{"id":29927,"date":"2024-09-24T20:11:16","date_gmt":"2024-09-24T14:41:16","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=29927"},"modified":"2024-09-24T20:11:50","modified_gmt":"2024-09-24T14:41:50","slug":"supreme-court-judgement-on-child-pornography","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/24-09-2024\/supreme-court-judgement-on-child-pornography","title":{"rendered":"Supreme Court Judgement on Child Pornography"},"content":{"rendered":"\n<p><strong>Syllabus: GS2\/ Polity and Governance<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court held that viewing in private, downloading, storing, possessing, distributing or displaying pornographic acts involving children, attract criminal liability under the <strong>Protection of Children from Sexual Offences Act (POCSO), 2012<\/strong> and the <strong>Information Technology Act, 2000.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Background<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court verdict was based on an appeal filed by NGO,<strong> Just Right for Children Alliance<\/strong>, against a Madras High Court decision.<\/li>\n\n\n\n<li>The High Court had concluded that watching or downloading pornographic acts involving children in private domains was not a crime under the POCSO Act.\u00a0<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Supreme Court ruling<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court urged the Parliament to amend the POCSO Act to substitute the term \u201cchild pornography\u201d with \u201c<strong>Child Sexual Exploitation and Abuse Material\u201d or CSEAM.<\/strong>\n<ul class=\"wp-block-list\">\n<li>The term child pornography can lead to a trivialisation of the crime, as pornography is often seen as a consensual act between adults.\u00a0<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The court said that <strong>Section 67B of the Information Technology (IT)<\/strong> Act had penalized the use, transmission and publication of obscene materials, including child pornography.\n<ul class=\"wp-block-list\">\n<li>It has also made browsing, creation, collection, online facilitation or enticement of children into any sexual act or conduct an offence.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Section 15 of the POCSO Act <\/strong>penalizes storage of child pornography with an intention to share or transmit it.<\/li>\n\n\n\n<li>The court evolved the principle of <strong>\u2018constructive possession\u2019,<\/strong> which means a person was accountable if at any point of time he had an invariable degree of power and knowledge to control, manipulate, alter, modify or destroy the material.<\/li>\n<\/ul>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full is-resized\"><img data-dominant-color=\"e0dede\" data-has-transparency=\"false\" loading=\"lazy\" decoding=\"async\" width=\"375\" height=\"434\" src=\"https:\/\/wp-images.nextias.com\/cdn-cgi\/image\/format=auto\/ca\/uploads\/2024\/09\/cases-and-victims-jpg.webp\" alt=\"cases and victims\" class=\"not-transparent wp-image-29928\" style=\"--dominant-color: #e0dede;
