What Is Greenwashing?<\/u><\/strong><\/span><\/span><\/span><\/p>\n

Greenwashing is the process of conveying a false impression or misleading information about how a company\u2019s products are environmentally sound.\u00a0<\/span><\/span><\/span><\/li>\n
Greenwashing involves making an unsubstantiated claim to deceive consumers into believing that a company\u2019s products are environmentally friendly or have a greater positive environmental impact than they actually do.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/div>\n
State of India\u2019s forest cover<\/u><\/strong><\/span><\/span><\/span><\/p>\n

India\u2019s forest cover has seen <\/span><\/span><\/span>only marginal increases<\/strong><\/span><\/span><\/span>, as biennial reports of the Forest Survey of India illustrate.\u00a0<\/span><\/span><\/span><\/li>\n
Growth in forest cover inside officially recorded forests is<\/span><\/span><\/span> stagnant, or at best incremental.<\/strong><\/span><\/span><\/span>\u00a0<\/span><\/span><\/span><\/li>\n
It is tree cover in orchards, plantations and village homesteads that has been on the rise and supplementing India\u2019s claim that 24% of its area is under forest and tree cover.\u00a0<\/span><\/span><\/span><\/li>\n
India has committed to increasing this number to 33% and adding a carbon sink of 2.5 billion to 3 billion tons of carbon dioxide this way, by 2030, as part of its international climate commitments.<\/span><\/span><\/span><\/li>\n<\/ul>\n
Legislations for the Forests in India<\/u><\/strong><\/span><\/span><\/span><\/p>\n

Apex Court\u2019s suspension order, 1996:<\/strong><\/span><\/span><\/span><\/span>\n

In 1996, the Supreme Court<\/span><\/span><\/span><\/span> suspended the felling of trees across the country<\/strong><\/span><\/span><\/span><\/span>, and ruled that the <\/span><\/span><\/span><\/span>FC Act would apply to all land parcels <\/strong><\/span><\/span><\/span><\/span>that were either recorded as \u2018forest\u2019 or resembled the dictionary meaning of forest.<\/span><\/span><\/span><\/span>\n

This sweeping order <\/span><\/span><\/span><\/span>helped check rampant deforestation on land<\/strong><\/span><\/span><\/span><\/span> not recorded as \u2018forest\u2019.\u00a0<\/span><\/span><\/span><\/span><\/li>\n
But the order also came in the way of <\/span><\/span><\/span><\/span>excluding from recorded forests vast areas <\/strong><\/span><\/span><\/span><\/span>that were already in use for agriculture or as homesteads.<\/span><\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n
Need for new legislations:<\/strong><\/span><\/span><\/span>\n

The existing <\/span><\/span><\/span>Forest (Conservation) Act, 1980<\/strong><\/span><\/span><\/span> \u2014 in the Environment Ministry\u2019s reckoning \u2014 was insufficient for these ends, as it<\/span><\/span><\/span> did not incentivise private agro-forestry and tree plantation activities<\/strong><\/span><\/span><\/span>.\u00a0<\/span><\/span><\/span>\n

From 2019 to 2021, India added 1,540 square kilometres of forest cover of which 1,509 sq. km was outside recorded forest area.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
The <\/span><\/span><\/span>new amendments to the Forest Act <\/strong><\/span><\/span><\/span>gave such incentives by clearly defining the limits of the 1996 judgment.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n
The Forest (Conservation) Amendment Bill, 2023<\/u><\/strong><\/span><\/span><\/span><\/span><\/p>\n

Restrictions on activities in forest:<\/strong><\/span><\/span><\/span><\/span>\u00a0<\/span><\/span><\/span><\/span>\n

The Act<\/span><\/span><\/span><\/span> restricts the de-reservation of forest<\/strong><\/span><\/span><\/span><\/span> or <\/span><\/span><\/span><\/span>use of forest land for non-forest purposes<\/strong><\/span><\/span><\/span><\/span>.\u00a0<\/span><\/span><\/span><\/span><\/li>\n
Such restrictions <\/span><\/span><\/span><\/span>may be lifted<\/strong><\/span><\/span><\/span><\/span> with the prior approval of the central government.\u00a0\u00a0<\/span><\/span><\/span><\/span>\n

Non-forest purposes<\/strong><\/span><\/span><\/span><\/span> include <\/span><\/span><\/span><\/span>use of land for cultivating horticultural crops<\/strong><\/span><\/span><\/span><\/span> or for <\/span><\/span><\/span><\/span>any purpose other than reafforestation<\/strong><\/span><\/span><\/span><\/span>.\u00a0\u00a0<\/span><\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n
Assigning of land through a lease or otherwise:\u00a0<\/strong><\/span><\/span><\/span><\/span>\n

Under the Act,<\/span><\/span><\/span><\/span> state government or any authority <\/strong><\/span><\/span><\/span><\/span>requires prior approval of the central government to direct the assigning of forest land<\/span><\/span><\/span><\/span> through a lease or otherwise to any organisation<\/strong><\/span><\/span><\/span><\/span> (such as private person, agency, authority, corporation) not owned by the government.<\/span><\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

Building forest carbon stock & improving livelihood:<\/strong><\/span><\/span><\/span><\/span>\n

The predominant idea of the proposed changes is <\/span><\/span><\/span><\/span>to build forest carbon stock <\/strong><\/span><\/span><\/span><\/span>by <\/span><\/span><\/span><\/span>raising plantations<\/strong><\/span><\/span><\/span><\/span>.\u00a0<\/span><\/span><\/span><\/span>\n

The Bill talks about keeping up with <\/span><\/span><\/span><\/span>\u201cdynamic changes in the ecological, strategic and economic aspirations of the country\u201d<\/strong><\/span><\/span><\/span><\/span> and <\/span><\/span><\/span><\/span>\u201cimprovement of livelihoods for forest-dependent communities.\u201d<\/strong><\/span><\/span><\/span><\/span>\u00a0<\/span><\/span><\/span><\/span><\/li>\n
The scope of the amendments boils down to <\/span><\/span><\/span><\/span>pushing plantations to achieve carbon neutrality<\/strong><\/span><\/span><\/span><\/span> by limiting the scope of the Act.<\/span><\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

The Bill also seeks to<\/span><\/span><\/span><\/span> make land available for developers<\/strong><\/span><\/span><\/span><\/span> to <\/span><\/span><\/span><\/span>meet their legal obligation <\/strong><\/span><\/span><\/span><\/span>towards <\/span><\/span><\/span><\/span>compensatory afforestation<\/strong><\/span><\/span><\/span><\/span> in lieu of <\/span><\/span><\/span><\/span>forest land diverted<\/strong><\/span><\/span><\/span><\/span> for <\/span><\/span><\/span><\/span>development projects<\/strong><\/span><\/span><\/span><\/span>.<\/span><\/span><\/span><\/span><\/li>\n
How?<\/strong><\/span><\/span><\/span><\/span>\n

If the scope of the FC Act is restricted, <\/span><\/span><\/span><\/span>fewer projects will be required to obtain forest clearance<\/strong><\/span><\/span><\/span><\/span>, which is<\/span><\/span><\/span><\/span> considered a \u2018hurdle\u2019 by most developers <\/strong><\/span><\/span><\/span><\/span>in and outside the government.\u00a0<\/span><\/span><\/span><\/span><\/li>\n
But it will also help developers secure forest clearance when they need it.<\/span><\/span><\/span><\/span><\/li>\n
A key condition for forest clearance is that <\/span><\/span><\/span><\/span>a developer must carry out compensatory afforestation<\/strong><\/span><\/span><\/span><\/span> on<\/span><\/span><\/span><\/span> equivalent non-forest land<\/strong><\/span><\/span><\/span><\/span> or, if non-forest land is not available, on degraded forest land twice the extent of the forest area diverted.\u00a0<\/span><\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

No contribution to \u201cregeneration\u2019 of Natural forests:<\/strong><\/span><\/span><\/span>\n

The amendments effectively mean <\/span><\/span><\/span>States can no longer classify<\/strong><\/span><\/span><\/span> unclassified forest land, or patches of trees with forest-like characteristics as \u2018forest land\u2019.\u00a0<\/span><\/span><\/span><\/li>\n
The amendments also allow forest land, up to 100 km near India\u2019s borders, to be appropriated, without central approval, for <\/span><\/span><\/span>\u201cstrategic and security\u201d purposes<\/strong><\/span><\/span><\/span>.\u00a0<\/span><\/span><\/span><\/li>\n
The primary criticism is that these amendments do not really contribute to regenerating natural forest, but rather<\/span><\/span><\/span> incentivise afforestation<\/strong><\/span><\/span><\/span> for <\/span><\/span><\/span>commercial ends<\/strong><\/span><\/span><\/span>.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
Issues of carbon stock:<\/strong><\/span><\/span><\/span>\n

Grooming private forests might look good in theory but expecting them to be a permanent carbon stock is wishful thinking given that strong market incentives exist to use them as \u2018carbon credits\u2019.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n

Any review of the FC Act is an opportunity to make suitable concessions for land that has<\/span><\/span><\/span><\/span> traditionally been under the control of indigenou<\/strong><\/span><\/span><\/span><\/span>s and <\/span><\/span><\/span><\/span>forest communities.<\/strong><\/span><\/span><\/span><\/span>\u00a0<\/span><\/span><\/span><\/span>\n

Even after the enactment of the <\/span><\/span><\/span><\/span>Forest Rights Act, 2006<\/strong><\/span><\/span><\/span><\/span>, the scope for their <\/span><\/span><\/span><\/span>consent has eroded incrementally<\/strong><\/span><\/span><\/span><\/span> when it came to the<\/span><\/span><\/span><\/span> diversion of forest land for development projects<\/strong><\/span><\/span><\/span><\/span>.\u00a0<\/span><\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n

Forests are<\/span><\/span><\/span><\/span> a lot more than a sum of trees<\/strong><\/span><\/span><\/span><\/span>. Unlike <\/span><\/span><\/span><\/span>man-made plantations, <\/strong><\/span><\/span><\/span><\/span>natural forests perform a range of ecosystem services that are <\/span><\/span><\/span><\/span>key to the survival and well-being of the millions of species<\/strong><\/span><\/span><\/span><\/span> that they support, and also provide direct livelihood and subsistence to crores of people.<\/span><\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

The recent <\/span><\/span><\/span><\/span>Intergovernmental Panel on Climate Change (IPCC) report <\/strong><\/span><\/span><\/span><\/span>also stated that not degrading existing ecosystems in the first place will do more to lower the impact of the climate crisis than restoring ecosystems that have been destroyed.<\/span><\/span><\/span><\/span><\/li>\n<\/ul>\n
