the right to fair compensation of the citizen;&nbsp;<\/li>\n\n\n\n<li>the duty of the state to conduct the process of acquisition efficiently and within prescribed timelines;&nbsp;<\/li>\n\n\n\n<li>and finally, the conclusion of the proceedings leading to vesting or the right of conclusion.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-3a3da93a2a8338ec7eb1b3ac495184e0\" style=\"color:#ff6a00\"><strong>Significance of the Judgement<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The ruling not only clarified the State\u2019s obligations but also strengthened the procedural protections afforded to property owners, reinforcing the constitutional principles of justice and fairness in property rights.<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#fff2cc\"><tbody><tr><td><strong>Right to Property<\/strong><br><br>&#8211; Since the Constitution of India came into force, <strong>the right to property was given fundamental status.&nbsp;<\/strong><br>a. Article 31 and Article 19(1)(f) ensured that any person&#8217;s right against his property remains protected.<br>&#8211; But by the <strong>Constitutional 44th Amendment act 1978,<\/strong> these two above-mentioned articles were deleted and<strong> were added in Part XII, containing only one article 300A.<\/strong><br>a. The legal status of the Right to Property was changed from the fundamental right to <strong>constitutional right.<\/strong><br>&#8211;&nbsp;In <strong>Jilubhai Nanbhai Khachar v. State of Gujrat<\/strong>, it was held that the Right to property u\/A 300A is not a basic structure of the Constitution. draft law, called the <strong>Digital Competition Bill, 2024.<\/strong><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-5f077d3f6cdce2eb40c8488bd933c5c6\" style=\"color:#ff6a00\"><strong>About<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It has provisions to set <strong>presumptive norms<\/strong> <strong>to curb anti-competitive practices<\/strong> before they actually take place, and promises to impose heavy penalties for violations.&nbsp;<\/li>\n\n\n\n<li>The law could stop tech giants like Google, Facebook, and Amazon from self-preferencing their own services, or using data gathered from one company to benefit another group company.<\/li>\n\n\n\n<li>The proposal is similar to the <strong>EU\u2019s Digital Markets Act (DMA),<\/strong> which requires large tech firms like Alphabet, Amazon and Apple to open their services, and not favour their own at the expense of rivals.\n<ul class=\"wp-block-list\">\n<li>The law came in on the back of a long history of anti-competitive practices by these companies.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-5f70ce32732d44e9214f244ea634ea8d\" style=\"color:#ff6a00\"><strong>Background<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In March this year, the <strong>Committee on Digital Competition Law (CDCL) <\/strong>published its report outlining the <strong>challenges associated with anti-competitive practices of digital enterprises <\/strong>such as anti-steering, self-preferencing, tying, and bundling in the digital markets in India.<\/li>\n\n\n\n<li>The committee had proposed a Digital Competition Bill in the report, providing for <strong>ex-ante regulations <\/strong>to curb these anti-competitive practices.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-74dcfe960eab395d1b191c8644d93456\" style=\"color:#ff6a00\"><strong>Key Highlights<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Predictive Regulation:<\/strong> It proposes a forward-looking, preventive, and presumptive law (an ex ante framework) that <strong>foresees the potential harms <\/strong>that can arise out of antitrust issues and prescribes pre-determined <strong>no-go areas<\/strong> is perhaps the way forward.\n<ul class=\"wp-block-list\">\n<li>Currently, India follows an ex post antitrust framework under the Competition Act, 2002.&nbsp;<\/li>\n\n\n\n<li>One of the biggest criticisms of the law has been that <strong>regulating after the incidence of market abuse involves delays<\/strong> \u2014 by the time the offending company has been penalised, market dynamics change to rule out smaller competitors.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Significant entities: <\/strong>The Bill proposes that for certain \u201c<strong>core digital services\u201d<\/strong> like <strong>search engines, and social media sites,<\/strong> the Competition Commission of India (CCI) should designate companies as \u201c<strong>Systematically Significant Digital Enterprise (SSDE)\u201d<\/strong> depending on various <strong>quantitative and qualitative parameters such as turnover, user base, market influence etc.<\/strong>\n<ul class=\"wp-block-list\">\n<li>Entities that don\u2019t fall under these parameters can still be designated as SSDEs if the CCI believes that they have a significant presence in any given core digital service.&nbsp;<\/li>\n\n\n\n<li>Entities which are designated as SSDEs, have been <strong>prohibited from engaging in practices such as self-preferencing, anti-steering, and restricting third party applications.&nbsp;<\/strong><\/li>\n\n\n\n<li>If they violate these requirements, they can be <strong>fined up to 10% of their global turnover.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Associate Digital Enterprises: <\/strong>Understanding the role that data collected by one company of a major technology group can play in benefitting other group companies, the Bill proposes to <strong>designate associate digital enterprises (ADEs).<\/strong>\n<ul class=\"wp-block-list\">\n<li>If an entity of a group is determined to be an associate entity, they would have the same obligations as SSDEs depending on the level of their involvement with the core digital service offered by the main company.&nbsp;<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Enforcement of provisions: <\/strong>The draft Bill empowers the <strong>Director General<\/strong>, appointed under the 2002 Act, to investigate any contraventions when directed by the CCI.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-06586231f69873cb9a6fbb08473a45bf\" style=\"color:#ff6a00\"><strong>Need for the Bill<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The big tech companies have shown a <strong>history of engaging in anti-competitive practices,<\/strong> and a presumptive framework would work better to address this.\n<ul class=\"wp-block-list\">\n<li>Last year, Google was fined Rs 1.337 crore by the CCI for its anti-competitive conduct in the Android ecosystem.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>There is also concern that in the last decade or so, a <strong>majority of the innovation<\/strong> has been confined to within the stables of a handful of big tech companies, mostly from the US.\n<ul class=\"wp-block-list\">\n<li>Officials believe that a big reason for this are the <strong>high market barriers for new entrants in the sector \u2014<\/strong> in the online market.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-a478ba7b59bdcebcb46f80787c748420\" style=\"color:#ff6a00\"><strong>Criticism of the Draft Bill<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Compliance Burden:<\/strong> For big tech companies, an ex ante framework with its strict prescriptive norms could lead to <strong>significant compliance burden,<\/strong> and <strong>shift focus from innovation and research<\/strong>.\n<ul class=\"wp-block-list\">\n<li>As a result, the tech giants are calling for the current competition law to be strengthened rather than moving towards an ex ante framework.&nbsp;<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Broad Definition of Entities:<\/strong> Companies are also understood to be concerned about the broad definition \u2014 both quantitative and qualitative \u2014 of who a significant platform could be.\n<ul class=\"wp-block-list\">\n<li>Unlike EU\u2019s DMA which specifically names the \u2018gatekeeper\u2019 entities, that decision in India\u2019s draft law has been left to the <strong>discretion of the CCI.<\/strong>&nbsp;<\/li>\n\n\n\n<li>Companies believe that could lead to <strong>arbitrary decision making,<\/strong> which could potentially also impact start-ups.&nbsp;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-3af95778281045205d67cc0156a49698\" style=\"color:#ff6a00\"><strong>Conclusion<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ex-ante regimes tell businesses precisely how to behave, or what to do.&nbsp;<\/li>\n\n\n\n<li>Under the current ex-post regime of the Competition Act, companies are only required to ensure that their conduct in the market is not anti-competitive.&nbsp;<\/li>\n\n\n\n<li>An overlapping ex-ante regime proposed under the digital competition Bill will <strong>force tech companies to comply with parallel legislation and undertake measures for additional the scamsters a huge amount of money.&nbsp;<\/li>\n\n\n\n<li>The criminals, who often use pictures or identities of police personnel to convey authenticity, usually demand money from the target for a stringent thresholds for an accused.&nbsp;<\/li>\n\n\n\n<li>For one, the person has to prove in court that he or she is prima facie innocent of the offense.&nbsp;<\/li>\n\n\n\n<li>Secondly, the accused should be able to convince the judge he would not commit any offense while on bail.
