has-link-color wp-elements-79179021333f42938579a7ab1cebea93\" style=\"color:#ff6a00\"><strong>Context:<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Recently, the Union Home Minister informed that the government has adopted <strong>an offensive strategy<\/strong> to curb the Leftwing Extremism.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-b2b0e5a33f8a02bd87f5243f8e5deed2\" style=\"color:#ff6a00\"><strong>About the Leftwing Extremism (also known as Naxalism):<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It originated <strong>in 1967<\/strong> from an <strong>uprising movement<\/strong>, led by the Communist Party of India (Marxist), in the <strong>Naxalbari area of West Bengal<\/strong>.<\/li>\n\n\n\n<li>The followers of this movement, <strong>often referred to as \u2018Naxals\u2019<\/strong>, believe in the political theory derived from the teachings of Chinese political leader Mao Zedong.<\/li>\n\n\n\n<li>The <strong>LWE movement<\/strong> has affected <strong>several states in India<\/strong>, including Chhattisgarh, Jharkhand, Odisha, Bihar, West Bengal, Andhra Pradesh, Telangana, Maharashtra, Madhya Pradesh, and Kerala.\n<ul class=\"wp-block-list\">\n<li>The intensity of the problem varies across these states.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-d1f133bba3148dc3c582902691f375d0\" style=\"color:#ff6a00\"><strong>Challenges associated with the LWE in India<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Socio-Economic Issues:<\/strong> Unemployment, poverty, land disputes, displacement, distress migration, improper communication, and food insecurity are some of the socio-economic problems prevalent in the areas affected by LWE.<\/li>\n\n\n\n<li><strong>Security Threats<\/strong>: LWE poses a significant security threat, leading to violence and loss of lives.\n<ul class=\"wp-block-list\">\n<li>In 2022, for the first time in four decades, the number of deaths of civilians and security forces was under 100.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Hindrance to Development:<\/strong> LWE groups often oppose development initiatives such as the construction of roads and installation of mobile towers, thereby hindering the overall development of the affected areas.<\/li>\n\n\n\n<li><strong>Legal and Institutional Challenges:<\/strong> The government faces challenges in implementing legal and institutional measures to combat LWE.\n<ul class=\"wp-block-list\">\n<li>For instance, the <strong>National Investigation Agency (NIA) and the Enforcement Directorate (ED)<\/strong> are working closely with state agencies to attack the financing of Left Wing Extremism.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Ideological Challenges:<\/strong> The ideology of LWE groups, which involves the use of violence as a means to capture State power, is against the country\u2019s development and bright future.\n<ul class=\"wp-block-list\">\n<li>This has resulted in a spiralling cycle of violence in some parts of India.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-7df4d78168806b8ca185eae212262f07\" style=\"color:#ff6a00\"><strong>Government\u2019s Response<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Legal and Institutional Framework:<\/strong> The government has strengthened the legal and institutional framework to combat extremism by amending The <strong>Unlawful Activities (Prevention) Amendment Act, 1967, National Investigation Agency Act 2008,<\/strong> etc.<img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/lh7-us.googleusercontent.com\/c0VeSBk8bBIfCR-lbb-CbkwWwdaqpBvSsVWc2lTOVbcfeXMxiXTQfAu7YOlEvLhoKVkfY_SLUJmGBDCKPZEWSFBM6ooaHsrB7a4dqh_a6wjdDBqn9NID7UwshZpr2SB4g-_pSziImMX8JIh1YLSPbm0\" width=\"311\" height=\"195\"><\/li>\n\n\n\n<li><strong>National Policy and Action Plan (2015):<\/strong> It envisages a multi-pronged strategy involving security-related measures, development interventions, ensuring rights and entitlements of local communities.<\/li>\n\n\n\n<li><strong>Security Measures:<\/strong> The Central Government assists the LWE affected State Governments by providing Central Armed Police Forces battalions, training, funds for modernization of State police forces, equipment &amp; arms, sharing of intelligence, construction of Fortified Police Stations.<\/li>\n\n\n\n<li><strong>Development Initiatives:<\/strong> Initiatives with special thrust on expansion of road network, improving telecommunication connectivity, skilling and financial inclusion.\n<ul class=\"wp-block-list\">\n<li><strong>Road Network:<\/strong> In the last 08 years, 9356 km of roads have been constructed at a cost of 710718 crores under two specific schemes for LWE affected areas.<\/li>\n\n\n\n<li><strong>Connectivity:<\/strong> To improve telecom connectivity, 2,343 mobile towers are installed in phase-I of the <strong>Mobile Tower Project,<\/strong> which are being upgraded to 4G.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Financial Inclusion:<\/strong> For financial inclusion of the local populace in these areas 1,258 Bank Branches, 1,348 ATMs and 22,202 Banking Correspondents in 30 Most LWE Affected Districts and 4,903 new Post Offices in 90 districts have been made functional during the last eight years.\n<ul class=\"wp-block-list\">\n<li><strong>The Security Related Expenditure (SRE) Scheme, and Special Infrastructure Scheme (SIS):<\/strong> 71285 crore released to Left Wing Extremism affected states in the last 4 years under the SRE scheme.\n<ul class=\"wp-block-list\">\n<li>Funds released under SRE increased approximately 124% during the last 9 years.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Assistance to Central Agencies for LWE Management Scheme (ACALWEMS):<\/strong> Rs 73 crore made available for camp infrastructure and 712.06 crore for upgradation of six hospitals during the last 4 years.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Skill Development:<\/strong> For skill development, under <strong>Kaushal Vikas Yojana<\/strong>, 43 ITIs and 38 Skill Development Centres (SDCs) have been made functional in LWE affected districts.<\/li>\n\n\n\n<li><strong>Quality Education:<\/strong> For quality education in tribal blocks of LWE affected districts 245 <strong>Eklavya Model Residential Schools<\/strong> have been sanctioned in 90 LWE affected districts, of which 121 are functional.<\/li>\n\n\n\n<li><strong>Tribal Youth Exchange Program: <\/strong>Under it, 22,000 youths have been taken on tour to large and developed areas of the country with an expenditure of 26.5 crores till date.\n<ul class=\"wp-block-list\">\n<li>Its objective is to make these youths aware of technological\/industrial advancement so that they can be freed from the influence of left wing extremism.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Intelligence Collection and Sharing:<\/strong> Actionable intelligence collection and sharing mechanisms need to be strengthened3. The state police need to be modernised to be able to tackle the Naxal attacks.<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td><strong>The Outcome:<\/strong><br><br>&#8211; According to the<strong> data of the Ministry of Home Affairs<\/strong>, LWE related violence has declined by 52% and the number of deaths by 69% from 6035 to 1868 in the decade 2014-23 compared to 2004-14.<br>a. Similarly, the incidents of leftist extremism have reduced from 14,862 to 7,128.<br>&#8211; The number of deaths of security forces due to Left Wing Extremism has declined by 72% from 1750 in 2004-14 to 485 during 2014-23 and the number of civilian deaths has declined by 68% from 4285 to 1383.<br>a. It means that persons with criminal backgrounds contest in the election and get selected as a member of parliament or state legislature.<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td><strong>Key Findings of ADR<\/strong><br><br>&#8211; <strong>Rajya Sabha Candidates:<\/strong> About 36% of Rajya Sabha candidates have declared criminal cases against themselves while the average assets of candidates analysed stood at \u20b9127.81 crore.<br>&#8211; <strong>Electoral Bonds:<\/strong> The Supreme Court held that the <strong>Electoral Bonds Scheme <\/strong>was unconstitutional for violating the right to information of voters.<br>&#8211; <strong>Registered Unrecognised Political Parties:<\/strong> According to a report by ADR, the number of registered unrecognised political parties has increased two-fold from 2010 to 2019.<br>&#8211; <strong>Election Commissioners Appointment:<\/strong> ADR argues that the present practice of appointment of Election Commissioners by the Centre is <strong>violative of <em>Articles 14 and Article 324 (2)<\/em> <\/strong>and the<strong> basic features of the Constitution<\/strong>.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-3b33712098f46e27a055dc32689a48ba\" style=\"color:#ff6a00\"><strong>Major Reasons<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Criminalization of political parties is a result of the connection between criminals and politicians and vote-bank politics.<\/li>\n\n\n\n<li>Lack of enforcement of laws and judgments.<\/li>\n\n\n\n<li>lack of ethics, and values, and loopholes in the function of the election commission.<\/li>\n\n\n\n<li>It is also linked to political control of state machinery and corruption.<\/li>\n\n\n\n<li>The political system is unwilling to change the law or the system.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-c6cb6dab755d342ebad3ea650e086fe8\" style=\"color:#ff6a00\"><strong>Issues of Criminalization of Politics<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Question of safety &amp; security:<\/strong> The main purpose of governance is to provide safety and security to citizens who elect their representatives for this role.\n<ul class=\"wp-block-list\">\n<li>But if the elected members themselves have criminal records, would they be interested in a criminal justice system that is prompt and efficient?<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Low conviction rate:<\/strong> As per the <strong>National Crime Records Bureau\u2019s 2021 report,<\/strong> only 10,416 cases of murder were disposed of during the year with just a 42.4% conviction rate.\n<ul class=\"wp-block-list\">\n<li>The Law minister has admitted to more than 4.7 crore cases pending in various courts.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Situation in police stations: <\/strong>Politicians play a very powerful role at police stations, compromising both integrity and impartiality of field staff.\n<ul class=\"wp-block-list\">\n<li>In due course, ordinary criminals graduate to be dreaded ones and form gangs extorting money, grabbing land, threatening witnesses in criminal cases, etc.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-3210a27bf29c8226f21d499297527403\" style=\"color:#ff6a00\"><strong>Measures to Curb Criminalisation<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The<strong> Vohra Committee<\/strong> set up by the Centre in 1993 sounded a note of warning saying that \u201csome political leaders become the leaders of these groups and, over the years, get themselves elected to local bodies, state assemblies, and the national Parliament.<\/li>\n\n\n\n<li><strong>Law Commission\u2019s 179th report:<\/strong> It recommended an amendment to the Representation of People Act 1951, and suggested the people with criminal backgrounds should be disqualified for five years or until acquittal.\n<ul class=\"wp-block-list\">\n<li>It also recommended that the person who wants to contest the election must furnish details regarding any pending case, with the copy of the FIR\/complaint, and also furnish details of all assets.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-9b7ab133ca3353cf4e0bbe44d8ad750f\" style=\"color:#ff6a00\"><strong>Related Supreme Court Judgement<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>In 2002: <\/strong>Every candidate contesting election <strong>had to declare his criminal and financial records<\/strong> along with educational qualifications.<\/li>\n\n\n\n<li><strong>In 2005: <\/strong>A sitting MP or MLA will be <strong>disqualified<\/strong> from contesting the election <strong>if convicted and sentenced to imprisonment for two years or more<\/strong> by a court of law.<\/li>\n\n\n\n<li><strong>In 2014: <\/strong>The Supreme Court <strong>accepted the Law Commission recommendations<\/strong> and passed an order directing that trials against sitting MPs and MLAs should be concluded within a year of charges being framed and conducted on a day-to-day basis.\n<ul class=\"wp-block-list\">\n<li>As a follow-up to these directives, in 2017, the government started a <strong>scheme to establish 12 special courts<\/strong> for a year to <strong>fast-track <\/strong>the trial of criminal cases against MPs and MLAs.&nbsp;<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>In 2021:<\/strong> The <strong>political parties<\/strong> need to upload on their websites and social media platforms the <strong>details of pending criminal cases<\/strong> against their candidates and the reasons for selecting them as also for not giving tickets to those without criminal antecedents.<\/li>\n\n\n\n<li><strong>Recently,<\/strong> the Supreme Court published <strong>some necessary mandates<\/strong> to avert the criminalisation of politics as many lawsuits have been withdrawn against MPs and MLAs in the past.<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td><strong>Association for Democratic Reforms (ADR)<\/strong><br><br>&#8211; It is an <strong>apolitical and non-partisan non-profit organisation<\/strong> in India that was <strong>established in 1999<\/strong> by a group of professors from the Indian Institute of Management (IIM) Ahmedabad.<br>&#8211; It focuses on <strong>corruption and criminalization<\/strong> in the political process, empowerment of the electorate through greater dissemination of information relating to the candidates and the parties etc.<br>&#8211; It has published numerous reports on the criminal backgrounds, financial details, and other relevant information of candidates contesting in various elections.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-41e2937e6673fa67110144148605b78c\" style=\"color:#ff6a00\"><strong>Conclusion and Way Forward<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The criminalisation of politics in India is a grave issue that needs immediate attention.
