{"id":22173,"date":"2024-02-29T17:30:55","date_gmt":"2024-02-29T12:00:55","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=22173"},"modified":"2024-03-01T10:17:21","modified_gmt":"2024-03-01T04:47:21","slug":"practice-of-fiscal-federalism-in-india","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/editorial-analysis\/29-02-2024\/practice-of-fiscal-federalism-in-india","title":{"rendered":"Practice of Fiscal Federalism in India"},"content":{"rendered":"\n<p><strong>Syllabus: GS 2\/Polity and Governance&nbsp;<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-0dab4a35479cb7a88ac0f778de143bb9\" style=\"color:#015aa7\"><strong>In Context<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The recent agitations by the governments of Kerala and Karnataka, and the support extended by several State governments, have highlighted many <strong>disquieting issues in the practice of fiscal federalism in India.&nbsp;<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-a4f155774128e785ce75fd796660e1cb\" style=\"color:#015aa7\"><strong>Fiscal Federalism in India<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The founding fathers of the Constitution provided that the Centre shall share its tax revenues with the states as well as provide grants from the Consolidated Fund as per a formula decided by the<strong> Finance Commission<\/strong> every five years.<\/li>\n\n\n\n<li>India has a<strong> three-tier federal tax system<\/strong>, with the powers of the Centre, states, and local bodies to collect taxes clearly demarcated.<\/li>\n\n\n\n<li>The<strong> Central government<\/strong> has the <strong>power to collect taxes <\/strong>on incomes of individuals and businesses, as well as indirect taxes such as the central goods and services tax, integrated goods and services tax, and customs.\n<ul class=\"wp-block-list\">\n<li>&nbsp;The Centre also collects surcharges and cesses on taxes.&nbsp;<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>States collect state GST<\/strong>, stamp duty, land revenue, state excise, and professional tax.<\/li>\n\n\n\n<li><strong>Local bodies <\/strong>collect property\/house tax, tolls, and taxes on utilities such as electricity and water.<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td><strong>Constitutional Provisions<\/strong><br><br>&#8211; <strong>&nbsp;<\/strong>The Constitution of India <strong>delineates tax bases<\/strong> between the <strong>Union and States <\/strong>listing them in the<strong> Union List<\/strong> and the<strong> State List <\/strong>respectively (as provided in the<strong> Seventh Schedule under Art 246).<\/strong>&nbsp;<br>a. There was\/is no taxation provision in the Concurrent List.&nbsp;<br>&#8211; However, when <strong>GST had to be introduced<\/strong>, it needed to be provided for a concurrent base for which <strong>Article 246A was inserted (as 101st Amendment in August 2016).&nbsp;<\/strong><br>a. This enabled the Union to make law for CGST (central GST) and IGST (integrated GST) and the States could legislate for SGST.&nbsp;<br>&#8211; <strong>Article 270 of the Constitution<\/strong> provides for the scheme of distribution of net tax proceeds collected by the Union government between the Centre and the States.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-87acf36a6b97b60c790b90eaeb4ea35f\" style=\"color:#015aa7\"><strong>Issues Highlights by States&nbsp;<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>There are complaints of increasing <strong>vertical<\/strong>(sharing of resources between the Union and States ) and horizontal inequalities in devolution.<\/li>\n\n\n\n<li>The <strong>Union government<\/strong> has sought to<strong> keep an increasing share <\/strong>of its <strong>proceeds out of the divisible pool <\/strong>so that they need not be shared with States.\n<ul class=\"wp-block-list\">\n<li>It has also not been devolving the shares of net proceeds to the States as mandated by successive FCs.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Several cesses and surcharges<\/strong> like Agriculture Infrastructure and Development Cess&nbsp; were introduced by the Union government.<\/li>\n<\/ul>\n\n\n\n<p><img loading=\"lazy\" decoding=\"async\" width=\"279\" height=\"242\" src=\"https:\/\/lh7-us.googleusercontent.com\/OcjnMBWDzPCuxE_IUeedX51uVGZvy73Q-YYpvDUIxYOQvYWBo3kU8OvcBnL-ppLBcaD0XybKBFYYWWpxayxtJqrvuf56kyogFCp_tWJnvN09I-gvNUP9R_CkGhdGIK-sa5AVWEC-RoBEGAt-A5BqftA\"><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The expansion of cesses and surcharges have led to the exclusion of an increasing share of the gross tax revenue from net proceeds.&nbsp;<\/li>\n\n\n\n<li>Between<strong> 2009-10 and 2023-24, <\/strong>a cumulative total of \u20b936.6 lakh crore was collected by the Union government as cesses and surcharges.&nbsp;<\/li>\n\n\n\n<li>This amount was not shared with States and was used solely by the Union government.<\/li>\n\n\n\n<li>Cesses and surcharges have also been subjected to critical scrutiny by the CAG.&nbsp;<\/li>\n\n\n\n<li>&nbsp;the <strong>State governments are forced to contribute <\/strong>significantly larger amounts to run the schemes meaningfully.<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td><strong>Do you know ?<\/strong><br><br>&#8211; The <strong>net divisible pool, or net proceeds,<\/strong> is that part of the gross tax revenue from which a share would have to be <strong>vertically devolved by the Union to all States.&nbsp;<\/strong><br>&#8211; Annual estimates of net proceeds can be obtained by <strong>deducting cesses, surcharges, <\/strong>and c<strong>osts of collection of taxes<\/strong> from the gross tax revenue.&nbsp;<br>a. Such shares are assigned by each FC for a five-year period.&nbsp;<br>b.
