{"id":18990,"date":"2023-11-24T22:11:13","date_gmt":"2023-11-24T16:41:13","guid":{"rendered":"https:\/\/www.nextias.com\/current_affairs\/?p=18990"},"modified":"2023-12-18T12:17:03","modified_gmt":"2023-12-18T06:47:03","slug":"daily-current-affairs-24-11-2023","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/24-11-2023\/daily-current-affairs-24-11-2023","title":{"rendered":"Daily Current Affairs 24-11-2023"},"content":{"rendered":"\n<h2 class=\"wp-block-heading has-text-align-center\"><span style=\"text-decoration: underline;\">SC Calls to Bring Children into the Adoption Pool<\/span><\/h2>\n\n\n\n<p><strong>Syllabus: GS1\/ Social Justice<\/strong><\/p>\n\n\n\n<p><strong>In News<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court of India recently called for collaborative efforts to bring children into the adoption pool.<\/li>\n<\/ul>\n\n\n\n<p><strong>More about the news<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>CARA findings:<\/strong>\n<ul class=\"wp-block-list\">\n<li>According to a recent finding by the <strong>Central Adoption Resource Authority (CARA), <\/strong>many children were living in CCIs for over a year with undetermined legal status.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Supreme Court\u2019s directives:<\/strong>\n<ul class=\"wp-block-list\">\n<li>The Supreme Court said that children living in<strong> child care institutions (CCI)<\/strong>, whose parents have <strong>not visited<\/strong> them for over a year or have <strong>\u201cunfit\u201d parents<\/strong> or guardians, should be identified and brought into the adoption pool.<\/li>\n\n\n\n<li>The court has ordered <strong>States and Union Territories <\/strong>to begin a<strong> bi-monthly drive<\/strong> to identify children in the <strong>orphaned, abandoned, surrendered (OAS) category<\/strong> in institutions.<\/li>\n\n\n\n<li>It is imperative for the States to ensure registration of all OAS children in the district on the<strong> Child Adoption Resource Information and Guidance System (CARINGS) portal.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Defining an \u201cunfit guardian\u201d:<\/strong>\n<ul class=\"wp-block-list\">\n<li>The court defined an \u201cunfit guardian\u201d as someone who is \u201cunable or unwilling for parenting, indulging in substance (drug) abuse, abuse or alcohol, known to have abused or neglected the child, having a criminal record, in need of care themselves, mentally unsound, etc\u201d.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td><span style=\"text-decoration: underline;\"><strong>Journey of Child Adoption in India<\/strong><br><\/span><strong>&#8211; About:&nbsp;<\/strong><br>A. The journey of orphaned or abandoned children, from the day they are found to the day they are placed in an adoptive home, is a long and rigorous one.&nbsp;<br><strong>&#8211;<\/strong> <strong>\u201cLegally free\u201d for adoption:<\/strong><br>A. First, they must be brought before the district child welfare committee and placed in a CCI under the Juvenile Justice Act of 2015.&nbsp;<br>B. An effort is then made to track their immediate or extended families and reunite them; if this fails, the child welfare committee, a quasi judicial body, has to deem the child legally free for adoption.<br>&#8211;&nbsp;<strong>Linking with adoption agencies &amp; adoption:<\/strong><br>A. The district child protection unit links them to an adoption agency and the child is registered with CARA.&nbsp;<br>B. A medical report is prepared and the child is then matched with a prospective parent after a home study is undertaken by CARA authorities.<br>&#8211; <strong>CARA\u2019s tabulation<\/strong> indicates that&nbsp;69.4% of registered PAPs opt for children in the age group of zero to two years;&nbsp;10.3% in the age group of two to four years; and&nbsp;14.8% in the age group of four to six years.<br><span style=\"text-decoration: underline;\"><strong>Child Adoption Resource Information &amp; Guidance System (CARINGS)<\/strong><br><\/span>A. CARINGS is an online platform, building bridges and creating links through a robust web-based management system designed to bring transparency in the adoption system and also curtailing delays at various levels.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p><strong>Challenges<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Huge mismatch:<\/strong>\n<ul class=\"wp-block-list\">\n<li>According to CARA\u2019s online portal, the <strong>CARINGS<\/strong>, there is \u201chuge mismatch\u201d between children available for legal adoption and the number of prospective adoptive parents (PAP).&nbsp;<\/li>\n\n\n\n<li>A State-wise break-up of the figures provided by CARA showed that 2,146 children were available for adoption as on October 28, 2023.<\/li>\n\n\n\n<li>As opposed to this, about 30,669 PAPs have been registered for in-country adoption as of October 2023.&nbsp;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-image is-resized\"><img decoding=\"async\" src=\"https:\/\/lh7-us.googleusercontent.com\/6vBn6jD7BvNk8kLMXeeC39fUsv56HhXI4PR79HeIJ1TU056N9DazqQb6wZ5vPIick8XGaYjOUNOxfgfmiUJNwA9i_yuGZhT9MMK5dnPsFMd-VfN_QdKhXi6Q7x5xDh5JEEZiQu7GQkrSqOwMBlR-tOI\" alt=\"\" style=\"width:494px;height:auto\"\/><\/figure>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Delays:<\/strong>\n<ul class=\"wp-block-list\">\n<li>PAPs have to wait for between three to four years for getting \u2018a healthy and young child\u2019 due to the huge mismatch in the number of registered PAPs and children available for adoption.<\/li>\n\n\n\n<li>Adding to these reasons for delay in the adoption process is the fact that PAPs \u201cprefer\u201d children up to the age of two for adoption.&nbsp;<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Dearth of Specialised Adoption Agencies:<\/strong>\n<ul class=\"wp-block-list\">\n<li>Also, out of 760 districts in the country, only 390 districts have Specialised Adoption Agencies.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Role of pandemic:<\/strong>\n<ul class=\"wp-block-list\">\n<li>According to critics, these delays are systemic. The pandemic has only made the wait time longer because the process is held up at every step.&nbsp;<\/li>\n\n\n\n<li>Medical reports could not be prepared because of the dearth of doctors, parents could not travel to meet the child, home surveys could not happen.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Lack of regulation &amp; communication:<\/strong>\n<ul class=\"wp-block-list\">\n<li>Many CCIs are not regulated by the State and are not linked to adoption agencies, and so the children in these institutes are invisible to the adoption pool.<\/li>\n\n\n\n<li>Even if they are linked to agencies, the paperwork is not completed, sometimes for years, and so the child is not declared legally free for adoption.<\/li>\n\n\n\n<li>PAPs also criticise the complete lack of communication from CARA.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Lack of \u2018desirable\u2019 children<\/strong>:\n<ul class=\"wp-block-list\">\n<li>Even within the small pool of children available for adoption, there are three categories who often do not find a home in India: older children, siblings, and those with disabilities.\n<ul class=\"wp-block-list\">\n<li>Whereas, foreign adoptive parents are more favourable to children in these categories.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>It isn\u2019t easy for parents to adopt an older child or a child with special needs, and there is a lot of preparation needed.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p><strong>Way ahead<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>India has traditionally been resistant to the idea of adoption. Social issues of caste, class and genetics have held major sway, with families and communities looking askance at the idea of adopting a child whose parentage is unknown.&nbsp;<\/li>\n\n\n\n<li>Given this history, the fact that there is a waiting list of prospective adoptive parents is a sea change.<\/li>\n\n\n\n<li>The surge in the number of prospective adoptive parents essentially means that people understand and appreciate adoption.<\/li>\n<\/ul>\n\n\n\n<p>Source: TH<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\"><span style=\"text-decoration: underline;\">Governor Veto Power Over Bills<\/span><\/h2>\n\n\n\n<p><strong>Syllabus:GS2\/Polity<\/strong><\/p>\n\n\n\n<p><strong>News<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court expressed \u2018serious concern\u2019 over inaction by the Governor on Bills presented for his assent.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p><strong>Supreme Court Judgement<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Supreme Court has laid down the law that a <strong>Governor, in case he withholds assent, should send back a Bill forwarded to him by a State Legislature \u201cas soon as possible\u201d<\/strong> with a message to reconsider the proposed law.<\/li>\n\n\n\n<li>In case, the State Assembly reiterates the Bill \u201cwith or without amendments\u201d, the Governor has no choice or discretion, and has to give his assent to it.<\/li>\n\n\n\n<li>The court held that a Governor who chooses to withhold a Bill without doing anything further would be acting in contravention of the Constitution.<\/li>\n<\/ul>\n\n\n\n<p><strong>Governor\u2019s power with respect to the Bills<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 200<\/strong> of the Constitution lays down that when a Bill, passed by a State Legislature, is presented to the Governor for their assent, they have four alternatives \u2014\n<ul class=\"wp-block-list\">\n<li>may give assent to the Bill;&nbsp;<\/li>\n\n\n\n<li>may withhold assent to the Bill, that is, reject the Bill in which case the Bill fails to become law;&nbsp;<\/li>\n\n\n\n<li>may return the Bill (if it is not a Money Bill) for reconsideration of the State Legislature; or&nbsp;<\/li>\n\n\n\n<li>may reserve the Bill for the consideration of the President.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Article 163 <\/strong>of the Constitution says the Governor will normally be aided and advised by the Council of Ministers except in those functions which require his discretion.<\/li>\n<\/ul>\n\n\n\n<p><strong>The case of \u2018withholding assent<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The situation of \u2018withholding assent\u2019 may arise in case of a <strong>Private Members\u2019 Bill<\/strong> (any Member of State Legislature other than a Minister) passed by the State Legislature, which the council of ministers do not want to be enacted into a law.<\/li>\n\n\n\n<li>Also, if the incumbent government whose Bill has been passed by the legislature, falls or resigns before it is assented to by the Governor, the new council may advise the Governor to \u2018withhold assent\u2019.<\/li>\n<\/ul>\n\n\n\n<p><strong>When can Governor exercise the \u2018discretion\u2019?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Governor must reserve certain Bills, like those which&nbsp; will contravene the provisions of the Constitution or reduce the powers of the High Court, for the consideration of the President.&nbsp;<\/li>\n\n\n\n<li>They may also reserve Bills on concurrent lists that are repugnant to a Union law based on ministerial advice.&nbsp;<\/li>\n\n\n\n<li>It is only under rare circumstances that the Governor may exercise their discretion. The hole was caused by widespread use of chemicals called <strong>chlorofluorocarbons.<\/strong><\/li>\n\n\n\n<li><strong>Ozone Depletion: <\/strong>When chlorine and bromine atoms come into contact with ozone in the stratosphere, they destroy ozone molecules.
