaching Sector, 2024"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/ Education<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <strong>Central Consumer Protection Authority (CCPA)<\/strong> has issued comprehensive guidelines to address the issue of misleading advertisements in the coaching sector.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>About<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>These guidelines are drafted in the wake of growing concerns about <strong>false\/misleading claims, exaggerated success rates, and unfair contracts <\/strong>that coaching institutes often impose on students.\u00a0<\/li>\n\n\n\n<li>Such practices have been found to <strong>mislead students<\/strong>, influencing their decisions by concealing important information, giving false guarantees etc.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Important definition in the Guidelines<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Coaching<\/strong> includes academic support, imparting education, guidance, instructions, study programme or tuition or any other activity of similar nature but does not include counseling, sports, dance, theater and other creative activities;<\/li>\n\n\n\n<li><strong>Coaching Center <\/strong>includes a center, established, run, or administered by any person(s) for providing coaching to more than fifty students;<\/li>\n\n\n\n<li><strong>Endorser<\/strong> shall have the same meaning as provided under <strong>clause 2(f)<\/strong> of the Guidelines for Prevention of Misleading Advertisements and Endorsements for Misleading Advertisements, 2022.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Key Highlights of the Guidelines<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Regulation of Advertisements: <\/strong>The guidelines explicitly prohibit coaching institutes from making false claims related to;\n<ul class=\"wp-block-list\">\n<li>The courses offered, their duration, faculty qualifications, fees, and refund policies.<\/li>\n\n\n\n<li>Selection rates, success stories, exam rankings, and job security promises.<\/li>\n\n\n\n<li>Assured admissions, high exam scores, guaranteed selections or promotions.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Truthful Representation:<\/strong> Misleading representations about the quality or standard of their services are strictly prohibited. Coaching institutes must accurately represent their infrastructure, resources, and facilities.<\/li>\n\n\n\n<li><strong>Convergence with National Consumer Helpline:<\/strong> Every coaching center will be required to partner with the National Consumer Helpline, making it easier for students to raise concerns or complaints regarding misleading advertisements and unfair trade practices.<\/li>\n\n\n\n<li><strong>Fair Contracts:<\/strong> Coaching institutes will no longer be allowed to use successful candidate\u2019s photographs, names, or testimonials without post-selection consent.\u00a0<\/li>\n\n\n\n<li><strong>No Creation of False Urgency:<\/strong> The guidelines aim to address common practices in coaching that create false urgency or scarcity such as suggesting limited seats or overstating demand.<\/li>\n\n\n\n<li><strong>Enforcement and Penalties: <\/strong>Any violation of these guidelines will be treated as a contravention of the <strong>Consumer Protection Act, 2019.<\/strong>\n<ul class=\"wp-block-list\">\n<li>The Central Authority has the power to take stringent actions against offenders, including imposing penalties.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#fff2cc\"><tbody><tr><td><strong>Consumer Protection Act, 2019\u00a0<\/strong><br>&#8211; This Act replaced <strong>The Consumer Protection Act, 1986,<\/strong> and seeks to widen its scope in addressing consumer concerns.<br>&#8211; The new <strong>Act recognises offenses such as providing false information <\/strong>regarding the quality or quantity of a good or service, and misleading advertisements.<br>&#8211; The <strong>Act came into force in July 2020 <\/strong>and it will empower consumers and help them in protecting their rights through its various notified rules and provisions.<br><strong>Central Consumer Protection Authority\u00a0<\/strong><br>&#8211; <strong>Section 10 <\/strong>of the Consumer Protection Act, 2019\u00a0 establishes the<strong> Central Consumer Protection Authority<\/strong> which seeks to promote, protect and enforce the rights of consumers as a class.<br>&#8211; <strong>Powers &amp; Functions of CCPA:<\/strong> It is empowered to:<br>1. conduct investigations into violation of consumer rights and institute complaints \/ prosecution<br>2. order recall of unsafe goods and services<br>3. order discontinuation of unfair trade practices and misleading advertisements<br>4. impose penalties on manufacturers\/endorsers\/publishers of misleading advertisements.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p><strong>Source: <\/strong><a href=\"https:\/\/pib.gov.in\/PressReleasePage.aspx?PRID=2073013\" target=\"_blank\" rel=\"noopener\"><strong>PIB<\/strong><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Central Consumer Protection Authority (CCPA) has issued comprehensive guidelines to address the issue of misleading advertisements in the coaching sector.<\/p>\n","protected":false},"author":4,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[21],"tags":[],"class_list":["post-32192","post","type-post","status-publish","format-standard","hentry","category-current-affairs"],"acf":[],"jetpack_featured_media_url":"","_links":{"self":[{"href":"https:\/\/www.nextias.com\/ca\/wp-json\/wp\/v2\/posts\/32192","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.nextias.com\/ca\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.nextias.com\/ca\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.nextias.com\/ca\/wp-json\/wp\/v2\/users\/4"}],"replies":[{"embeddable":true,"href":"https:\/\/www.nextias.com\/ca\/wp-json\/wp\/v2\/comments?post=32192"}],"version-history":[{"count":1,"href":"https:\/\/www.nextias.com\/ca\/wp-json\/wp\/v2\/posts\/32192\/revisions"}],"predecessor-version":[{"id":32193,"href":"https:\/\/www.nextias.com\/ca\/wp-json\/wp\/v2\/posts\/32192\/revisions\/32193"}],"wp:attachment":[{"href":"https:\/\/www.nextias.com\/ca\/wp-json\/wp\/v2\/media?parent=32192"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.nextias.com\/ca\/wp-json\/wp\/v2\/categories?post=32192"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.nextias.com\/ca\/wp-json\/wp\/v2\/tags?post=32192"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
