for sex.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<p><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong><u>Defining consent<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>POCSO:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">A <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>\u2018child\u2019 under POCSO<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"> is defined as any <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>person below the age of 18 years<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Acts of penetrative sexual assault<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"> committed on children are criminal offences under <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>POCSO<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The purpose of <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>defining \u2018child\u2019 under POCSO<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">, and of the provision under <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Section 375 of the IPC<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"> (sexual intercourse, whether with or without her consent, is rape if she is under 18 years of age), is<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> to safeguard children against penetrative sexual assault<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"> irrespective of their consent, which could even be unequivocal and voluntary.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>IPC:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">Otherwise, the third part of <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Section 90 of the IPC<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">, which provides that consent is not consent \u201cunless the contrary appears from the context, if it is given by <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>a person who is under 12 years<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">\u201d, was sufficient to interpret consent for a child of any age.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>SC &#038; ST Prevention of Atrocities Act:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">According to the <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989,<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"> if certain prohibited acts are committed with the knowledge of the caste of the victim, intention does not have to be proved separately.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The provision was made specifically<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> to safeguard vulnerable groups<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">Similarly, if children are to be treated as a separate and vulnerable category, consent should be of no avail if the accused had knowledge of the victim being a child.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong><u>Opinion of Judiciary<\/u><\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">\u00a0<\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>About:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">In the various cases, <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>High Courts neither honoured the age of consent<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"> nor took any cognisance of the <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>mandatory legal presumption <\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">in favour of the prosecutors.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">Even the<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> difference between the age<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"> of the prosecutor and the age of the accused, which <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>ranged up to 10 years<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">, was not taken into account.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">Though there are recommendations from various sources to reduce the age of consent from 18 to 16 years, the case where the victim was 15 years was also not paid heed to.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Bombay HC\u2019s recent recommendation:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The court has pointed out that after the enactment of<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> the Protection of Children from Sexual Offences (POCSO) Act, 2012, <\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">many adolescents are being prosecuted for consensual relationships with minor girls.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The Court recommended that the Indian government consider reducing the age of consent of the prosecutrix from 18 to 16 years.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Rationale behind court\u2019s opinion:<\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">One of the reasons, for the reluctance of courts to convict accused persons in consensual sex cases could be<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> the harsh minimum imprisonment<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">, which is 10 years and 20 years for penetrative sexual assault and aggravated penetrative sexual assault, respectively.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">Instead of proving to be a deterrent, this appears to be benefiting the accused.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<p><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong><u>Isuses<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Burdon on Police forces:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">None of the provisions of the IPC or POCSO has been declared unconstitutional by the courts.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">Therefore, quashing the cases of consensual sex <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>may not lead to any less work for the police<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">; they will still have to register FIRs whenever a child goes missing or a cognisable offence is reported either by parents or any other third party and proceed with their investigation.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Evaluation of Increasing Minimum Age of Marriage:\u00a0<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">A parliamentary committee is looking into <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>the Prohibition of Child Marriage (Amendment) Bill, 2021<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"> which seeks to increase the minimum age of marriage for women to 21 years.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">Rights activists feel instead of helping the community, raising the age may force vulnerable women to remain under the yoke of family and social pressures.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Socio-Legal Responses in India:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">A study published by Partners for Law in Development in 2019.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The study noted that in many cases, a couple elopes fearing opposition from parents resulting in a situation where families file a case with the police, who then book the boy for rape under the POCSO Act and abduction with the intent to marry under IPC or the Prohibition of Child Marriage Act, 2006.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Restrictions on freedom:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The study also records that while girls face restrictions on their mobility, premarital relations and sexuality, the same was not true for boys of the same social milieu who enjoyed greater freedom.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong><u>Suggestions<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Deciding on case to case basis:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> Bureau of Police Research and Development <\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">could analyse the<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> cases of consensual sex<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"> (as has been directed by the Madras High Court), age-wise, across States and help the Central government in taking a decision of reducing the age of consent based on that study.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Reducing the age of consent:\u00a0<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">One solution could be to reduce the age of consent with some leverage allowed to the judiciary to interpret consent in cases of the victim being of lower age <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>based on the child\u2019s understanding of consequences<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The caveat of the \u2018best interest of the child\u2019 would be necessary.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Role of apex court:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">While reducing the age of consent is within the jurisdiction of Parliament, the <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Supreme Court must step in to quickly<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"> <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>resolve <\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">the gap between the laid down law (as understood by the investigating agencies) and the different interpretations by the High Courts.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">This acquires importance in light of th<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>e Supreme Court judgment in Independent Thought v. Union of India (2017)<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"> wherein it held that even <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>sexual intercourse with a minor wife is rape<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong><u>Way Ahead<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The government needs to look into the issue with the courts and rights activists seeking amendment to the age of consent criteria.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">In the meantime, adolescents have to be made aware of the stringent provisions of the POCSO Act and also the IPC.
