About TRAI<\/u><\/strong><\/span><\/span><\/span><\/p>\n

The entry of private service providers brought with it an independent regulation in the form of The Telecom Regulatory Authority of India (TRAI), which was established in 1997 by an Act of Parliament to regulate telecom services, including fixation\/revision of tariffs for telecom services which were earlier vested in the Central Government.<\/span><\/span><\/span><\/li>\n
TRAI’s mission is to create and nurture conditions for growth of telecommunications in the country in a manner and at a pace which will enable India to play a leading role in emerging global information society.<\/span><\/span><\/span><\/li>\n
One of the main objectives of TRAI is to provide a fair and transparent policy environment which promotes a level playing field and facilitates fair competition.<\/span><\/span><\/span><\/li>\n
The TRAI Act was amended by an ordinance, effective from 24 January 2000, establishing a <\/span><\/span><\/span>Telecommunications Dispute Settlement and Appellate Tribunal (TDSAT)<\/strong><\/span><\/span><\/span> to take over the adjudicatory and disputes functions from TRAI.\u00a0<\/span><\/span><\/span><\/li>\n
TDSAT was set up to adjudicate any dispute between a licensor and a licensee, between two or more service providers, between a service provider and a group of consumers, and to hear and dispose of appeals against any direction, decision or order of TRAI.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/div>\n
What are OTT Services?<\/u><\/strong><\/span><\/span><\/span><\/p>\n

OTT (Over-the-Top) refers to content providers that deliver media directly over the internet to users without the need for traditional cable or satellite TV services.\u00a0<\/span><\/span><\/span><\/li>\n
Streaming, on the other hand, is the overarching technology that is used to transmit data (audio, video, etc.) in real time over the internet. Essentially, OTT platforms utilize streaming technology to deliver their content to users.<\/span><\/span><\/span><\/li>\n<\/ul>\n
Why a regulation for OTT communication services?<\/u><\/strong><\/span><\/span><\/span><\/p>\n
\n
The TRAI has argued that while telecom operators and OTT platforms such as WhatsApp offer similar services, they are not bound by the same requirements \u2013 as a result, there is a need for regulatory parity.<\/span><\/span><\/span><\/li>\n
It said that telecom operators need a service licence for offering voice and SMS services, and on the other hand \u201cOTT communication service providers offer voice call, and messaging and video call services similar to the services provided by TSPs, without any such licence\u201d.<\/span><\/span><\/span><\/li>\n
Telecom service providers in India are regulated by several laws, including the Indian Telegraph Act, 1885, the Wireless Telegraphy Act, 1933 and the Telecom Regulatory Authority of India Act, 1997, and have to adhere to requirements such as lawful interception. Such requirements are not applicable to OTT services currently.<\/span><\/span><\/span><\/li>\n
It added that OTT services do not financially contribute towards increasing telecom services penetration in the country, unlike the operators who have to pay towards the Universal Service Obligation Fund (USOF).<\/span><\/span><\/span><\/li>\n<\/ul>\n
What is the key issue between telcos and OTT apps?<\/u><\/strong><\/span><\/span><\/span><\/p>\n

Apart from a different regulatory regime, there are other financial considerations. Key among them is the avenue of revenues that has shifted from voice and SMS to data.<\/span><\/span><\/span><\/li>\n
TRAI said that the contribution of data usage in the revenue from mobile subscribers has grown more than ten times from 8.10% in the quarter ending (QE) June 2013 to 85.1% in the QE December 2022.<\/span><\/span><\/span><\/li>\n
From the year 2014 to 2022, the volume of monthly wireless data usage in India grew by about 156 times from 92.4 million GB (December 2014) to 14.4 trillion GB (December 2022), TRAI said.\u00a0<\/span><\/span><\/span><\/li>\n
In the same period, the average revenue from data usage per wireless subscriber per month in the country increased by about 5.6 times from Rs. 22.19 (for GSM service in the quarter ending December 2014) to Rs. 125.05 (quarter ending December 2022).<\/span><\/span><\/span><\/li>\n<\/ul>\n
What did the draft telecom Bill prescribe for OTT services?<\/u><\/strong><\/span><\/span><\/span><\/p>\n

One of the key changes is the inclusion of new-age over-the-top communication services like WhatsApp, Signal and Telegram in the definition of telecommunication services.<\/span><\/span><\/span><\/li>\n
As per the draft law, providers of telecommunication services will be covered under the licensing regime, and will be subjected to similar rules as other telecom operators.\u00a0<\/span><\/span><\/span><\/li>\n
This issue has been under contention for several years now with telecom service providers seeking a level-playing field with OTT apps over communication services such as voice calls, messages, etc. where operators had to incur high costs of licences and spectrum, while OTT players rode on their infrastructure to offer free services.<\/span><\/span><\/span><\/li>\n<\/ul>\n

These forests have reached a stage of ecological maturity and exhibit a complex and diverse ecosystem with fully developed tree canopy layers, understory vegetation, and rich biodiversity.<\/span><\/span><\/span><\/span><\/li>\n<\/ul>\n

Primary forests are burned for short-term cultivation and then left fallow for regeneration of soil nutrients.\u00a0<\/span><\/span><\/span><\/span><\/li>\n

None <\/strong><\/span><\/span><\/span>of the districts were able to earn<\/span><\/span><\/span> Daksh and Utkarsh,<\/strong><\/span><\/span><\/span> in the latest report, <\/span><\/span><\/span>121 districts were graded as Ati-Uttam for 2020-21,<\/strong><\/span><\/span><\/span> though this number <\/span><\/span><\/span>fell by<\/strong><\/span><\/span><\/span> <\/span><\/span><\/span>more than half in 2021-22,<\/strong><\/span><\/span><\/span> with just 51 districts making the grade.\u00a0<\/span><\/span><\/span><\/li>\n
In 2021-22, <\/span><\/span><\/span>Chandigarh retained its Ati-Uttam status<\/strong><\/span><\/span><\/span>, as well as some districts of <\/span><\/span><\/span>Delhi and Gujarat.<\/strong><\/span><\/span><\/span> In Maharashtra, Satara, Kolhapur, Nashik and Mumbai achieved this status as did Kolkata.<\/span><\/span><\/span><\/li>\n
Uttar Pradesh has several districts under Uttam and Prachesta-1, and four under Prachesta-2.\u00a0<\/span><\/span><\/span><\/li>\n
South Salmara-Mankachar district was the only district in Assam under Akanshi-1 for 2021-22, grade) while the <\/span><\/span><\/span>two grades at the bottom had no districts.<\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n

As per the <\/span><\/span><\/span>Health Ministry<\/strong><\/span><\/span><\/span> <\/span><\/span><\/span>Ayushman Bharat-Health and Wellness Centres programme<\/strong><\/span><\/span><\/span> is undergoing its biggest ever expansion of services.<\/span><\/span><\/span><\/li>\n<\/ul>\n

Under the latest expansion spree, the Central government is adding <\/span><\/span><\/span>services, <\/strong><\/span><\/span><\/span>including screening, prevention, control & management of non-communicable diseases, care for common ophthalmic & ENT problems, basic oral health care, elderly and palliative health care services, emergency medical services, and screening and management of mental health ailments.<\/span><\/span><\/span><\/li>\n
To complement the expanded services, the<\/span><\/span><\/span> essential list of medicines <\/strong><\/span><\/span><\/span>and diagnostics has been expanded to make available<\/span><\/span><\/span> <\/strong><\/span><\/span><\/span>medicines at Health Care-Health and Wellness Centres (HWCs).<\/span><\/span><\/span><\/li>\n
A new cadre of <\/span><\/span><\/span>Community Health Officers<\/strong><\/span><\/span><\/span>\u00a0 has been introduced at the level of SHC-HWC to act as <\/span><\/span><\/span>clinicians<\/strong><\/span><\/span><\/span> as well as <\/span><\/span><\/span>public health managers<\/strong><\/span><\/span><\/span> and to lead the team of Accredited Social Health Activists (ASHA), Anganwadi Workers (AWW) and Auxiliary Nurse Midwives (ANM).<\/span><\/span><\/span><\/li>\n
The facilities are being encouraged to undergo the <\/span><\/span><\/span>National Quality Assurance Standards (NQAS) assessment and certification<\/strong><\/span><\/span><\/span> with a target to realise 50% of the public health facilities being certified by 2026.<\/span><\/span><\/span><\/li>\n<\/ul>\n

In\u00a0 2018, the Government of India announced the creation of <\/span><\/span><\/span>1,50,000 Health and Wellness Centres (HWCs)<\/strong><\/span><\/span><\/span> by transforming existing Sub Centres and Primary Health Centres as the base pillar of Ayushman Bharat.\u00a0<\/span><\/span><\/span><\/li>\n
These centres would deliver <\/span><\/span><\/span>Comprehensive Primary Health Care (CPHC) <\/strong><\/span><\/span><\/span>bringing healthcare closer to the homes of people covering both maternal and child health services and non-communicable diseases, including free essential drugs and diagnostic services.<\/span><\/span><\/span><\/li>\n
The <\/span><\/span><\/span>National Health Policy of 2017<\/strong><\/span><\/span><\/span> envisioned these centres as the<\/span><\/span><\/span> foundation of India\u2019s health system.<\/strong><\/span><\/span><\/span><\/li>\n
AB-HWCs provide<\/span><\/span><\/span> free essential medicines and diagnostic services, <\/strong><\/span><\/span><\/span>teleconsultation, and health promotion including wellness activities like Yoga.<\/span><\/span><\/span><\/li>\n<\/ul>\n
