This applies to both the state legislatures and the Lok Sabha.\u00a0<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">The terms of Legislative Assemblies and the Lok Sabha may not synchronize with one another.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/div>\n<h3 style=\"text-align: justify;\"><span style=\"font-size: 13pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong><u>What is \u2018One Nation One Election\u2019?<\/u><\/strong><\/span><\/span><\/span><\/h3>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong>Meaning <\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">: The idea of \u201cOne Nation, One Election\u201d envisages a system where elections to all states and the Lok Sabha will have to be held simultaneously.\u00a0<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">This will involve the restructuring of the Indian election cycle in a manner that elections to the states and the centre synchronise.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">This would mean that the voters will cast their vote for electing members of the LS and the state assemblies on a single day, at the same time (or in a phased manner as the case may be).<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong>Background<\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">: Simultaneous elections\u00a0 were the norm until 1967. But following the dissolution of some Legislative Assemblies in 1968 and 1969.<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">The idea of reverting to simultaneous polls was mooted in the annual report of the Election Commission in 1983.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">The Law Commission\u2019s Report also referred to it in 1999.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">The Niti Aayog prepared a working paper on the subject in January 2017.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">The Law Commission brought out in April 2018, it said that at least \u201c<\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong>five Constitutional recommendations<\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">\u201d would be required to get this off the ground.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong>Implementation process :\u00a0 <\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">The five amendments in the Constitution would entail changes to <\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"> relating to the imposition of President\u2019s Rule in States.<\/span><\/span><\/span><\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><span style=\"font-size: 13pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong><u>Pros\u00a0<\/u><\/strong><\/span><\/span><\/span><\/h3>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">The primary benefits of \u2018One Nation, One election\u2019 is the <\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong>reduction in the cost of conducting elections<\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"> as each separate election requires a huge amount of financial resources.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">Having simultaneous elections <\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong>would ease the burden on administrative <\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">and <\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong>security forces<\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">, who otherwise are engaged multiple times in election duties.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">The government<\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong> can focus more on governance <\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">rather than being in an election mode, which often hampers policy implementation.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">Simultaneous elections, according to the Law Commission, <\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong>will increase voter turnout<\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"> because it will be easier for people to cast many ballots at once.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">It can help ensure continuity in the policies and programmes of the central and state governments.\u00a0<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">Currently, the Model Code of Conduct is imposed whenever elections are set to take place, putting a ban on the launch of new projects for public welfare for that period.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong style=\"color: initial; font-family: Georgia, serif; font-size: 13pt; text-align: justify;\"><u>Cons<\/u><\/strong><\/p>\n<ul>\n<li><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong>National and state issues <\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">are different, and holding simultaneous elections is likely to affect the judgement of voters.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">Since elections will be held once every five years, it will <\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong>reduce the government&#8217;s accountability to the people<\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">.\u00a0<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: around 30 lakh electronic voting machines (EVMs) and voter-verified paper audit trail (VVPAT) machines, and deploying central forces around the country\u00a0 will be style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">Simultaneous elections to Parliament and Assemblies could be held by bringing in changes to the existing laws, seeking the support of all national and recognised political parties and by ensuring understanding between States.<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">It would also require an additional number of electronic voting machines (EVMs) and VVPATs (paper trail style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong>Governor<\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">, but these <\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong>mandated by Article 74(1) <\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">of Constitution of India.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">Section 473(1) of the BNSS allows <\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong>a convict \u201cunder the sentence of death\u201d or his legal heir or any relative<\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"> to file a mercy petition within 30 days when the Jail Superintendent informs him about the:<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">dismissal of the appeal or special leave to appeal by the Supreme Court, or<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">date of confirmation of the sentence of death by the High Court and the time allowed to file an appeal or special leave in the Supreme Court has expired.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">In cases where there are multiple convicts, the jail superintendent or the officer-in-charge shall ensure that every convict makes a mercy petition within 60 days.<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">If the Superintendent doesn\u2019t receive the mercy petitions from all other convicts in the case, he shall himself send the names, addresses, copy of the record of the case and all other details of the case to the Central Government or State Government.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">While this 60-day time limit has been given to the Centre, no time limit has been prescribed for the President to dispose of the mercy petitions.<\/span><\/span><\/span><\/li>\n<li style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">, his rejection or disposal of the petition will result in it being forwarded to the President <\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"><strong>powers of the President or Governor under Articles 72<\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\"> and <\/span><\/span><\/span><span style=\"font-size: any question as to the arriving of the decision by the President shall not be enquired into in any Court.<\/em><\/strong><\/span><\/span><\/span><span style=\"font-size: 12pt;\"><span style=\"font-family: Georgia,serif;\"><span style=\"color: #000000;\">\u201d<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 12pt;\"><span
