{"id":30161,"date":"2024-09-28T19:13:59","date_gmt":"2024-09-28T13:43:59","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=30161"},"modified":"2024-09-28T19:14:00","modified_gmt":"2024-09-28T13:44:00","slug":"india-signs-agreement-to-protect-marine-biodiversity-on-high-seas-at-unga","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/28-09-2024\/india-signs-agreement-to-protect-marine-biodiversity-on-high-seas-at-unga","title":{"rendered":"India Signs Agreement to Protect Marine Biodiversity on High Seas at UNGA"},"content":{"rendered":"\n<p><strong>Syllabus: GS3\/ Environment<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>India has formally signed the Global Ocean Treaty, also known as the Agreement on <strong>Biodiversity Beyond National Jurisdiction (BBNJ).<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>About<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The Ministry of Earth Sciences <\/strong>will spearhead the country&#8217;s implementation of the BBNJ Agreement.<\/li>\n\n\n\n<li>The Agreement allows India to enhance its strategic presence in areas beyond the <strong>EEZ (Exclusive Economic Zone).<\/strong><\/li>\n\n\n\n<li>It would also contribute to achieving several SDGs, particularly <strong>SDG14 (Life Below Water).<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What is the BBNJ Agreement?<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The BBNJ Agreement, or the \u2018<strong>High Seas Treaty\u2019,<\/strong> is an international treaty under the <strong>United Nations Convention on the Law of the Sea (UNCLOS).<\/strong><\/li>\n\n\n\n<li>It sets precise mechanisms for the <strong>sustainable use of marine biological diversity <\/strong>through international cooperation and coordination.\u00a0<\/li>\n\n\n\n<li>Parties cannot claim or exercise sovereign rights over marine resources derived from the high seas and ensure<strong> fair and equitable sharing of benefits.\u00a0<\/strong>\n<ul class=\"wp-block-list\">\n<li><strong>High Seas <\/strong>(areas beyond national jurisdiction) are the global common oceans open to all for internationally lawful purposes such as navigation, overflight, laying submarine cables and pipelines, etc.\u00a0<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Implementation of BBNJ Agreement<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The BBNJ Agreement will be the <strong>third implementation agreement<\/strong> under <strong>UNCLOS<\/strong> if and when it enters into force, alongside its sister implementation agreements:\n<ul class=\"wp-block-list\">\n<li><strong>The 1994 Part XI Implementation Agreement<\/strong> (which addresses the exploration and extraction of mineral resources in the international seabed area) and\u00a0<\/li>\n\n\n\n<li><strong>The 1995 UN Fish Stocks Agreement<\/strong> (which addresses the conservation and management of straddling and highly migratory fish stocks).<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The Agreement was agreed upon in March 2023 and is open for signature for two years starting September 2023.\u00a0<\/li>\n\n\n\n<li>It will be an <strong>international legally binding treaty<\/strong> after it enters force 120 days after the 60th ratification, acceptance, approval or accession.\n<ul class=\"wp-block-list\">\n<li>As of now, <strong>101 countries have signed the BBNJ Agreement,<\/strong> and <strong>10 Parties<\/strong> have ratified it.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#fff2cc\"><tbody><tr><td><strong>United Nations Convention on the Law of the Sea (UNCLOS)<\/strong><br>&#8211; <strong>UNCLOS<\/strong> was adopted in <strong>1982,<\/strong> and came into force in <strong>1994.\u00a0<\/strong><br>&#8211; It lays down a <strong>comprehensive regime of law and order in the world&#8217;s oceans<\/strong> and seas establishing rules governing all uses of the oceans and their resources.<br>&#8211;
