style=\"color:#000000\"><strong>Chief Election Commissioner and other Election Commissioners (Appointment, Conditions of Service and Term of Office) Bill, 2023,<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"> was recently introduced in Rajya Sabha.<\/span><\/span><\/span><\/li>\n<\/ul>\n<p><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong><u>Need for the law<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Appointment of election commissioners:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The Supreme Court while<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> examining a series of petitions seeking functional independence for Election Commissioners<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"> had ruled that the selection panel should comprise the Prime Minister, the Leader of the Opposition, and the Chief Justice of India (CJI).<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">This selection panel to be continued until Parliament enacts a law on the manner of appointment.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Issue of incompletion of tenure:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The SC also noted that although the CEC\u2019s tenure is six years under \u2018The Chief Election Commissioner And Other Election Commissioners (Conditions Of Service) Act, 1991\u2019, no CEC has completed his tenure since 2004.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong><u>The Chief Election Commissioner and other Election Commissioners (Appointment, Conditions of Service and Term of Office) Bill, 2023:<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>About:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The bill<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> repeals the Election Commission (Conditions of Service of Election Commissioners and Transaction of Business) Act, 1991<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">As per <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Article 324 <\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">of the Constitution, the Election Commission consists of the Chief Election Commissioner (CEC) and such number of other Election Commissioners (ECs), as the President may decide.\u00a0 The CEC and other ECs are appointed by the President.\u00a0\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The Bill specifies the<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> same composition of the Election Commission<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Selection Committee:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The Bill has proposed that the selection panel for appointing the Election Commission, comprising the Chief Election Commissioner (CEC) and other Election Commissioners (ECs), will consist of\u00a0<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:square\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The Prime Minister as the chairperson,\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:square\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The Leader of the Opposition as a member, and\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:square\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">A Union Cabinet Minister nominated by the Prime Minister as another member.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The bill removed the Chief Justice of India (CJI) from a previously constituted three-member panel to select the Chief Election Commissioner (CEC) and Election Commissioners.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Search Committee:\u00a0<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">A Search Committee will prepare a<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> panel of five persons <\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">for the consideration of the Selection Committee.\u00a0\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The Search Committee will be<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> headed by the Cabinet Secretary<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">.\u00a0\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Qualification of CEC and ECs:\u00a0<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">Persons who are holding or have held posts equivalent to the rank of Secretary to the central government will be eligible to be appointed as CEC and ECs.\u00a0\u00a0\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">Such persons must have expertise in managing and conducting elections.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Removal and resignation:\u00a0<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Under Article 324<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"> of the Constitution, the CEC can only be removed from his office in a<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> manner similar to that of a Supreme Court judge<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">.\u00a0\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">This is done through an<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> order of the President, <\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">based on a motion passed by both Houses of Parliament in the same session.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The motion for removal must be adopted with: (i) majority support of total membership of each House, and (ii) at least two-thirds support from members present and voting.\u00a0\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">An EC can only be removed from office <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>on the recommendation of the CEC<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">Further, the 1991 Act provides that the<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> CEC and other ECs may submit their resignation to the President<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The Bill <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>retains this removal &#038; resignation procedure<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong><u>Challenges &#038; Criticisms<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Making EC a puppet:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">This composition of the selection panel puts a<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> question mark on the neutrality of the Election Commission (EC)<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"> as the selection panel would effectively have two members of the ruling party\u2014 the Prime Minister and the Cabinet Minister.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The Opposition has been arguing that the replacement of the CJI with a Cabinet Minister in the Bill indicates that the government is trying to make the poll body a puppet.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Against the spirit of fundamental rights:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The court judgment says that the right to vote is a fundamental right, effectuated by the Election Commission through the conduct of elections.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">And therefore, to ensure that this right can be exercised properly, the Election Commission has to be independent of the executive.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">So, while the Bill, as proposed, follows the letter of the judgment, it does not at all follow the spirit of the judgment.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Counter to a recent judgment:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The SC suggested that the least intrusive will be a system where there is a presence of the Chief Justice in the appointment committee.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The bill <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>runs counter to this judgment <\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">of a Constitution Bench.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The judgment was also in line with the recommendations of the Dinesh <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>Goswami Committee in 1990 <\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">and the<\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong> Justice Tarkunde Committee in 1975<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong><u>Way ahead<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The Election Commission of India is a constitutional body that <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>not only conducts elections<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"> but also renders a <\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\"><strong>quasi-judicial role<\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">ECI has played a seminal role in the periodic conduct of elections, which have only seen greater participation from the electorate because of the largely free, fair and convenient nature of the process.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#000000\">The need for a selection process that embodies insulation from executive preponderance makes sense.
