The Supreme Court has recently reminded the Union and several State governments of their \u201cconsistent failure\u201d to act against the lynching and mob violence.\u00a0<\/span><\/span><\/span>\n

The Court has asked the Ministry of <\/span><\/span><\/span>Home Affairs, Maharashtra, Odisha, Rajasthan, Bihar, Madhya Pradesh <\/strong><\/span><\/span><\/span>and <\/span><\/span><\/span>Haryana<\/strong><\/span><\/span><\/span> to respond<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n
What is Mob Lynching?<\/u><\/strong><\/span><\/span><\/span><\/p>\n
\n
About: <\/strong><\/span><\/span><\/span>It is a form of violence in which a mob, under the pretext of administering justice without trial, punishes and inflicts torture on a presumed offender, sometimes even resulting in murders.<\/span><\/span><\/span><\/li>\n
Origin:<\/strong><\/span><\/span><\/span> The word lynching in fact originated in the United States in the mid-18th century.\u00a0<\/span><\/span><\/span>\n
\n
Historians believe that the term was first used by planter Charles Lynch to describe extra-judicial authority assumed by private individuals like him.<\/span><\/span><\/span><\/li>\n
It came to be applied over time to extra-judicial killings by crowds, most commonly of African-Americans in the late 19th century.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
Impacts: <\/strong><\/span><\/span><\/span>The spate of incidents of lynching over the past few years has led to a heightened sense of insecurity among the marginalised communities.<\/span><\/span><\/span><\/li>\n<\/ul>\n
Reasons<\/u><\/strong><\/span><\/span><\/span><\/p>\n

Combined effect of various factors: <\/strong><\/span><\/span><\/span>A combined effect of political, socio-economic, and psychological factors have led to a situation of hyper-reactivity among large populations even in rural areas and small towns.\u00a0<\/span><\/span><\/span>\n
\n
These factors which instigated the people include deep discontent and anger in rural youth populations due to the worsened crisis of agriculture and bleak employment opportunities.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
Poor Law and order: <\/strong><\/span><\/span><\/span>Most lynchings have occurred in remote areas, on highways, or in the countryside.\u00a0<\/span><\/span><\/span>\n
\n
The network of law and order is generally lax in these areas and even a set of enthusiastic police personnel might not reach the location on time to prevent violence.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
Role of social media: <\/strong><\/span><\/span><\/span>Smartphones and cheap internet have become a common phenomenon only after 2010.\u00a0<\/span><\/span><\/span>\n
\n
Lynchings are often fuelled by rumors spread on social media platforms.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
Religion-based: <\/strong><\/span><\/span><\/span>There have been dozens of killings on the name of religion in the last few years.<\/span><\/span><\/span>\n

The lynching of and mob violence against Muslims and marginalised sections by \u201ccow vigilantes\u201d in particular.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
Witch-hunting: <\/strong><\/span><\/span><\/span>Witch-hunting was one of the reasons for mob violence, where 2000 mentally challenged women were lynched for rumours that put an allegation upon them of stealing and murdering children.<\/span><\/span><\/span><\/li>\n<\/ul>\n
2018 Judgment – Tehseen S. Poonawalla Case<\/u><\/strong><\/span><\/span><\/span><\/p>\n
\n
In <\/span><\/span><\/span>2018, the Court, in Tehseen S. Poonawalla vs Union of India, <\/strong><\/span><\/span><\/span>had held that it was the <\/span><\/span><\/span>\u201csacrosanct duty\u201d of the state <\/strong><\/span><\/span><\/span>to <\/span><\/span><\/span>protect the lives <\/strong><\/span><\/span><\/span>of its citizens and that the authorities have the \u201cprincipal obligation\u201d to <\/span><\/span><\/span>prevent \u201cvigilantism\u201d<\/strong><\/span><\/span><\/span> of any kind.\u00a0<\/span><\/span><\/span><\/li>\n
It had come up with guidelines that included\u00a0<\/span><\/span><\/span>\n
\n
The <\/span><\/span><\/span>designation of a nodal [police] officer<\/strong><\/span><\/span><\/span> in each district, who, with the identification of districts\/blocks\/villages where mob violence and lynching have occurred in recent years, and\u00a0<\/span><\/span><\/span><\/li>\n
The help of<\/span><\/span><\/span> police intelligence,<\/strong><\/span><\/span><\/span> would work towards tackling such incidence in coordination with other government agencies.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
They were also to be aided by the<\/span><\/span><\/span> initiative of the Home Ministry and State governments <\/strong><\/span><\/span><\/span>in sensitising law enforcement officials and <\/span><\/span><\/span>warning the public <\/strong><\/span><\/span><\/span>about the consequences of engaging in mob violence or vigilantism, among other measures.<\/span><\/span><\/span><\/li>\n<\/ul>\n
Government initiatives to deal such mob actions<\/u><\/strong><\/span><\/span><\/span><\/p>\n

Creation of Nodal Officers: <\/strong><\/span><\/span><\/span>Central government has asked states to appoint a nodal officer in each district to prevent the incidents of mob violence and lynching.<\/span><\/span><\/span>\n
\n
As per advisory from the Home Ministry, the nodal officer should be a superintendent of police-level officers.<\/span><\/span><\/span><\/li>\n
It has also asked to set up a special task force to procure intelligence reports about the people who are likely to commit such crimes or who are involved in spreading hate speeches, provocative statements and fake news.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
Creation of Two High Level Committees: <\/strong><\/span><\/span><\/span>Two high-level committees were constituted by the Central government to suggest ways and legal framework to effectively deal with incidents of mob violence and lynching.<\/span><\/span><\/span><\/li>\n
Awareness generation: <\/strong><\/span><\/span><\/span>The government through audio-visual media has also generated public awareness to curb the menace of mob lynching.\u00a0<\/span><\/span><\/span>\n

The government has also sensitized the service providers to take steps to check the propagation of false news and rumours having the potential to incite mob violence and lynching.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
Jharkhand\u2019s Law: <\/strong><\/span><\/span><\/span>The <\/span><\/span><\/span>Jharkhand Assembly <\/strong><\/span><\/span><\/span>passed the Prevention of Mob Violence and Mob Lynching Bill, 2021, which aims at providing \u201ceffective protection\u201d of constitutional rights and the prevention of mob violence in the state.<\/span><\/span><\/span>\n

The Bill defines lynching <\/strong><\/span><\/span><\/span>as \u201cany act or series of acts of violence or death or aiding, abetting or attempting an act of violence or death, whether spontaneous or planned, by a mob on the grounds of religion, race, caste, sex, place of birth, language, dietary practices, sexual orientation, political affiliation, ethnicity or any other ground\u201d.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n
Issues & challenges<\/u><\/strong><\/span><\/span><\/span><\/p>\n
\n
Lynching, mob violence and <\/span><\/span><\/span>\u201ccow vigilantism\u201d<\/strong><\/span><\/span><\/span> \u2014 an incorrect euphemism for criminals engaging in wanton violence against minorities for the purported reason of transporting cattle for slaughter or cattle meat.<\/span><\/span><\/span>\n
\n
Such activities still happen <\/span><\/span><\/span>since the judgment and little has been done by the Union government or the States<\/strong><\/span><\/span><\/span> in question, especially in north India.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
Besides vigilantism, <\/span><\/span><\/span>social and economic boycott of the minority community<\/strong><\/span><\/span><\/span> have also taken root in States where they receive political patronage.\u00a0<\/span><\/span><\/span><\/li>\n
The Court is right in issuing orders to agencies of the state in holding them to account for the non-implementation of the guidelines in the 2018 judgment.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n
Way Ahead<\/u><\/strong><\/span><\/span><\/span><\/p>\n
\n
It requires no<\/span><\/span><\/span> less than concerted civil society action<\/strong><\/span><\/span><\/span> to tackle the menace of mob violence and \u201cvigilantism\u201d by <\/span><\/span><\/span>sensitising people towards fraternal relations<\/strong><\/span><\/span><\/span> with other communities and avoiding typecasting them as the \u201cother\u201d.\u00a0<\/span><\/span><\/span><\/li>\n
In Tamil Nadu, for example, <\/strong><\/span><\/span><\/span>where, historically, secular and rational movements were active, such incidents are rare.\u00a0<\/span><\/span><\/span>\n
\n
And if they do occur, dominant political representatives face outrage from civil society.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
Preventing atrocities of the kind that mob violence wreaks on ordinary citizens cannot be left to just judicial fiat.<\/span><\/span><\/span><\/li>\n<\/ul>\n
