Sri Lanka is separated from India by a narrow channel of sea formed by the Palk Strait and the Gulf of Mannar, while Maldives Islands are situated to the south of the Lakshadweep Islands.<\/li>\n\n\n\n<li>All states except Madhya Pradesh, Chattisgarh, Jharkhand, Delhi and Haryana have an international border or a coast line.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-5daa885ea0a7732f516b76ece8bc8238\" style=\"color:#ff6a00\"><strong>Challenges&nbsp;<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Indian borders run through plains, hills and mountains, deserts, riverine territories and marshes.\n<ul class=\"wp-block-list\">\n<li>Land borders are not fully demarcated and Border guarding forces are often under resourced and ill equipped.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Institutional mechanisms for coordinating intelligence gathering, sharing and intelligence coordination are weak.<\/li>\n\n\n\n<li>Managing such a diverse border is <strong>a complex task<\/strong> but vital from the point of view of national security<\/li>\n\n\n\n<li>Several of India\u2019s neighbours are<strong> undergoing political and economic instability<\/strong>.&nbsp;<\/li>\n\n\n\n<li>India also has <strong>continuing border disputes <\/strong>with several of its neighbours.<\/li>\n\n\n\n<li>Uncertain borders not only raise bilateral tensions but also<strong> facilitate cross border infiltration, illegal migration, smuggling and crime<\/strong><\/li>\n\n\n\n<li>Human trafficking is a complex and rampant phenomenon\n<ul class=\"wp-block-list\">\n<li>Females including children are entangled in the vicious circle of forced labour, sexual brutality, and forced matrimony.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The <strong>Northeast receives drugs<\/strong>, arms and other contraband through the porous borders.&nbsp;<\/li>\n\n\n\n<li>The management of <strong>Coastal borders<\/strong> is a problem of a different scale altogether. The Mumbai terror attacks brought home the need to strengthen coastal surveillance.\n<ul class=\"wp-block-list\">\n<li>Sea routes are used to smuggle people, arms, drugs and other contraband.&nbsp;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-c2dba03fbb40518a44fb60836468385a\" style=\"color:#ff6a00\"><strong>Steps of Government&nbsp;<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>India has spent a lot of <strong>resources in building fences<\/strong> and <strong>associated infrastructure<\/strong> over the last three decades.\n<ul class=\"wp-block-list\">\n<li>&nbsp;It has also built the capabilities of border guarding forces to guard and manage the borders. This has had a positive impact on checking infiltrations, reducing smuggling, curbing contrabands etc.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>MHA has also professionalised the border guarding forces<\/strong> \u2013 BSF, ITBP, SSB, AR, Coast Guard.&nbsp;<\/li>\n\n\n\n<li>Several initiatives have been undertaken by the <strong>Border Management-I Division<\/strong>\n<ul class=\"wp-block-list\">\n<li>These include construction of fence, floodlighting, roads, Border Out Posts (BOPs), Company Operating Bases (COBs) and deployment of technological solutions along the India-Pakistan, India-Bangladesh, India-China, India-Nepal, India-Bhutan and India-Myanmar borders.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Border Infrastructure and Management (BIM) Schem<\/strong>e: Border Infrastructure and Management (BIM) Scheme is a <strong>Central Sector Scheme<\/strong> comprising projects aimed at infrastructure development of India\u2019s international borders to enhance the security along the borders of the country .<\/li>\n\n\n\n<li><strong>Comprehensive Integrated Border Management System<\/strong>: To improve situational awareness at different levels of hierarchy to facilitate prompt and quick response to emerging situations along the India-Pakistan Border (IPB) and India-Bangladesh Border (IBB), a Comprehensive Integrated Border Management System (CIBMS) has been conceptualized which is the integration of manpower, sensors, networks, intelligence and command control solutions.<\/li>\n\n\n\n<li>Government has decided to construct a fence along the entire1643-kilometre-long Indo-Myanmar border.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-7c6fbeda9b1f30069fc5c42bf8adae4b\" style=\"color:#ff6a00\"><strong>Suggestion&nbsp;<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>India is in the process of <strong>evolving a robust and balanced border management <\/strong>system that balances the cross border flows with national security interests.&nbsp;<\/li>\n\n\n\n<li>India has the vision of integrating South Asia into an economic whole.\n<ul class=\"wp-block-list\">\n<li><strong>SAARC, BIMSTEC and BBIN<\/strong> are efforts in that direction. This will require connectivity and relatively free movements.<\/li>\n\n\n\n<li>The challenge of border management is how to ensure that borders are secure and yet they are accessible.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The key to border management is to take <strong>people-centric approache<\/strong>s and make them partners in national security.\n<ul class=\"wp-block-list\">\n<li><strong>Good cooperation <\/strong>with the <strong>neighbours is also essential.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>We need to study and evolve good borer management practices.<\/li>\n\n\n\n<li>Further, we <strong>should harness space technologies<\/strong>, IT, and modern methods of infrastructure construction to ensure better border management.<\/li>\n\n\n\n<li><strong>Coastal police need to be strengthened.<\/strong> The problems of island territories require a special focus and approach<\/li>\n\n\n\n<li><strong>Border guarding party, <\/strong>including data custodians, third-party software vulnerabilities, and other direct or indirect supply chain issues.<\/li>\n\n\n\n<li>About <strong>68 percent<\/strong> of breaches, whether they include a third party or not, involve a <strong>non-malicious human element,<\/strong> which refers to a person making an error or falling prey to a social engineering Union of India<\/strong> the supreme court held that the right to vote (or the right to elect) is \u201cpure and simple, a statutory right\u201d.\n<ul class=\"wp-block-list\">\n<li>This means that voting is not a fundamental right and can be repealed.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The same was held for the right to be elected by the Bench, ruling that laws enacted by Parliament could regulate both these statutory rights.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-79192619635aeb5a9688c6631d6e79d5\" style=\"color:#ff6a00\"><strong>Bar against contesting elections&nbsp;<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Section 8 of the Representation of People Act, 1951 (RP Act)<\/strong> is titled \u201cDisqualification on conviction for certain offenses\u201d.&nbsp;<\/li>\n\n\n\n<li>If a person is convicted of any of the offenses in the exhaustive list provided in the provision, they will be disqualified from contesting elections to Parliament or state legislatures from the date of conviction onwards and face further a <strong>six-year disqualification<\/strong> from contesting in elections beginning from the date of their release.<\/li>\n\n\n\n<li>This disqualification only kicks in once a person has been convicted and does not apply if they have only been charged with criminal offenses.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-3a3fde3e2c8e34a5c4e8f99d6e263d61\" style=\"color:#ff6a00\"><strong>Exceptions to disqualification<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The Election Commission of India (ECI)<\/strong> is empowered under<strong> Section 11<\/strong> of the RP Act to <strong>\u201cremove\u201d or \u201creduce\u201d<\/strong> the period of disqualification.<\/li>\n\n\n\n<li>In 2019 the Supreme Court held that once a conviction is stayed \u201cthe disqualification which operates as a consequence of the conviction cannot take or remain in effect\u201d.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-625c83bf781c1e4717d42c1046597653\" style=\"color:#ff6a00\"><strong>Bar against the right to vote<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Section 62 <\/strong>of the RP Act provides a series of restrictions on the right to vote.\n<ul class=\"wp-block-list\">\n<li>Its <strong>sub-clause (5) <\/strong>which states in broad terms \u201cNo person shall vote at any election if he is confined in a prison, whether under a sentence of imprisonment or transportation or otherwise, or is in the lawful custody of the police\u201d.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>With an exception provided for those in preventive detention, this provision effectively bars every individual who had criminal charges framed against them from casting their vote unless they have been released on bail or have been acquitted.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-c27e5241496908b9e02d5f836bb7a591\" style=\"color:#ff6a00\"><strong>Anukul Chandra Pradhan, Advocate, Supreme Court v.
