{"id":20373,"date":"2024-01-09T19:56:54","date_gmt":"2024-01-09T14:26:54","guid":{"rendered":"https:\/\/www.nextias.com\/ca\/?p=20373"},"modified":"2024-01-10T18:39:31","modified_gmt":"2024-01-10T13:09:31","slug":"daily-current-affairs-09-01-2024","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/09-01-2024\/daily-current-affairs-09-01-2024","title":{"rendered":"Daily Current Affairs 09-01-2024"},"content":{"rendered":"\n<h2 class=\"wp-block-heading has-text-align-center\"><strong><span style=\"text-decoration: underline;\">Bharatiya Nyay Sanhita for Hit-and-Run Cases<\/span><\/strong><\/h2>\n\n\n\n<p><strong>Syllabus :GS 2\/Governance\/3\/Infrastructure<\/strong><\/p>\n\n\n\n<p><strong><span style=\"text-decoration: underline;\">In Context<\/span><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Transporters and commercial drivers from States like Maharashtra, Chhattisgarh, West Bengal, and Punjab have staged protests against the <strong>recent legislation concerning hit-and-run incidents.<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong><span style=\"text-decoration: underline;\">About the law<\/span><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Section 106 (2) of the <strong>Bharatiya Nyay Sanhita, 2023 (BNS) <\/strong>stipulates a penalty of up to<strong> 10 years in jai<\/strong>l and a <strong>fine \u20b97 lakh for fleeing an accident spot<\/strong> and failing to report the incident to a police officer or a magistrate.&nbsp;<\/li>\n\n\n\n<li>This law is in addition to the colonial-era provision on <strong>causing death <\/strong>due to rash or negligent acts under <strong>Section 304A of the Indian Penal Code, 1860.<\/strong>&nbsp;<\/li>\n<\/ul>\n\n\n\n<p><strong><span style=\"text-decoration: underline;\">Need for the law&nbsp;<\/span><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The new law comes in the backdrop of concerning figures related to road accidents in India.\n<ul class=\"wp-block-list\">\n<li>In 2022, India <strong>registered the highest count of road crash<\/strong> fatalities, exceeding 1.68 lakh deaths.&nbsp;<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>It aims to <strong>deter drivers<\/strong> from<strong> engaging in rash and negligent<\/strong> driving that may lead to death.&nbsp;<\/li>\n\n\n\n<li>The intent is to<strong> punish an offender<\/strong> in the event that they attempt to escape the law after causing death due to rash and negligent driving.&nbsp;<\/li>\n\n\n\n<li>The law creates a <strong>positive obligation <\/strong>on part of the<strong> offender to report such an incident to the police or magistrate.&nbsp;<\/strong><\/li>\n\n\n\n<li>They are also provisions to criminalise the omission in the performance of such a duty.&nbsp;<\/li>\n\n\n\n<li>The imposition of this legal duty clearly arises from <strong>a legislative intent to enforce moral responsibility <\/strong>on the part of the offender towards the victim of a road accident.&nbsp;<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#fff2cc\"><tbody><tr><td><span style=\"text-decoration: underline;\"><strong>Data Analysis&nbsp;<\/strong><br><\/span>&#8211; The <strong>National Crime Records Bureau<\/strong> recorded 47,806 hit and run incidents which resulted in the deaths of 50,815 people in 2022.&nbsp;<br>&#8211; Despite a <strong>5% global decrease in road crash deaths, <\/strong>India witnessed a year-on-year increase of 12% in road accidents and 9.4% in fatalities in the same year.&nbsp;<br>&#8211; With only 1% of the world\u2019s vehicles, India accounts for about 10% of crash-related deaths and incurs an <strong>economic loss of 5-7% of its GDP annually due to road crashes.<\/strong><\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p><strong><span style=\"text-decoration: underline;\">Reasons for Protest&nbsp;<\/span><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Transporters have raised concerns that the <strong>offence provides for stringent<\/strong> <strong>punishment <\/strong>even where the accidents are unintentional.&nbsp;<\/li>\n\n\n\n<li>They say that the penalty<strong> is excessive<\/strong> and that it fails to consider their challenging work conditions, including long driving hours and difficult roads.<\/li>\n\n\n\n<li>They argue that accidents may be caused by factors beyond the driver\u2019s control, such as poor visibility due to fog.&nbsp;<\/li>\n\n\n\n<li>The punishment provided by the law is <strong>disproportionate and does not align<\/strong> with the<strong> realities of road transport<\/strong> and the nature of accidents.&nbsp;<\/li>\n\n\n\n<li>The drivers are also concerned that the<strong> law may be abused by law enforcement<\/strong> <strong>agencies <\/strong>to their detriment.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p><strong><span style=\"text-decoration: underline;\">Suggestion and Conclusion&nbsp;<\/span><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The way forward is to revisit and reconcile clauses so that more than 35 lakh truck drivers in the country are not treated unfairly, apart from individual vehicle drivers.&nbsp;<\/li>\n\n\n\n<li>For instance, an exception has been made under 106 (1) of the BNS for doctors in the event of rash or negligent acts, where the punishment will be up to two years with a fine.\n<ul class=\"wp-block-list\">\n<li>This limited categorisation is problematic and is against the principles of equality, as the liability of a wide variety of people working in other sectors also needs to be moderated.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>In order to provide a graded liability and commensurate punishment, the acts of rash driving and negligent driving must be separated and placed under different degrees of liability so that all incidents of this nature are not bracketed into one, causing prejudice to the actors.<\/li>\n\n\n\n<li>The road accidents resulting in minor injuries ought not to be equated with criminal acts.\n<ul class=\"wp-block-list\">\n<li>Here measures like community service or revoking of driving licences or mandatory driving retests etc. could be the ways to criminalise.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>Source:<a href=\"https:\/\/www.thehindu.com\/news\/national\/debating-indias-new-hit-and-run-law-explained\/article67720776.ece#:~:text=Section%20161%20of%20the%20Motor,not%20recoverable%20from%20the%20drivers.\" rel=\"nofollow noopener\" target=\"_blank\">TH<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\"><strong><span style=\"text-decoration: underline;\">Self Pollination in Parisian Pansies<\/span><\/strong><\/h2>\n\n\n\n<p><strong>Syllabus: GS3\/Environment<\/strong><\/p>\n\n\n\n<p><strong><span style=\"text-decoration: underline;\">In News<\/span><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>As per a recent study, <strong>Pansy Plants (Viola arvensis) <\/strong>growing near Paris have evolved themselves to produce<strong> <\/strong>less nectar, showing<strong> signs of self-pollination instead of depending on Pollinators.&nbsp;<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong><span style=\"text-decoration: underline;\">What is Pollination?<\/span><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pollination is the act of transferring pollen grains from the male anther (reproductive organ) of a flower to the female stigma (reproductive organ).<\/li>\n\n\n\n<li><strong>Plants can be:<\/strong>\n<ul class=\"wp-block-list\">\n<li><strong>Self-pollinating <\/strong>&#8211; personnel, and facility\/environment, etc.&nbsp;<\/li>\n\n\n\n<li>GMP was first incorporated in Schedule M of the Drugs and Cosmetics Rules, 1945 in <strong>1988<\/strong> and the last amendment was made in<strong> 2005.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>With the amendment, the words \u2018Good Manufacturing Practices\u2019 (GMP) has been replaced with <strong>\u2018Good Manufacturing Practices and Requirements of Premises, Plant and Equipment for Pharmaceutical Products\u2019<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p><strong><span style=\"text-decoration: underline;\">Need for Revising the Guidelines<\/span><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The move comes in the wake of <strong>overseas deaths<\/strong> linked to Indian-made drugs since 2022, prompting increased scrutiny of the pharmaceutical industry.<\/li>\n\n\n\n<li><strong>To keep pace with fast-changing manufacturing and quality domain<\/strong>, there was a necessity to revise the principles of GMP mentioned in current Schedule M.&nbsp;<\/li>\n\n\n\n<li>It brings GMP recommendations<strong> at par with global standards,<\/strong> especially to those of World Health Organization (WHO), and ensures production of globally <strong>acceptable quality of drug.<\/strong><\/li>\n\n\n\n<li>This will elevate the quality standards of medicines, reinforcing the <strong>reputation of industry and improving patient outcomes<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p><strong><span style=\"text-decoration: underline;\">Guidelines<\/span><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Implementation: <\/strong>Large companies, which have a turnover of <strong>more than Rs 250 crore<\/strong>, will have to implement the guidelines <strong>within the next six months.&nbsp;<\/strong>\n<ul class=\"wp-block-list\">\n<li>Small and medium manufacturers, which have a turnover of <strong>less than Rs 250 crore, will get a year<\/strong>.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Data Security: <\/strong>Companies should have GMP-related computerised systems, which ensure that there is no tampering of data related to the processes.<\/li>\n\n\n\n<li><strong>Testing and Final Product:<\/strong> Companies <strong>must <\/strong>market a finished product only after getting <strong>\u201csatisfactory results\u201d <\/strong>on tests of the ingredients and retain a sufficient quantity of the samples to allow repeated testing or verification of a batch.<\/li>\n\n\n\n<li><strong>Addition of Products: <\/strong>It has <strong>five new categories of drugs<\/strong> containing hazardous substances such as sex hormones, steroids (anabolic and androgenic), cytotoxic substances, biological products and radiopharmaceuticals.<\/li>\n\n\n\n<li><strong>Quality Risk Management:<\/strong> There must be a comprehensively designed and correctly implemented pharmaceutical quality system incorporating GMP and Quality Risk Management (QRM).<\/li>\n\n\n\n<li>It introduced the <strong>product quality review (PQR)<\/strong> by the senior management of the companies The Indian pharmaceutical industry has played a key role in driving better health outcomes across the world by being a large and reliable supplier of affordable and high-quality generics drugs.<br>b. The vaccine industry in India has proven its capacity for manufacturing at scale, catering to more than <strong>60% of global vaccine demand.&nbsp;<\/strong><br>c.
