The practices fall under \u2018unfair trade practices\u2019 category under Consumer Protection Act, 2019.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Dark Patterns menace in India\u2019s Digital Landscape<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>India&#8217;s e-commerce market is projected to reach $350 billion by 2030,<\/strong> driven by rising Internet access, with 936 million Internet subscribers and 350 million active online users.\n<ul class=\"wp-block-list\">\n<li>The fierce competition in this space pressures businesses to exploit manipulative tactics to gain an edge.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Exploitation of User Psychology:<\/strong> Dark patterns take advantage of cognitive biases and emotional triggers, such as <strong>fear of missing out (FOMO)<\/strong> or urgency, to manipulate user behavior.<\/li>\n\n\n\n<li><strong>Lack of Oversight:<\/strong> There is limited regulation around digital design ethics, allowing companies to use manipulative techniques without significant legal repercussions.<\/li>\n\n\n\n<li><strong>Consumer Vulnerability: <\/strong>With an increasing number of first-time users engaging in digital services, especially in developing markets, there is a knowledge gap that dark patterns exploit.<\/li>\n\n\n\n<li><strong>Complex User Interfaces: <\/strong>Many websites and apps deliberately design complex user interfaces that obscure important information.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Concerns of Drak patterns<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Erosion of Trust: <\/strong>Dark patterns violate the fundamental expectation of honest and transparent interactions between businesses and consumers. Over time, this damages the perceived integrity of digital platforms.<\/li>\n\n\n\n<li><strong>Damage to Brand Reputation: <\/strong>In the long term, businesses risk severe damage to their reputation and hinder their ability to attract and retain customers.<\/li>\n\n\n\n<li><strong>Scrutiny and Legal Risks:<\/strong> With increasing attention from regulatory bodies, companies using dark patterns face potential legal consequences.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Initiatives taken by India<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Central Consumer Protection Authority (CCPA) has notified the <strong>Guidelines for Prevention and Regulation of Dark Patterns, 2023,<\/strong> under section 18 of the <strong>Consumer Protection Act, 2019.<\/strong>\n<ul class=\"wp-block-list\">\n<li>The guidelines have a list of <strong>13 specified dark patterns<\/strong>. These are: false urgency; basket sneaking; confirm shaming; forced action; subscription trap; interface interference; bait and switch; drip pricing; disguise advertisement; nagging; trick question; Saas billing; and rogue malwares.<\/li>\n\n\n\n<li>The guidelines will <strong>apply to all platforms,<\/strong> systematically offering goods or services in India; advertisers and sellers.\u00a0<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>The Consumer Protection (E-commerce) Rules, 2020,<\/strong> prohibits e-commerce entities from indulging in unfair trade practices.<\/li>\n\n\n\n<li><strong>The Digital Personal Data Protection Act, 2023, <\/strong>states the requirement of free and unambiguous consent of individuals prior to the processing of their personal data.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Global initiatives<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In the European Union, regulations such as the <strong>Digital Services Act (DSA)<\/strong>, <strong>General Data Protection Regulation (GDPR)<\/strong> and the <strong>Unfair Commercial Practices Directive (UCPD)<\/strong> address the concerns of Dark patterns.<\/li>\n\n\n\n<li>In the United States, various States have introduced legislation to combat dark patterns, including the <strong>California Privacy Rights Act, the Connecticut Data Privacy Act, <\/strong>and <strong>Colorado Privacy Act.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Way Ahead<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Adopting a User-First Approach: <\/strong>To address the issue businesses must prioritize user experience by regularly reviewing and improving their interfaces to eliminate dark patterns. This includes:\n<ul class=\"wp-block-list\">\n<li>Ensuring transparency in subscription terms,<\/li>\n\n\n\n<li>Providing easy opt-out options and<\/li>\n\n\n\n<li>Offering clear and straightforward instructions for canceling services.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Educating designers and developers on ethical design practices<\/strong> is essential for responsible innovation.
